DETENTION CENTRES

The Detention Centre (Amendment) Rules 1987

In pursuance of sections 25(1) and 47 of the Prison Act 1952(1), I hereby make the following Rules:

1.  These Rules may be cited as the Detention Centre (Amendment) Rules 1987 and come into force on 13th August 1987.

2.  Rule 6 of the Detention Centre Rules 1983(2)(which relates to remission of sentence) shall be amended by substituting for paragraph (2) the following paragraph:—

(2) The remission granted under this rule shall not exceed one-half of the total of the actual term and any period taken into account under section 67 of the Criminal Justice Act 1967 (which relates to the computation of custodial sentences):

  • Provided that this rule shall not permit the reduction of the actual term to less than 5 days.

Explanatory Note

(This note is not part of the Rules)

These Rules amend rule 6 (remission of sentence) of the Detention Centre Rules 1983 so as to increase from one-third to one-half of the term the remission which may be granted to inmates serving detention centre orders or committed to be detained under section 9 of the Criminal Justice Act 1982 for default or contempt.

1952 c. 52; Section 47 was amended by the Criminal Justice Act 1961 (c. 39), Schedule 4, the Criminal Justice Act 1967 (c. 80), section 66(5), the Courts Act 1971 (c. 23), Schedules, paragraph 33 and the Criminal Justice Act 1982 (c. 48), Schedule 14, paragraph 7. Section 47 of the 1952 Act was also affected by an amendment to section 52(2) of that Act by the Criminal Justice Act 1967, section 66(4).
