The Social Security (Overlapping Benefits) Amendment Regulations 1982

Coming into Operation

The Secretary of State for Social Services, in exercise of powers conferred upon him by section 85 of the Social Security Act 1975 and of all other powers enabling him in that behalf, after agreement by the Social Security Advisory Committee that proposals to make these regulations should not be referred to it1, hereby makes the following regulations:—

Citation, interpretation and commencement1

These regulations, which may be cited as the Social Security (Overlapping Benefits) Amendment Regulations 1982, amend the Social Security (Overlapping Benefits) Regulations 19792 (hereinafter referred to as “the principal regulations”) and shall come into operation on 14th September 1982.

Amendment of regulation 10 of the principal regulations2

Paragraph (1) of regulation 10 of the principal regulations (adjustment of dependency benefit where certain personal benefit is payable) shall be further amended by substituting a semi-colon for the comma in sub-paragraph (g), and inserting after sub-paragraph (g) the following sub-paragraph:—

h

a weekly allowance pursuant to arrangements made by the Manpower Services Commission under section 2 of the Employment and Training Act 1973 for the purpose of the Enterprise Allowance Scheme ,

EXPLANATORY NOTE

These regulations amend regulation 10 of the Social Security (Overlapping Benefits) Regulations 1979 by adding an allowance payable by virtue of arrangements made by the Manpower Services Commission under the Enterprise Allowance Scheme, to the categories of personal benefit payable to the dependant by reference to which a dependency benefit payable for the same period is required to be adjusted.
