In exercise of the powers conferred upon the Secretary of State by paragraphs 5 and 6 of Schedule 10 to the Local Government Planning and Land Act 19801 and after consulting in accordance with paragraph 8 of that Schedule such associations of local education authorities as appeared to me to be concerned, I hereby make the following Regulations:

These Regulations may be cited as the Block Grant (Education Adjustments) (England) (Amendment) Regulations 1988 and shall come into force on 6th October 1988.

For sub-paragraph (b) of regulation 6(3) of the Block Grant (Education Adjustments) (England) Regulations 19872 (“the principal regulations”) there shall be substituted the following sub-paragraph—

b

those attending a full-time course of less than 19 weeks duration shall not be counted;

After sub-paragraph (b) of regulation 6(3) of the principal regulations there shall be added the following sub-paragraph—

ba

those attending a part-time course of less than 11 days duration shall not be counted;

At the end of paragraph (5) of regulation 6 of the principal regulations there shall be added the following words—

and the calculation required by paragraph (3)(ba) above shall be made having regard only to those part-time courses the duration of which is recorded in that data in units of days.

In Schedule 1 to the principal regulations—

i

there shall be added to the list in paragraph (a)(iii) at the appropriate alphabetical position “Thames Polytechnic”;

ii

for the list in paragraph (a)(iv) there shall be substituted the following list—

Avery Hill College

Manchester Polytechnic

National Council of Young Men’s Christian Associations, in association with North East London Polytechnic

Thames Polytechnic

University of Ulster;

iii

there shall be added after paragraph (a)(iv) the following sub-paragraphs—

v

a course for the Diploma in Higher Education or for the degree of Bachelor of Education (Honours) provided by Crewe and AlsagerCollege of Higher Education;

vi

a course for the degree of Bachelor of Education provided by St Martin’s College, Lancaster;

vii

a course for the degree of Bachelor of Education in Youth and Community Studies provided by Westhill College of Education, Birmingham, Roehampton Institute of Higher Education or Thames Polytechnic;

viii

any other course of initial training for youth workers and/or community centre wardens endorsed by the Council for Education and Training in Youth Work and approved by the Joint Negotiating Committee for Youth Workers and Community Centre Wardens.

iv

for paragraph (b) there shall be substituted the following paragraph—

b

if he is, on 6th October 1988 a qualified teacher or becomes such before 1st January 1989

in paragraph (d) for the year 1984 there shall be substituted the year 1988;

after paragraph (d) there shall be added the following paragraph—

if he has successfully completed a part-time apprenticeship scheme for youth workers and/or community centre wardens provided by—

  • Westhill College of Education, Birmingham and known as “Interface”,

  • Goldsmiths College, London and known as “Turning Point”, or

  • the City of Sheffield and known as “the Community Work Apprenticeship Scheme”;

In Schedule 2 to the principal regulations there shall be added after paragraph 2(1) (g)(iii) the following sub-paragraph—

a General Certificate of Secondary Education recording that the Student attained grade C or above in at least five subjects or,

These Regulations amend the Block Grant (Education Adjustments) (England) Regulations 1987 which provide for the adjustment of block grant payable to local authorities in England in respect of the financial year 1987/8 and subsequent years.

First there are amendments to regulation 6 (which provides for the apportionment of expenditure in accordance with the formulae contained therein). Regulation 6(3)(b) provided that students attending a course (whether full-time or part-time) of less than 19 weeks duration should not be counted for the purpose of counting the number of students attending relevant courses. By virtue of the amendments, while students attending a full-time course of less than 19 weeks duration continue not to be counted (regulation 2(1)), students attending a part-time course are to be counted unless the course is one of less than 11 days duration, that calculation being made having regard only to those part-time courses the duration of which is recorded in days in the data available to the Secretary of State (regulation 2(2) and (3)).

Secondly, there are amendments to Schedule 1 (which specifies certain qualifications for the purposes of the definition of youth and community worker in regulation 2(1)). The amendments add to the list of courses satisfactory completion of which means that a person is to be treated as qualified as a youth and community worker for the purposes of the Regulations. They also revise and add to the other circumstances in which a person is to be so treated (regulation 3).

Thirdly, there is an amendment to Schedule 2 (which sets out the courses of advanced further education to which the Regulations apply). Certain courses are included where they may be taken only by students who have attained the age of 18 and hold any of the qualifications listed. A General Certificate of Secondary Education recording that the student attained grade C or above in at least 5 subjects is added to that list of qualifications (regulation 4).
