The Rabies (Importation of Dogs, Cats and Other Mammals) (Amendment) Order 1984

Coming into Operation

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 1, 10(1), (2), (3), (4) and (5) and 95(1) of the Animal Health Act 1981 and of all other powers enabling them in that behalf, for the purpose of preventing the introduction of rabies into Great Britain, hereby order as follows:—

Title and commencement1

This Order may be cited as the Rabies (Importation of Dogs, Cats and Other Mammals) (Amendment) Order 1984 and shall come into operation on 1st September 1984.

Amendment of principal order2

The Rabies (Importation of Dogs, Cats and Other Mammals) Order 19741 shall be amended as follows—

a

after paragraph (8) of Article 4 (prohibition on landing of animals in Great Britain) there shall be inserted the following paragraphs—

Subject to paragraph (10) below, where an animal landed in Great Britain is brought into Great Britain from a place other than a country outside Great Britain, the prohibition on landing contained in paragraph (1) above shall apply to that animal if while outside Great Britain it has been or may have been in contact with an animal to which, if it were brought into Great Britain, the prohibition on landing contained in paragraph (1) above would apply.

The prohibition on the landing of an animal brought into Great Britain from a place other than a country outside Great Britain contained in paragraph (9) above shall not apply to a dog belonging to the police, Her Majesty's Customs and Excise or Her Majesty's Forces which is kept under the constant control of a trained handler while outside Great Britain.

in paragraph (3) of Article 8 (control of animals passing through Great Britain) after the words “a licence” there shall be inserted the words “(which may be general or specific)”;

in paragraph (1) of Article 15 (contact animals) for the words “the Minister” there shall be substituted the words “an inspector”; and

d

for Part I of Schedule 2 (ports and airports at which authorised landings of animals may take place) there shall be substituted the following:

EXPLANATORY NOTE

This Order further amends the Rabies (Importation of Dogs, Cats and Other Mammals) Order 1974 (“the 1974 Order”) which, in order to prevent the introduction of rabies into Great Britain, prohibits the landing in Great Britain of certain animals except under the authority of, and in accordance with conditions imposed by, a licence granted under it.

The changes of substance made to the 1974 Order by this Order are—

(1) the prohibition on the landing of animals contained in Article 4 of the 1974 Order now applies to the landing of an animal which is brought into Great Britain from a place other than a country outside Great Britain (for example an oil rig not forming part of any country) if the animal, while outside Great Britain, has been or may have been in contact with any other animal which, if brought into Great Britain, would be subject to such prohibition (Article 2(a)); and

(2) a revised list of ports at which authorised landings of animals may take place is inserted in Part I of Schedule 2 to the 1974 Order (Article 2(d)).
