The Secretary of State for Transport, in exercise of the powers conferred by section 40(1) and (3) of the Road Traffic Act 19721, now vested in him2, and after consultation with representative organisations in accordance with section 199(2) of that Act, hereby makes the following Regulations:—

Citation, Commencement and Introduction

These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 3) Regulations 1988 and shall come into force on 12th July 1988.

The Road Vehicles (Construction and Use) Regulations 19863 hereinafter “the principal Regulations” shall be further amended in accordance with regulation 3.

The Secretary of State is satisfied that —

a

it is requisite that the provisions of regulation 3 of these Regulations (being provisions which vary the requirements as regards the construction of certain classes of vehicles) shall apply as from 12th July 1988 to vehicles registered under the Vehicles (Excise) Act 19714 before the expiration of one year from the making of these Regulations; and

b

notwithstanding that the said provisions will then apply to those vehicles, no undue hardship or inconvenience will be caused thereby.

The principal Regulations shall have effect as if the Road Vehicles (Construction and Use) (Amendment) (No. 2) Regulations 19885 had never been made.

The Road Vehicles (Construction and Use) (Amendment) (No. 2) Regulations 1988 are hereby revoked.

These Regulations revoke the Road Vehicles (Construction and Use) (Amendment) (No. 2) Regulations 1988 which were defective, and provide that the Road Vehicles (Construction and Use) Regulations 1986 shall have effect as if the (Amendment) (No. 2) Regulations had never been made.
