The Police (Amendment) Regulations 1987

In exercise of the powers conferred on me by section 33 of the Police Act 1964(1), and after taking into account the recommendations made by the Police Negotiating Board for the United Kingdom and furnishing the said Board with a draft of the Regulations in accordance with section 2(1) of the Police Negotiating Board Act 1980(2), I hereby make the following Regulations:

1.  These Regulations may be cited as the Police (Amendment) Regulations 1987.

2.  These Regulations shall come into force on 16th November 1987 and shall have effect for the purposes of regulation 3(a), as from 1st July 1986, for the purposes of regulation 3(b), as from 1st February 1987, for the purposes of regulation 4(b) to (f), as from 15th June 1987, and for the purposes of regulation 4(h) and (j), as from 1st September 1987.

3.  The Police Regulations 1979(3) (as they continue to have effect in relation to the period prior to their revocation by the Police Regulations 1987(4)) shall be deemed to have been amended as follows —

(a)in regulation 36 (London weighting) and paragraph 3(2) of Schedule 4 (university scholars) for the words “£885” there shall be deemed to have been substituted the words “£945”;

(b)in regulation 48(3) (a) and (b) (supplementary rent allowance) for the words “£8.33” there shall be deemed to have been substituted the words “£13.92”.

4.  The Police Regulations 1987(4) shall be amended as follows—

(a)in regulation 5(1) (meanings assigned to certain expressions), in the definition of the expression “public holiday”, after the words “Christmas Day” there shall be inserted the words “the 26th December (if it falls on a Saturday or a Sunday), the 1st January (if it so falls),”;

(b)in regulation 39 (London weighting) and in paragraph 3(2) of Schedule 4 (university scholars) for the words “£885” there shall be substituted the words “£945”;

(c)in regulation 41(2)(a) (reckoning by constables of service in certain constabularies) after the words Ministry of Defence Police Act 1987(5)“ there shall be inserted the words or before the coming into force of that Act, comprising constables appointed under Section 3 of the Special Constables Act 1923(6) on the nomination of the Defence Council or, before 1st April 1964, of the Admiralty, Army Council or Air Council”;

(d)in regulation 43 (reckoning by constables of overseas police service) after paragraph (4) there shall be added the following provision—

(5) A certificate given by or on behalf of—

(a)the Secretary for Technical Co-operation before 27th November 1964, or

(b)the Minister of Overseas Development on or after that date but before 12th November 1970,

shall be treated for the purposes of paragraph (2) as if it had been given by or on behalf of the Secretary of State.:

(e)in regulation 44(1)(a) (deductions from pay of social security benefits and statutory sick pay) for the words “1982” there shall be substituted the word “1986”;

(f)in regulation 50(3)(a) and (b) (supplementary rent allowance) for the words “£8.33” there shall be substituted the words “£13.92”;

(g)in regulation 53(1)(d) (removal allowance) for the word “13” in the second place where it occurs there shall be substituted the word “39”;

(h)in Schedule 5 for tables A and B there shall be substituted respectively the tables set out in the Appendix to these Regulations;

(j)in paragraph 1 of Schedule 11 (dog handler’s allowance) for the words “£567” in sub-paragraph (a) there shall be substituted the words “£612”, and for the words “£771” in sub-paragraph (b) there shall be substituted the words “£831”.

Explanatory Note

(This note is not part of the Regulations)

These amending Regulations have effect, as provided by regulation 2, for the purposes of regulation 3(a), as from 1st July 1986, for the purposes of regulation 3(b), as from 1st February 1987, for the purposes of regulation 4(b) to (f), as from 15th June 1987, for the purposes of regulation 4(h) and (j) as from 1st September 1987 (retrospection is authorised by Section 33(4) of the Police Act 1964) and, for all other purposes, as from 16th November 1987.

Under regulation 3 the Police Regulations 1979 have deemed to have been amended for the purpose of increasing London weighting and the supplementary pay of university scholars in the City and the metropolitan police district (regulation 3(a)) and the Supplementary rent allowance (regulation 3(b)).

Regulation 4 amends the Police Regulations 1987.

Regulation 4(a) designates as public holidays for the purposes of the 1987 Regulations 26th December or 1st January where either of those dates falls on a Saturday or a Sunday.

Regulation 4(b) increases London weighting and the supplementary pay of university scholars in the City and the metropolitan police district.

Regulation 4(c) to (e) make good certain minor defects and omissions in the consolidation of the 1987 Regulations.

Regulation 4(f) increases the supplementary rent allowance.

Regulation 4(g) increases the period in respect of which additional removal expenses may be paid at the discretion of the police authority.

Regulation 4(h) increases pay.

Regulation 4(j) increases the dog handler’s allowance.
