Citation and commencement

1.  These regulations may be cited as the Building (Inner London) Regulations 1985 and shall come into operation on 6th January 1986.

Application of building regulations and the Building Act 1984 to Inner London

2.—(1) The Building Regulations 1985(1), the Building (Approved Inspectors etc.) Regulations 1985 and the Building (Prescribed Fees etc.) Regulations 1985 shall apply in inner London.

(2) Those regulations shall be amended as provided in Schedule 2.

(3) The following provisions of the Building Act 1984 are prescribed for the purposes of paragraph 2(1) of Schedule 3 to that Act and apply in relation to the Greater London Council as they apply to a local authority outside inner London—

  • section 8 (relaxation of building regulations);

  • section 9 (application for relaxation);

  • section 10 (advertisement of proposal for relaxation of building regulations);

  • section 16 (passing or rejection of plans);

  • section 32 (lapse of deposit of plans);

  • section 36 (removal or alteration of offending work);

  • section 37 (obtaining of report where section 36 notice given);

  • section 39 (appeal against refusal etc. to relax building regulations);

  • section 40 (appeal against section 36 notice).

Consequential modifications and repeals

3.—(1) The enactments mentioned in Schedule 3 shall have effect subject to the modifications and repeals specified in that Schedule.

(2) The enactments and instruments mentioned in Schedule 4 are repealed or revoked to the extent specified in the third column of that Schedule.

Transitional provisions

4.—(1) Subject to paragraphs (2) and (3) of this regulation, these regulations and the repeals made by them shall not apply in respect of a building, structure or work if before 6th January 1986—

(a)a fee had become due under section 12 of the London County Council (General Powers) Act 1955(2) (payment of fees on submission of calculations); or

(b)a contract was entered into for the erection of the building, construction of the structure or execution of the work; or

(c)a building notice in respect of the building, structure or work was served on the district surveyor; or

(d)the erection of the building, construction of the structure or execution of the work was commenced and no building notice in respect of it was served on the district surveyor; or

(e)consent was given under section 30 of the London Building Acts (Amendment) Act 1939(3) (consent to special and temporary buildings etc.) to the setting up, erection or retention of the buildings or structure,

until that building, structure or work has been completed or where paragraph (e) applies until any consent given under the said section 30 of the London Building Acts (Amendment) Act 1939 has expired.

(2) notwithstanding paragraph (1) of this regulation, these regulations and the repeals made by them shall apply if on or after that date—

(a)a building notice is given or full plans are deposited under regulation 11 of the Building Regulations 1985 or an initial notice or a public body's notice is given under sections 47(1) or 54(1) of the Building Act 1984; and

(b)at the time that the notice is given or the plans are deposited the building work to which the notice or those plans relate has not been commenced.

(3) This regulation does not apply to the modifications to section 46 of the London Buildings (Amendment) Act 1939 specified in paragraph 6 of Schedule 3 to these regulations.

(4) Expressions used in paragraph (1) shall have the same meaning as in the London Building Acts 1930 to 1982(4) and expressions used in paragraph (2) shall have the same meaning as in the Building Regulations 1985(5)
