The Naval Medical Compassionate Fund (Amendment) Order 1988

Her Majesty, in pursuance of section 1 of the Naval Medical Compassionate Fund Act 19151, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

This Order shall come into force on 1st October 1988 and may be cited as the Naval Medical Compassionate Fund (Amendment) Order 1988.

The Order in Council dated 28th July 19152, whereby Standing Orders and Regulations for the Constitution and Government of the Naval Medical Compassionate Fund (“the Standing Orders and Regulations”) were approved, shall be amended as follows.

In Article 2 of the Standing Orders and Regulations for the words “Accountant General of the Navy” there shall be substituted the words “Assistant Under Secretary of State (Naval Personnel)”.

For Article 8 of the Standing Orders and Regulations there shall be substituted:

The Annual Subscription shall be £1.05 or such other sum as the Trustees may decide payable on the 1st day of January each year to the Honorary Treasurer of the Fund.

A person eligible to become or continue as a Subscriber to the Fund may pay to the Honorary Treasurer of the Fund a Life Subscription calculated in accordance with the provisions of the Schedule to these Standing Orders and Regulations.

Where a person pays a Life Subscription in accordance with paragraph (2) above, he shall for the remainder of his life be deemed to be a Subscriber to the Fund.

For paragraph (b) of Article 9 of the Standing Orders and Regulations there shall be substituted:

The Orphans and Widows of such Persons as may hereafter become Subscribers to the Fund provided that:

i

before their death they had paid a Life Subscription, or

ii

at the date of their death their Annual Subscription was not more than 9 months in arrear.

The provisions set out in the Schedule to this Order shall have effect as a Schedule to the Standing Orders and Regulations.

SCHEDULEPROVISIONS HAVING EFFECT AS A SCHEDULE TO THE STANDING ORDERS AND REGULATIONS

PART I

The Life Subscription payable by a person under Article 8(2) shall be the annual subscription multiplied by the appropriate multiplier.

In paragraph 1 above “annual subscription” means the Annual Subscription payable by Subscribers to the Fund under Article 8(1) as at the date that the Life Subscription is paid.

The Table in Part II of this Schedule shows the appropriate multiplier for the purposes of paragraph 1 above by reference to the age of the person at the date of payment of the Life Subscription and to his or her sex.

For the purposes of the Table a person

a

between two particular ages includes a person who has attained the first or the second;

b

is over 64 years if he has attained the age of 65 years.

This Order amends the Standing Orders and Regulations of the Naval Medical Compassionate Fund. It provides for the Assistant Under Secretary of State (Naval Personnel) for the time being to be a trustee of the Fund instead of the Accountant General of the Navy for the time being. It also enables a person to become a subscriber for life by paying a single lump sum.
