The Public Bodies' Land (Appropriate Ministers) Order 1981

Coming into Operation

The Secretary of State for the Environment, in exercise of the powers conferred on him by section 99(6) of the Local Government, Planning and Land Act 1980 and of all other powers enabling him in that behalf and with the concurrence of the Treasury, hereby makes the following order:—

This order may be cited as the Public Bodies' Land (Appropriate Ministers) Order 1981 and shall come into operation on 6th February 1981.

For the purposes of Part X of the Local Government, Planning and Land Act 1980, the expression “the appropriate Minister” in relation to the bodies set out in column 1 in the following Table shall have the meaning given in column 2 of that Table as respects those bodies—

EXPLANATORY NOTE

Section 99(5) of the Local Government, Planning and Land Act 1980 provides for certificates to be given in certain circumstances by “the appropriate Minister” for a body to whom Part X of that Act applies. In relation to any body who are not statutory undertakers for the purposes of Part XI of the Town and Country Planning Act 1971 (c. 78), section 99(6)(b) empowers the Secretary of State, with the concurrence of the Treasury, to designate by order the appropriate Minister. This order sets out who are to be the appropriate Ministers for the bodies named in it.
