The M40 London—Oxford—Birmingham Motorway (Waterstock to Warwick Section)and Connecting Roads (No 1) Scheme 1984 Variation Scheme 1987

The Secretary of State for Transport makes this Scheme in exercise of powers conferred by sections 16, 17, 19 and 108 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The M40 London—Oxford—Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No 1) Scheme 1984(3) (hereinafter referred to as “the principal scheme”) is hereby varied so that—

(a)in article 5(2)(i), after the word “inclusive,”, there are inserted the words “and the plan folio numbered HA 16/1 WMRO(L) XVII marked The M40 London—Oxford—Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No 1) Scheme 1984 Variation Scheme 1987, containing a map lettered C2, each”;

(b)in paragraph 3 of Schedule 1—

(i)for the words “the route diverging for a distance of about 1500 metres and merging as indicated on the deposited plan, the motorway comprising both of the routes,” there are substituted the words “under the Kineton Railway”, and

(ii)for the words “on Plan C” there are substituted the words “on Plans C and C2”; and

(c)on the map lettered C in the deposited plan, the heavy black lines between the footpath adjacent to Gaydon Hill Farm and the footpath adjacent to Little Dassett Farm are deleted.

2.  For the purposes of article 3 of the principal scheme (date on which special roads are to become trunk roads), in relation to the special road along the route shown on the map lettered C2 in the deposited plan the date shall be date when this Scheme comes into force.

3.  This Scheme shall come into force on 2nd July 1987 and may be cited as the M40 London—Oxford—Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No 1) Scheme 1984 Variation Scheme 1987.
