The Superannuation (National Assistance Board) Transfer Rules 1965

Coming into Operation
The Treasury, in exercise of the powers conferred upon them by section 33 of the Superannuation Act 1965, and of all other powers enabling them in that behalf, hereby make the following Rules:—

Where a person was, after the 30th September 1960 and before the 2nd February 1965, taken into the civil service of the State as an officer employed by the National Assistance Board in a Reception Centre established in accordance with subsection (1) of section 17 of the National Assistance Act 1948 after having been employed by a local authority for the purposes of functions exercised by that authority on behalf of the National Assistance Board in accordance with subsection (2) of section 17 of that Act, and his employment by the authority was, in the opinion of the Treasury, of the same nature and for the same purpose as his employment in the service of the State, then, subject to the provisions of Rule 2 of these Rules, his service in such employment by the authority before the date on which he was taken into the service of the State, but not before the 1st January 1919, may be reckoned for the purposes of the Superannuation Act 1965 as employment in an unestablished capacity within the meaning of that Act.

Rule 1 of these Rules shall not apply to any person to whom Part II of the Superannuation (Transfers between the Civil Service and Local Government) Rules 1950 and 1955 applies or would apply if he fulfilled the conditions contained in paragraphs (c) and (d) of Rule 3(1) of those Rules.

The Interpretation Act 1889shall apply for the interpretation of these Rules as it applies for the interpretation of an Act of Parliament.

These Rules may be cited as the Superannuation (National Assistance Board) Transfer Rules 1965, and shall come into operation on 24th December 1965.
