The Local Government Reorganisation (Property) (Tyne and Wear) Order 1987

Whereas the Tyne and Wear Residuary Body, acting pursuant to section 67(2) of the Local Government Act 1985(1), has submitted proposals to the Secretary of State for the transfer of certain of its properties to local authorities, and he has decided to give effect to those proposals without modification:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(3) of that Act, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Local Government Reorganisation (Property) (Tyne and Wear) Order 1987 and shall come into force on 20th August 1987.

Specified Property

2.  There shall vest in each local authority mentioned below the property of the Tyne and Wear Residuary Body which is specified in the corresponding Schedule:—

Property held in connection with functions relating to highways

3.  All property of the Tyne and Wear Residuary Body, other than property specified in Schedule 6 to this Order, which was immediately before 1st April 1986 held by the Tyne and Wear County Council for the purposes of its functions relating to highways, shall vest in the council of the district in which it is situated.

Land below a highway

4.  Where on 1st April 1986 by virtue of section 263 of the Highways Act 1980(2) any highway vested in the council of any district within the area of the county of Tyne and Wear, any interest of the Tyne and Wear Residuary Body in any land below such highway shall vest in that council.

Rights and liabilities

5.  All rights and liabilities acquired or incurred by the Tyne and Wear Residuary Body exclusively in connection with any property transferred by this Order shall vest in the local authority to which that property is transferred.

SCHEDULE 1PROPERTY TRANSFERRED TO NEWCASTLE CITY COUNCIL

1.  Bessie Surtees' House, Sandhill.

2.  Blandford House, West Blandford Street.

3.  The following property in Elswick—

(a)Lynwood Terrace Industrial Units;

(b)Mill Lane Factories;

(c)Elliott Terrace Workshops;

(d)Rainbow Workshops, Elswick Road.

4.  Byker Hill Industrial Estate, Shields Road, Byker.

5.  Bells Close Industrial Estate, Lemington.

SCHEDULE 2PROPERTY TRANSFERRED TO NORTH TYNESIDE METROPOLITANBOROUGH COUNCIL

1.  Middle Engine Lane Transport Museum (otherwise known as the Tyne Tunnel Strategic Site), West Chirton.

2.  Hadrian Business Park, Middle Engine Lane.

3.  Algernon Industrial Estate, New York Road, Shiremoor.

4.  Cadcam Centre, Hadrian Road, Wallsend.

5.  Maurice Road Industrial Estate, Neptune Road, Wallsend.

6.  The following property in Killingworth—

(a)Camperdown Industrial Estate;

(b)Silver Birch Industrial Estate;

(c)Station Road Industrial Estate;

(d)George Stephenson Industrial Estate.

7.  Sandy Lane Industrial Estate, Wideopen.

SCHEDULE 3PROPERTY TRANSFERRED TO GATESHEAD METROPOLITAN BOROUGH COUNCIL

1.  Site of the former engineering works at Coulthards Lane, Saltmeadows.

2.  Brewery Lane Industrial Estate, Felling.

3.  A parcel of land consisting of approximately 2.52 hectares, lying east of Stoneygate Lane, and north of Felling By-pass, Felling.

4.  The following property in Dunston—

(a)Dunston Workshops, Railway Street;

(b)the site of the former flour mill, lying immediately north of the disused railway line at Riverside;

(c)the Pond Site, Wellington Road.

5.  The following property in Pelaw—

(a)Stonehills Offices, Shields Road;

(b)Green Lane Industrial Estate;

(c)Stonehills Industrial Estate.

Explanatory Note

(This note is not part of the Order)

This Order transfers properties formerly owned by the County Council of Tyne and Wear, and since the abolition of that council by the Local Government Act 1985 by the Tyne and Wear Residuary Body, to the councils of the districts in which they are situated. Article 2 effects transfers as follows:—

Article 3 transfers property which was held by the County Council immediately before its abolition for the purposes of its highways functions to the council of the district in which the property is situated. Schedule 6 makes exceptions to this transfer.

Article 4 transfers the sub-soil of highways to the district councils in the county, and article 5 makes provision for the transfer of the rights and liabilities associated with property transferred by the Order.

1980 c. 66. On 1st April 1986, by virtue of section 8 of and Schedule 4 to the Local Government Act 1985, metropolitan district councils became highway authorities for their areas, and by virtue of section 263 the highways vested in those councils.
