The Minister of Agriculture, Fisheries and Food, the Secretary of State for Social Services and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by sections 4, 123 and 123A of the Food and Drugs Act 1955(1), and now vested in them(2) and of all other powers enabling them in that behalf, hereby make the following regulations, after consultation in accordance with section 123(6) of the said Act with such organisations as appear to them to be representative of interests substantially affected by the regulations:—
1. These regulations may be cited as the Erucic Acid in Food (Amendment) Regulations 1982, and shall come into operation on 30th March 1982.
2. The Erucic Acid in Food Regulations 1977 are hereby amended by inserting between regulations 4 and 5 thereof the following regulation:—
“4A. The erucic acid content of the oils, fats and foods referred to in regulation 4 of these regulations shall be determined by the following procedure:—
(1)
(2) If the screening process is dispensed with, or if the total content of either docosenoic or cis-docosenoic acid determined by it exceeds five per cent. or, in the case of any oil, fat or food manufactured before 1st July 1979, ten per cent., the erucic acid content shall be determined by the method set out in the Annex to the Directive.”

These regulations amend the Erucic Acid in Food Regulations 1977 by providing a Community method of analysis for determining the erucic acid content of oils, fats and foods intended for human consumption, in implementation of the Commission Directive 80/891/EEC.
section 4 was amended and section 123A inserted by section 4(1) of and paragraph 3(1) and (2)(a) of Schedule 4 to the European Communities Act 1972 (c. 68).
