Coming into Operation

The Minister of Agriculture, Fisheries and Food and the Secretary of State, acting jointly, in exercise of the powers conferred on them by section 4(2) of and Part III of Schedule 3 to the European Communities Act 1972 and of all other powers enabling them in that behalf hereby make the following order:—

Title and Commencement1

This Order may be cited as the Plant Varieties and Seeds Act 1964 (Repeals) (Appointed Day) Order 1982 and shall come into operation on 16th August 1982.

Appointed day of Repeals2

The repeal of the provisions of the Plant Varieties and Seeds Act 1964, except section 32 thereof, and of the Agriculture (Miscellaneous Provisions) Act 1968 respectively specified in Part III of Schedule 3 to the European Communities Act 1972 shall take effect on the date of the coming into operation of this order.

EXPLANATORY NOTE

Section 4 of the European Communities Act 1972 provided for the repeal of certain provisions of the Plant Varieties and Seeds Act 1964 and of the Agriculture (Miscellaneous Provisions) Act 1968, such repeal to take effect from such date as the Minister of Agriculture, Fisheries and Food and the Secretary of State acting jointly should appoint.

This Order appoints a date for the repeal of such of those provisions as relate to the Index of names of plant varieties and performance trials of new plant varieties.

Section 32 of the 1964 Act (provision for the repeal of which was also made in the European Communities Act 1972) was repealed by the Plant Varieties and Seeds Act 1964 (Repeals) (Appointed Day) Order 1978.
