Coming into force

The Secretary of State for Transport, in exercise of the powers conferred by section 37(3)(a) of the Vehicles (Excise) Act 19711, as set out in paragraph 24 of Part I of Schedule 7 to that Act, and of all other enabling powers, hereby makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Road Vehicles (Prescribed Regulations for the Purposes of Increased Penalties) Regulations 1987 and shall come into force on 1st January 1988.

Prescribing of regulations2

The regulations of the Road Vehicles (Registration and Licensing) Regulations 19712 specified in column (1) of the Table below, the subject matter of which is briefly described in column (2) of the Table, are hereby prescribed for the purposes of paragraph (a) of section 37(3) of the Vehicles (Excise) Act 1971 (as set out in paragraph 24 of Part I of Schedule 7 to that Act).

These Regulations prescribe the regulations of the Road Vehicles (Registration and Licensing) Regulations 1971 where a contravention is to attract a maximum penalty of a fine not exceeding level 3 on the standard scale (currently £400). Contraventions of other regulations of the 1971 Regulations not hereby prescribed, and of other sets of regulations made under the Vehicles (Excise) Act 1971, continue to attract a lesser maximum penalty of a fine not exceeding level 2 (£100).
