The Energy Act 1983 (Commencement No. 2) Order 1988

Made6th September 1988

The Secretary of State, in exercise of his powers under section 37(1) and (2) of the Energy Act 19831 (hereinafter called “the Act”), and of all other powers enabling him in that behalf, hereby makes the following Order:—

This Order may be cited as the Energy Act 1983 (Commencement No. 2) Order 1988.

The repeals in Part 1 of Schedule 4 to the Act specified in the Appendix to this Order shall, subject to paragraph (2) of this Article, come into force on 1st October 1988.

Notwithstanding the repeal of paragraph (c) of section 10 of the Schedule to the Electric Lighting (Clauses) Act 18992, any approval given under that paragraph shall continue to apply, and the regulations of the Electricity Supply Regulations 19883 specified in regulation 2(1) of those Regulations shall not apply, in relation to the works the subject of the approval until the date on which there is a material change to those works.

This Order brings into force on 1st October 1988 further repeals contained in Part I of Schedule 4 to the Energy Act 1983. The Electricity Supply Regulations 1937 and the Electricity (Overhead Lines) Regulations 1970 (S.I.1970/1355) which were made or continued in force under section 60 of the Electricity Act 1947 will be revoked on the repeal of that section. They are replaced by the Electricity Supply Regulations 1988 (S.I.1988/1057).
