The Essex (District Boundaries) Order 1987

Coming into force—
for the purpose of article 1(2)
for all other purposes
The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 19721 and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47 and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
Citation and commencement1

This Order may be cited as the Essex (District Boundaries) Order 1987.

This Order shall come into force on 1st January 1988 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 19762.

For all other purposes this Order shall come into force on 1st April 1988.
Transfer from the district of Braintree to the district of Maldon2
The area of the district of Braintree and the parish of Witham which is marked Area A on the map prepared by the Department of the Environment, marked “Map of the Essex (District Boundaries) Order 1987” and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976 shall be transferred to—
a
the district of Maldon;
b
the Wickham Bishops ward of that district;
c
the parish of Wickham Bishops;
d
the Tollesbury electoral division of the county of Essex;
e
the Dengie and Maldon petty sessional division.
Town and Country Planning3
Any provisions of a local plan adopted by the Braintree District Council which apply immediately before 1st April 1988 to the area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the Maldon District Council.
