The Merchant Shipping (Confirmation of Legislation) (Federation of Malaya) Order, 1953

The Queen's Most Excellent Majesty in Council

Whereas it is provided by Section 735 of the Merchant Shipping Act, 1894 (hereinafter called “the said Section”), that the Legislature of any British Possession may by Act or Ordinance confirmed by Her Majesty in Council repeal, wholly or in part, any provisions of that Act (other than those of the Third Part thereof, which relate to emigrant ships) relating to ships registered in that Possession; but that any such Act or Ordinance shall not take effect until the approval of Her Majesty has been proclaimed in that Possession or until such time thereafter as may be fixed by the Act or Ordinance for the purpose:

And Whereas by the Federation of Malaya Order in Council, 1948(1), it is provided that there shall be established a Federation comprising the Malay States as therein defined and the Settlements of Penang and Malacca, and by virtue of the said Order and of the Federation of Malaya Agreement, 1948, the Legislature of the Federation of Malaya is for the purposes of merchant shipping and other related subjects the Legislature of the said Settlements:

And whereas the Legislature of the Federation of Malaya by an Ordinance No. 70 of 1952 entitled “An Ordinance to consolidate and amend the law with respect to Merchant Shipping” (hereinafter called “the said Ordinance”) has in part repealed the provisions of the said Act that apply to British ships registered in the said Settlements other than those of the Third Part thereof, which relate to emigrant ships:

And whereas it is expedient that the said Ordinance in its application to the said Settlements should be confirmed by Her Majesty:

Now, therefore, Her Majesty, in exercise of the powers vested in Her by the said Section and all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered as follows:—

1.  This Order may be cited as the Merchant Shipping (Confirmation of Legislation) (Federation of Malaya) Order, 1953, and shall come into operation on the 13th day of February, 1953.

2.  The said Ordinance in its application to the said Settlements is hereby confirmed.

EXPLANATORY NOTE

By this Order the Queen in Council confirms Federation of Malaya Ordinance No. 70 of 1952 entitled “An Ordinance to consolidate and amend the law with respect to Merchant Shipping” in its application to Penang and Malacca.
