The Secretary of State for the Environment, on the application of the Council of the Isles of Scilly and in exercise of the powers conferred upon him by section 265 of the Local Government Act 1972 and of all other powers enabling him in that behalf, hereby makes the following order:—

This order may be cited as the Isles of Scilly (Functions) Order 1982 and shall come into operation on 14th June 1982.

The Council of the Isles of Scilly shall exercise and perform the functions conferred or imposed on the councils of non-metropolitan counties by—

  • section 7(4) of the Family Law Reform Act 19691;

  • section 44(1) of the Matrimonial Causes Act 19732;

  • section 2(2)(a) of the Guardianship Act 19733; and

  • section 12(3) of the Domestic Proceedings and Magistrates' Courts Act 1978.

EXPLANATORY NOTE

Section 265(2) of the Local Government Act 1972 provided for orders providing for the exercise and performance in the Isles of Scilly of functions which are for the time being conferred or imposed on local authorities. This order provides for the exercise and performance by the Council of the Isles of Scilly of the functions conferred or imposed on the councils of non-metropolitan counties by the enactments specified in article 2, which deal with the supervision of wards of court, the supervision of children subject to court orders in matrimonial proceedings, the supervision of children subject to guardianship orders and the power of the court in certain matrimonial proceedings to require local authorities to provide reports on any matter which the court considers is relevant to any decision it may make.
