The Building Regulations (Local Enactments) Order 1966

Coming into Operation27th June 1966

The Minister of Public Building and Works in exercise of the powers conferred on him under section 82(1) of the Public Health Act 1961 and the Transfer of Functions (Building Control) Order 19641, and of all other powers enabling him in that behalf, after consulting all county councils and local authorities appearing to him to be concerned, hereby makes the following Order:—

Citation, interpretation and commencement1.

(1)

This Order may be cited as The Building Regulations (Local Enactments, Order 1966.

(2)

The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

(3)

This Order shall come into operation on 27th June 1966.

Repeal of provisions in Local Acts and Orders2.

(1)

The enactments mentioned in Part I of the Schedule to this Order shall be repealed to the extent specified in the third column of the Schedule.

(2)

The enactments mentioned in Part II of the Schedule to this Order shall be repealed, so far as they relate to matters as to which the Minister of Public Building and Works has power to make building regulations, to the extent specified in the third column of the Schedule.

Transitional Provisions3.

Nothing in this Order shall affect the operation of any provision of an enactment repealed by this Order in relation to—

(a)

plans which, in accordance with any such provision, were deposited with a local authority before the 27th June 1966, and

(b)

work carried out in accordance with plans so deposited with a local authority before that date, with or without any departures or deviations from those plans, and

(c)

work carried out and completed before that date, and

(d)

temporary or movable buildings which were erected in accordance with a conditional consent given by a local authority before that date.

This Order repeals provisions in Local Acts and Orders governing matters within the scope of the powers of the Minister of Public Building and Works to make building regulations.

The provisions specified in Part II.of the Schedule relate also to matters outside those powers, and to that extent remain in force.

There are transitional provisions of general application.
