The Public Trustee (Custodian Trustee) Rules 1981

Coming into Operation

The Lord Chancellor, in exercise of the powers conferred on him by section 14(1) of the Public Trustee Act 1906, and with the concurrence of the Treasury, hereby makes the following Rules:–

1.

These Rules may be cited as the Public Trustee (Custodian Trustee) Rules 1981 and shall come into operation on 1st April 1981.

2.

Rule 30 of the Public Trustee Rules 19121 shall be amended as follows:—

(1)

After the figure “30” there shall be inserted the figure “(1)”.

(2)

The following sub-paragraph shall be added after sub-paragraph (i):—

“(j)

The National Coal Board or any subsidiary of the National Coal Board, but only in relation to a scheme or arrangements established under regulations made under section 37 of the Coal Industry Nationalisation Act 19462;”.

(3)

The following paragraph shall be inserted at the end:—

“(2)

In this rule “subsidiaryhas the same meaning as in section 154 of the Companies Act 19483.”.

EXPLANATORY NOTE

These Rules enable the National Coal Board to act themselves or by means of a subsidiary as a custodian trustee of schemes and arrangements established by them to provide pensions, gratuities and similar benefits to or in respect of persons employed in the coal industry.
