The Minister of Agriculture, Fisheries and Food, the Secretaries of State for Scotland, Wales and Northern Ireland, acting jointly in exercise of the powers conferred by sections 5 and 35(3) of the Agriculture Act 1957(1), and now vested in them and of all other powers enabling them in that behalf, hereby make the following order:—
1. This Order may be cited as the Sheep Variable Premium (Protection of Payments) (Amendment) Order 1981, and shall come into operation on 22nd May 1981.
2. The Sheep Variable Premium (Protection of Payments) (No. 2) Order 1980 shall be amended by substituting in Schedule 1 thereto, for subparagraph (b) of the first paragraph (which prescribes the marks to be placed on animals approved for certification as being eligible for a premium payment), the following sub-paragraph:—
“(b)a circular punch hole about 6 millimetres in diameter.”.

This Order amends the Sheep Variable Premium (Protection of Payments) (No. 2) Order 1980 by substituting a new mark for application to any animal qualifying for a premium payment before certification for such payment, in place of the mark prescribed in paragraph (b) of the first paragraph of Schedule 1 thereto. The effect of this change is to allow for a smaller hole to be punched in the ear of a qualifying animal.
Section 5 is applied to Community arrangements by section 6(3) and (4) of the European Communities Act 1972 (c. 68) and is to be read with the Transfer of Functions (Wales) (No. 1) Order 1978 (S.I. 1978/272).
