Her Majesty, in exercise of the powers conferred upon Her by section 94 of the Merchant Shipping Act 19701, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

This Order may be cited as the Merchant Shipping (Tonnage) (Overseas Territories) Order 1988 and shall come into force on 21st July 1988.

The provisions of section 91 of the Merchant Shipping Act 1970 shall extend to each of the territories, any one of which is in this Order referred to as “the Territory”, specified in Schedule 1 to this Order, as part of the law thereof, with the exceptions, adaptations and modifications specified in Schedule 2 to this Order, and the reference in that section to the Merchant Shipping Act 19652 shall be to that Act as extended to the Territory by the Merchant Shipping (Tonnage) (Overseas Territories) Order 19713.

In section 1 (6) of the Merchant Shipping Act 1965, as substituted by section 91:
a
for any reference to the Board of Trade there shall be substituted a reference to the Governor;
b
for the reference to the United Kingdom there shall be substituted a reference to the Territory.

In section 1 (6A) of the Merchant Shipping Act 1965, as substituted by section 91, for the reference to a fine not exceeding £100 there shall be substituted a reference in the case of the Turks and Caicos Islands and the British Virgin Islands to a fine not exceeding 200 United States dollars.
