COMPENSATION (DEFENCE)

The Compensation (Defence) Notice of Claim Rules, 1948

The Lords Commissioners of His Majesty's Treasury, in pursuance of the powers conferred upon Them by Section 11 of the Compensation (Defence) Act, 1939 and of all other powers enabling Them in that behalf hereby make the following Rules:—

1.—(1) Claims for compensation under the said Act (as amended by the Requisitioned Land and War Works Acts, 1945 and 1948) accruing due on or after the date on which these Rules come into operation in respect of the taking possession of any land shall be made by notice in accordance with the forms specified in relation to such claims respectively in the First Schedule hereto.

(2) In accordance with the provisions of paragraph (1) of this Rule the Compensation (Defence) Notice of Claims Rules, 1939(1) and Forms Nos. 1 and 2 specified in the Schedule thereto, shall not apply to claims in respect of land of which possession is taken or relinquished, as the case may be, on or after the date on which these Rules come into operation.

2.  Claims under Section 9 of the Requisitioned Land and War Works Act, 1948, for an increase of the compensation payable in respect of any land under paragraph (a) of subsection (i) of Section 2 of the Compensation (Defence) Act, 1939, shall be made by notice in accordance with the form specified in the Second Schedule hereto.

3.  Every such notice of claim shall be signed by the claimant or by a person duly authorised by the claimant on his behalf and shall be delivered to the competent authority by whom the compensation is payable or to such other person as the competent authority shall direct.

4.—(1) These Rules may be cited as the Compensation (Defence) Notice of Claim Rules, 1948.

(2) These Rules shall come into operation on the 19th day of February, 1948.

EXPLANATORY NOTE

These Rules provide new forms of claim for compensation in respect of requisitions of land made or relinquished after the commencement of the Requisitioned Land and War Works Act, 1948, in order to fit in with the new basis of compensation laid down by that Act. They also provide a form of claim for an increase of rental compensation under that Act in respect of land already requisitioned.
