The Nightwear (Safety) (Amendment) Regulations 1987

Whereas the Secretary of State has, in accordance with section 1(4) of the Consumer Safety Act 1978,(1) consulted such organisations as appear to him to be representative of interests substantially affected by these Regulations and such other persons as he considers appropriate:

And whereas a draft of these Regulations has been approved by a resolution of each House of Parliament pursuant to section 7(7) of the said Act of 1978:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 1 of, and paragraph 13 of Schedule 2 to, the said Act of 1978(1), hereby makes the following Regulations:

1.  These Regulations may be cited as the Nightwear (Safety) (Amendment) Regulations 1987 and shall come into force on 1st March 1987.

2.  Regulation 1 of the Nightwear (Safety) Regulations 1985(2) shall be amended by adding at the end the words—

, except that, for the purposes of the requirements imposed by them in relation to babies' garments, they shall come into operation on 1st September 19877.

Explanatory Note

(This Note is not part of the Regulations)

These Regulations amend the Nightwear (Safety) Regulations 1985. As a result, those Regulations come into force on 1st September 1987 as regards requirements relating to babies' garments. 1st March 1987 remains the date on which all other requirements of the 1985 Regulations come into force.

The 1985 Regulations impose requirements relating to the flammability performance of nightwear (which includes any babies' garments, as defined in Regulation 3(1)), its testing and labelling. Babies' garments are not required to comply with the flammability performance requirements but must be labelled so as to indicate whether or not they are capable of complying with those requirements.
