Any question arising between the Commission and any person as to whether that person is a participant in a pension scheme, and any question arising between the Commission and a participant in a pension scheme as to the application or effect of any of the provisions of paragraph (2) of Regulation 3, sub-paragraph (a) of paragraph (1) or paragraph (2) of Regulation 5, paragraph (1) of Regulation 6 or sub-paragraph (a) of paragraph (1) or paragraph (2) of Regulation 8 of these Regulations shall in default of agreement between the parties concerned be referred to a tribunal whose decision thereon shall be final.
