The Queen's Most Excellent Majesty in Council
Her Majesty, in exercise of the powers vested in Her by section 738 of the Merchant Shipping Act 1894 and by section 80 of the Merchant Shipping Act 1906, and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—
1.—(1) This Order may be cited as the Merchant Shipping (Registration of Scottish Fishery Cruisers, Research Ships etc.) (Amendment) Order 1972 and shall come into operation on 1st January 1973.
(2) The Merchant Shipping (Registration of Scottish Fishery Cruisers, Research Ships etc.) Order 1960(1) and this Order may be cited together as the Merchant Shipping (Registration of Scottish Fishery Cruisers, Research Ships etc.) Orders 1960 and 1972.
2.—(1) In this Order “the principal Order” means
(2) The Interpretation Act 1889 shall apply for the interpretation of this order as it applies for the interpretation of an Act of Parliament.
3. In article 5 of the principal Order the words from “and the bill of sale” to the end shall be deleted.
4. Article 12 of the principal Order is hereby revoked.
5. In article 13 of the principal Order for paragraphs (i), (ii) and (iii) there shall be substituted the following two paragraphs:—
“(i)the principal Act, sections 1, 2, 7(3) and (5), 8 to 12, 16, 27 to 38; 39 to 46 (so far as relating to mortgages), 58, 69, 71, 72, 74, 76, 103(4), 157, 158, 692, 693; 729(1)(d) and (3) (so far as relating to any papers or documents belonging to or in the possession of the Crown).
(ii)The Merchant Shipping Act 1970(2), sections 1 to 4, 7 to 10, 13, 14, 20, 31, 34 to 36, 38, 43 to 45, 47, 62 to 64, 65, 66, 68, 69 and 71;”

This Order amends the Merchant Shipping (Registration of Scottish Fishery Cruisers, Research Ships etc.) Order 1960 which provides for the registration for the purposes of the Merchant Shipping Acts of the fishery cruisers, research ships, dredgers and fishing boats owned by and in the service of the Secretary of State for Scotland.
The amendments are consequential on the coming into force of parts of the Merchant Shipping Act 1970.
