The Direct Grant Schools (Amendment) Regulations 1987

In exercise of the powers conferred by section 100(1) and (3) of the Education Act 1944(1) and vested in them(2) the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:

1.  These Regulations may be cited as the Direct Grant Schools (Amendment) Regulations 1987 and shall come into force on 15th August 1987.

2.  After regulation 17 of the Direct Grant Schools Regulations 1959(3) there shall be added the following regulation—

17A.  Without prejudice to paragraph (3) of regulation 17 a person shall not be debarred from receiving education (whether by refusing him admission to the school, suspending his attendance or otherwise) by reason of the fact that section 47 of the Education (No. 2) Act 1986 applies in relation to him, or if he were admitted might so apply..

3.  In regulation 25 of the Direct Grant Schools Regulations 1959 after the number “15” there shall be added the number “17A”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Direct Grant Schools Regulations 1959.

To the conditions which are required to be fulfilled before grant may be paid or to ensure that grant is not deducted in pursuance of the 1959 Regulations there is added a condition that existing and potential pupils of the school shall not be debarred from education there on account of the application of section 47 of the Education (No. 2) Act 1986 (c. 61) (Abolition of Corporal Punishment).

S.I. 1959/1832, to which there are amendments not relevant to these Regulations. It is, however, to be noted that S.I. 1975/1198 provides for the cessation by stages of the payment of grants under the 1959 Regulations.
