The Motor Vehicles (Designation of Approval Marks) (Amendment) Regulations 1981

Coming into Operation

The Minister of Transport in exercise of the powers conferred by section 63(1) of the Road Traffic Act 19721 and now vested in him2, and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of that Act, hereby makes the following Regulations:—

These Regulations shall come into operation on 5th March 1981 and may be cited as the Motor Vehicles (Designation of Approval Marks) (Amendment) Regulations 1981.

The Motor Vehicles (Designation of Approval Marks) Regulations 19793 shall be amended so as to have effect in accordance with the following provisions of these Regulations.

In Schedule 2—

a

after item No. 24 insert the following new item—

In Schedule 3, after paragraph 15, add the following new paragraphs:—

The figure in the rectangle above the circle in the marking relating to item No. 24A in Schedule 2 (which indicates the corrected absorption coefficient of the vehicle part to which that marking relates) will be varied in accordance with the requirements of the ECE Regulation specified in column (5) of Schedule 2 in relation to that marking.

In relation to the marking prescribed at item No. 44 in Schedule 2—

the approval number and any additional symbol outside the marking in relation to this item must be placed close to the circle, and either above or below the “E” or to the left or right of it, the digits of the approval number must be on the same side of the “E” and oriented in the same direction, and any additional symbol must be diametrically opposite the approval number;

the word “universal” shall form part of the marking if the child restraint is manufactured for use in all types of vehicle, but the word “non-universal” shall form part of the marking instead of the word “universal” if the child restraint is not manufactured for use in all types of vehicle; and

3

the figures “9–36” following the word “universal” or, as the case may be, “non-universal” shall be varied so as to show the weight group for which the child restraint is manufactured being either:—

  • 9–18 kilograms,

  • 15–25 kilograms,

  • 22–36 kilograms,

  • 9–25 kilograms, or

  • 15–36 kilograms.

EXPLANATORY NOTE

(This Note is not part of the Regulations.)

These Regulations further amend the Motor Vehicles (Designation of Approval Marks) Regulations 1979 as follows:—

(a)in consequence of ECE Regulation 24 (uniform provisions concerning the approval of vehicles equipped with diesel engines with regard to the emission of pollutants by the engine) being amended by the O2 series of amendments, a new marking is designated as an approval mark and numbered 24A in Schedule 2 to these Regulations;

(b)in consequence of ECE Regulation 44 (uniform provisions concerning the approval of restraining devices for child-occupants of power-driven vehicles), a new marking is designated as an approval mark and numbered 44 in Schedule 2 to these Regulations; and

(c)new paragraphs are added to Schedule 3 to these Regulations: paragraph 16 provides for variation in the figures in the rectangle above the circle in the marking prescribed as an approval mark at item No. 24A: paragraph 17 provides for certain circumstances relating to variations in the marking prescribed as an approval mark at item No. 44.
