Coming into Operation

The Secretary of State for Transport, in exercise of the powers conferred by section 44(4) of the Road Traffic Act 19721 and now vested in him2, and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of that Act, hereby makes the following Regulations:-

These Regulations shall come into operation on 15th July 1982 and may be cited as the Motor Vehicles (Tests) (Amendment) (No. 2) Regulations 1982.

The Motor Vehicles (Tests) Regulations 19813 are amended in accordance with the following provisions of these Regulations.

In Regulation 5 (Classification of Vehicles and Application of Regulations), in paragraph (1), for the words “Class II: motor bicycles other than light motor vehicles” substitute the words “Class II: motor bicycles” and for the words “Class III: Light motor vehicles” substitute the words “Class III: Light motor vehicles other than motor bicycles”.

In Regulation 6 (Exemptions), after paragraph (1) insert the following paragraph:—

Pursuant to section 44(4) the Secretary of State hereby prescribes until 1st January 1983 public service vehicles adapted to carry more than eight passengers as a class of vehicles to which section 44 does not apply

EXPLANATORY NOTE

These Regulations amend the Motor Vehicles (Tests) Regulations 1981 in the following respects—

(a) the classification of vehicles for the purposes of the Regulations is amended so that all motor bicycles, including those with side cars, fall within Class II (See Regulation 3);

and

(b) the requirement for certification arising from the application of Section 44 of the Road Traffic Act 1972 is excluded until 1st January 1983 from public service vehicles adapted to carry more than eight passengers (see Regulation 4).
