The Secretary of State for Transport, in exercise of the powers conferred by section 63(1) of the Road Traffic Act 1972(1) and now vested in him(2), and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of that Act, hereby makes the following Regulations:—

1.  These Regulations shall come into operation on 19th November 1982 and may be cited as the Motor Vehicles (Designation of Approval Marks) (Amendment) Regulations 1982.

2.  The Motor Vehicles (Designation of Approval Marks) Regulations 1979(3) shall be amended so as to have effect in accordance with the following provisions of these Regulations.

3.  In Schedule 2, after the items the numbers of which are shown in column (1) of the Table below, insert, respectively, the new items specified in the Schedule to these Regulations the numbers of which are shown in column (2) of that Table.

4.  In Schedule 4, after item 23, add the following new item:—

Safety belt.The beltCouncil Directive 77/541/EEC of 28th June 1977 as amended by Commission Directive 82/319/EEC of 2nd April 1982.O.J. L139, 19.5.82, p. 171, 2 and 10

5.  In Schedule 5, in paragraph 10—

(a)in paragraph (1), for the words “In the marking relating to item 23” substitute the words “In the markings relating to items 23 and 23A”; and

(b)in paragraph (3)(b), for the full stop at the end of sub–paragraph (v) substitute “; and”, and after that sub–paragraph add the following sub–paragraph:—

(vi)the letter “N” if the retractor forming part of the motor vehicle part has special properties as regards use in a vehicle in category M2, M3, N1, N2 or N3..

EXPLANATORY NOTE

1.  These Regulations further amend the Motor Vehicles (Designation of Approval Marks) Regulations 1979.

2.  The markings which are shown in the diagrams in column (2) of the Schedule to these Regulations are designated as approval marks. These designations result from the amendments mentioned in column (5) in that schedule to the relevant ECE Regulations mentioned in column (5) of Schedule 2 to the 1979 Regulations (see Regulation 3 and the Schedule).

3.  A new item numbered 23A has been added to Schedule 4 to the 1979 Regulations as regards safety belts in consequence of Commission Directive 82/319/EEC (see Regulation 4) and a minor consequential amendment is made to Schedule 5 to the 1979 Regulations (see Regulation 5).

4.  Copies of the ECE Regulations and the Commission Directive may be obtained from Her Majesty's Stationery Office.
