The Statutory Water Companies (Occupational Pension Schemes) Regulations 1988

Coming into force

The Secretary of State, in exercise of the powers conferred on him by section 17(2) of the Social Security Act 19861 and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Statutory Water Companies (Occupational Pension Schemes) Regulations 1988 and shall come into force on 1st September 1988.

Compulsory membership of statutory water company schemes2

Section 27 of the Water Act 19732 shall have effect with the omission of subsection (5).

Section 17(2) of the Social Security Act 1986, as amended by the Social Security Act 1988, empowers the Secretary of State to make regulations modifying the effect of specified Acts in consequence of the provisions of Part I of the 1986 Act.

In consequence of the provisions of section 15 of the 1986 Act (terms of contracts of employment or pension schemes which restrict choice of pension schemes to be void), these Regulations revoke section 27(5) (which provided, with one excepted class, that every employee of a statutory water company shall be a member of the standard water company scheme) of the Water Act 1973 with effect from 1st September 1988.
