The Senior Officers (Metropolitan Counties and Northumbria Police Area) (Continuation in Rank) Order 1985
In exercise of the powers conferred on me by section 101 of the Local Government Act 1985, I hereby make the following Order:—
Citation and commencement1.
This Order may be cited as the Senior Officers (Metropolitan Counties and Northumbria Police Area) (Continuation in Rank) Order 1985 and shall come into operation on 1st April 1986.
Continuation in rank of senior officers2.
(1)
Where, immediately before the date of coming into operation of this Order, a person holds senior rank in the police force maintained for a metropolitan county or for the Northumbria police area, he shall, subject to any other enactment, continue as from that date to hold that rank in that force notwithstanding that the police authority by which he was appointed or promoted thereto has ceased to exist and that its functions, under section 37 of the Local Government Act 1985, have become vested in a police authority created under Part IV of that Act.
(2)
In this Article, “senior rank”, in relation to a police force, means a rank in that force above the rank of chief superintendent.
This Order makes provision, consequential on the creation of new police authorities for the metropolitan counties and the Northumbria police area, under Part IV of the Local Government Act 1985, for continuing in their rank, as from 1st April 1986, senior officers in the police forces for those areas, notwithstanding that appointment or promotion to that rank was made, under section 4(2) or 6(4) of the Police Act 1964 (c.48), by a police authority which will cease to exist as from that date.
