The Education (Schools and Further Education) (Amendment) Regulations 1987

In exercise of the powers conferred by sections 27(1)(e) and (7) and 35(4) of the Education Act 19801 the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:

Citation and commencement1

These Regulations may be cited as the Education (Schools and Further Education) (Amendment) Regulations 1987 and shall come into force for the purposes of this regulation and regulation 2 on 8th June 1987 and for all other purposes on 1st August 1987.

Duration of school year

In regulation 10 (Duration of school year and day) of the Education (Schools and Further Education) Regulations 19812 paragraph (7) shall be amended as follows—

For the words “the academic year 1985/86” there shall be substituted the words “the year ending on 31st July 1987”;

In the proviso, for the words “four sessions” there shall be substituted the words “two sessions”.

With effect from 1st August 1987 the said regulation 10 shall be further amended as follows—

In paragraph (2), for the provision before the proviso there shall be substituted the following provision—

In each academic year a school shall meet for not less than 380 sessions which shall constitute the school year so however that nothing in this paragraph shall require a nursery class to meet for that number of sessions:

In paragraph (3), for the words “paragraphs (5), (6) and (7)” there shall be substituted the words “paragraphs (5) and (6)”;

In this regulation “academic year” means a period of 12 months beginning on 1st September unless the school has a term beginning in August in which case it means a period of 12 months beginning on 1st August.

Revocation4

The Education (Schools and Further Education) (Amendment) Regulations 19863 are hereby revoked.

These Regulations amend that part of regulation 10 of the Education (Schools and Further Education) Regulations 1981 which relates to the duration of the school year.

Regulation 2, which comes into force on 8th June 1987, amends regulation 10(7), inserted by the Education (Schools and Further Education) (Amendment) Regulations 1986, to provide that where, in the year ending on 31st July 1987, a school session is devoted to the provision to teachers at the school of training related to the introduction of the General Certificate of Secondary Education (GCSE), it shall be treated for the purpose of regulation 10 as a session on which the school has met. This provision applies in relation to a maximum of two sessions in that year.

Regulation 3, which comes into force on 1st August 1987, deletes the provisions relating to training for the GCSE inserted in 1986, as so amended (which by then will be spent) and makes fresh provision for the duration of the school year.

This duration continues to be expressed as a minimum number of sessions. Regulation 10(1) of the 1981 Regulations provides that every day on which a school meets shall normally be divided into two sessions, except in cases where the school meets on six days a week. With effect from 1st August 1987 the minimum number of sessions is reduced from 400 (subject to reduction for occasional holidays granted in term-time) to 380 in each academic year, defined as a period of 12 months beginning on 1st September, unless the school has a term which begins in August, in which case the year begins on 1st August. No provision is made for occasional holidays.

Regulation 4 revokes the amending Regulations made in 1986.
