The Rules of the Supreme Court (Amendment) 1982

We the Supreme Court Rule Committee, having power under section 84 of the Supreme Court Act 1981 to make rules of court for the purpose of regulating and prescribing the practice and procedure to be followed in the Supreme Court, hereby exercise those powers as follows:—

Citation and commencement

1.—(1) These Rules may be cited as the Rules of the Supreme Court (Amendment) 1982 and shall come into operation on 19th April 1982.

(2) In these Rules on Order referred to by number means the Order so numbered in the Rules of the Supreme Court 1965(1).

Sheriff's or small debts courts in Scotland

2.  Order 11, rule 4(3) shall be amended by substituting, for the words “sheriff's or small debts courts”, the words “sheriff court”.

Fees of Examiners of the Court

3.  Order 39, rule 19 shall be amended as follows:—

(1) in paragraph (1), for the figures £20.00, £6.00 and £35.00, there shall be substituted the figures £27.00, £9.00 and £50.00 respectively;

(2) in paragraph (3), for the figures £15.00 and £20.00, there shall be substituted the figures £21.00 and £28.00 respectively.

Court of Appeal

4.  Rule 1(1) of the Rules of the Supreme Court (Amendment No. 2) 1981 shall be amended by substituting, for the words “20th April 1982”, the words “1st October 1982”.

EXPLANATORY NOTE

These Rules amend the Rules of the Supreme Court so as—

(a) to amend obsolete references in Order 11, rule 4(3) to Scottish courts (rule 2);

(b) to raise the fees payable to examiners of the Court (rule 3).

These Rules postpone from 20th April 1982 until 1st October 1982 the commencement of the rules relating to the Court of Appeal contained in the Rules of the Supreme Court (Amendment No. 2) 1981.
