cases where their death or disablement is directly attributable to their having sustained war injuries, or suffered detention, by reason of their service as mariners in British ships;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/1/b" id="section-3-1-b"><Pnumber><Addition ChangeId="d30p74" CommentaryRef="c590492">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">the payment of allowances to or for the benefit of persons who have suffered detention as aforesaid or to or for the benefit of their dependants.</Addition></Text></P3para></P3></P2para></P2><P2 CommentaryRef="c590492">2</Addition></Pnumber><P2para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">The cases in which a person who has sustained an injury, or suffered detention, is to be treated as having sustained the injury, or suffered the detention, by reason of his service in a British ship as a mariner are where the injury, or the capture on which his detention was consequent, as the case may be, occurred—</Addition></Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/2/a" id="section-3-2-a"><Pnumber><Addition ChangeId="d30p74" CommentaryRef="c590492">a</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">while he was in the service of a British ship as a mariner;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/2/b" id="section-3-2-b"><Pnumber><Addition ChangeId="d30p74" CommentaryRef="c590492">b</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">in the case of a person normally employed as a mariner, while he was in the service of a seagoing British ship in the British Islands in which he was employed as master or a member of the crew thereof, notwithstanding that he was not employed in seagoing service in the ship;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/2/c" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/2/c" id="section-3-2-c"><Pnumber><Addition ChangeId="d30p74" CommentaryRef="c590492">c</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">while he was at a place outside the British Islands on leave from a British ship in which he was employed as a mariner and which was at a port outside the British Islands;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/2/d" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/2/d" id="section-3-2-d"><Pnumber><Addition ChangeId="d30p74" CommentaryRef="c590492">d</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">while he was at a place outside the British Islands in accordance with arrangements made or approved by or on behalf of the Minister of War Transport for having persons available for employment as mariners;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/2/e" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/2/e" id="section-3-2-e"><Pnumber><Addition ChangeId="d30p74" CommentaryRef="c590492">e</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">while he was at any place, except on land in the British Islands, in the course of proceeding to employment in a British ship as a mariner, or to a place to which he was going in accordance with such arrangements as aforesaid;</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/2/f" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/2/f" id="section-3-2-f"><Pnumber><Addition ChangeId="d30p74" CommentaryRef="c590492">f</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">without prejudice to the last preceding paragraph, while he was at any place, except as aforesaid, in the course of returning to any part of the British Islands, to the country to which he belonged, or to any other country approved by or on behalf of the Minister of War Transport, from employment in a British ship as a mariner, or from a place at which he had been in accordance with such arrangements as aforesaid, and before he first arrived on land in that part of the British Islands or, as the case may be, in that country; or</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/2/g" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/2/g" id="section-3-2-g"><Pnumber><Addition ChangeId="d30p74" CommentaryRef="c590492">g</Addition></Pnumber><P3para><Text><Addition ChangeId="d30p74" CommentaryRef="c590492">while he was waiting at any place outside the British Islands to proceed or return as aforesaid whether the delay was due to sickness or to any other cause outside his control.</Addition></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/3/3" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/3/3" id="section-3-3"><Pnumber>3</Pnumber><P2para><Text>If it appears to the Minister that the awards that could be authorised by the provisions of a scheme made by virtue of paragraph (<Emphasis>a</Emphasis>) of subsection (1) of this section would, in the case of mariners of any particular class, be inappropriate to the conditions of their employment or engagement, he may, with the consent of the Treasury, in lieu of making provision for the application in their case of a Naval War Pensions Order, make a scheme authorising in their case awards on account of the like matters as if the scheme were made under those provisions, <Addition ChangeId="d30p152" CommentaryRef="c590493">but of such amount and character as may be determined by or under the scheme.</Addition></Text></P2para></P2></P1para></P1></P1group><P1group RestrictExtent="E+W+S+N.I." RestrictStartDate="1996-01-01"><Title> Awards to pilots, &amp;c. <CommentaryRef Ref="c590503"/></Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4" id="section-4"><Pnumber><CommentaryRef Ref="c590504"/>4</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/1" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/1" id="section-4-1"><Pnumber>1</Pnumber><P2para><Text>The Minister may with the consent of the Treasury make a scheme for—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/1/a" this section applies in cases where their death or disablement is directly attributable to war injuries sustained by reason of their service, or to detention caused by reason of their service; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/1/b" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/1/b" id="section-4-1-b"><Pnumber>b</Pnumber><P3para><Text>the payment of allowances to or for the benefit of any such persons detained as aforesaid, or to or for the benefit of the dependants of such persons so detained.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/2" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/2" id="section-4-2"><Pnumber>2</Pnumber><P2para><Text>This section applies to the following persons, namely—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/2/a" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/2/a" id="section-4-2-a"><Pnumber>a</Pnumber><P3para><Text>pilots and apprentice pilots; and</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/2/b" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/2/b" id="section-4-2-b"><Pnumber>b</Pnumber><P3para><Text>masters and members of the crew of pilot boats, lightships, lighthouse tenders and lightship tenders.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/3" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/3" id="section-4-3"><Pnumber>3</Pnumber><P2para><Text>For the purpose of this section, a person to whom this section applies shall be deemed to have sustained a war injury, or to have been detained, by reason of his service, if he sustained the injury, or if the capture in consequence of which the detention occurs is effected—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/3/a" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/3/a" id="section-4-3-a"><Pnumber>a</Pnumber><P3para><Text>. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . <CommentaryRef Ref="c590505"/></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/3/b" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/3/b" id="section-4-3-b"><Pnumber>b</Pnumber><P3para><Text>in the case of a master or member of the crew of a pilot boat, lighthouse tender or lightship tender, while he is in the service of the boat or tender <Addition ChangeId="d30p220" CommentaryRef="c590506">or is at any place, except on land in the British Islands, in the course of proceeding to the boat or tender for the purpose of being in the service thereof, or of returning from the boat or tender after being in the service thereof.</Addition></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/3/c" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/3/c" id="section-4-3-c"><Pnumber>c</Pnumber><P3para><Text>in the case of a master or member of the crew of a lightship, while he is in the service of the lightship or <Addition ChangeId="d30p229" CommentaryRef="c590507">is at any place, except on land in the British Islands, in the course of proceeding</Addition> to the lightship for the purpose of being in the service thereof <Addition ChangeId="d30p233" CommentaryRef="c590507">or of returning from the lightship</Addition> after being in the service thereof.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/4/4" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/4/4" id="section-4-4"><Pnumber>4</Pnumber><P2para><Text>In this section the following expressions have the meanings hereby respectively assigned to them:—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-lightship">Lightship</Term>” means a lightship belonging to a local or general lighthouse authority within the meaning of the <Addition ChangeId="d30p251" CommentaryRef="c590509">Merchant Shipping Act 1995</Addition>;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-lighthouse-tender">Lighthouse tender</Term>” means a tender to a lighthouse belonging to any such authority;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-lightship-tender">Lightship tender</Term>” means a tender to a lightship;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-pilot-boat">Pilot boat</Term>” has the meaning assigned to it by <Addition ChangeId="d30p276" CommentaryRef="c590510">section 6 of the Pilotage Act 1987</Addition>, <Addition ChangeId="d30p280" CommentaryRef="c590506">save that it includes any vessel which for the time being is being used in the pilotage service of any pilotage district in the British Islands.</Addition></Text></Para></ListItem></UnorderedList></P2para></P2></P1para></P1></P1group><P1group><Title> Awards to certain persons serving on naval ships. <CommentaryRef Ref="c590512"/></Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/5" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/5" id="section-5"><Pnumber><CommentaryRef Ref="c590513"/>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/5/1" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/5/1" id="section-5-1"><Pnumber>1</Pnumber><P2para><Text>The Minister may, with the consent of the Treasury, make a scheme for—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/5/1/a" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/5/1/a" id="section-5-1-a"><Pnumber>a</Pnumber><P3para><Text>applying the provisions of any Naval War Pensions Order to persons employed or engaged on ships forming part of <Addition ChangeId="d30p305" CommentaryRef="c590514">the Royal Navy</Addition>(being persons to whom the provisions of the Order would not otherwise apply) in cases where their death or disablement is directly attributable to war injuries sustained in such circumstances as may be specified in the scheme, or to detention caused by reason of their service in such ships; and</Text></P3para></P3><P3 id="section-5-1-b"><Pnumber>b</Pnumber><P3para><Text>the payment of allowances to or for the benefit of any such persons detained as aforesaid, or to or for the benefit of the dependants of such provisions of a scheme made by virtue of paragraph (<Emphasis>a</Emphasis>) of the foregoing subsection would, in the case of any such persons of any particular class, be inappropriate to the conditions of their employment or engagement, he may, with the consent of the Treasury, in lieu of making provision for the application in their case of a Naval War Pensions Order, make a scheme authorising in their case awards on account of the like matters as if the scheme were made under those provisions, <Addition ChangeId="d30p324" CommentaryRef="c590515">but of such amount and character Board of Trade may with the consent of the Treasury make a scheme for compensating— </Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/6/1/a" British ships, that is to say, sustained in any of the circumstances mentioned in paragraphs (</Addition><Emphasis><Addition ChangeId="d30p343" CommentaryRef="c590524">a</Addition></Emphasis><Addition ChangeId="d30p343" CommentaryRef="c590524">) to (</Addition><Emphasis><Addition ChangeId="d30p343" CommentaryRef="c590524">g</Addition></Emphasis><Addition ChangeId="d30p343" CommentaryRef="c590524">) DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/6/4" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/6/4" id="section-6-4"><Pnumber>4</Pnumber><P2para><Text>In this section the expression “<Term id="term-effects">effects</Term>”, in relation to any person, means any property carried on his person or in the ship in which he is serving or in the ship or other conveyance in which he is travelling, or otherwise accompanying him, at the time when the war damage in question occurs.</Text></P2para></P2></P1para></P1></P1group><P1group><Title> General provisions as to schemes. <CommentaryRef Ref="c590527"/></Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/7" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/7" id="section-7"><Pnumber><CommentaryRef Ref="c590528"/>7</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/7/1" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/7/1" id="section-7-1"><Pnumber>1</Pnumber><P2para><Text>A scheme made by the Minister or the Board of Trade under this Act (hereafter in this Act referred to as “<Term id="term-a-scheme">a scheme</Term>”) may contain any such provisions as appear to him or them to be necessary or expedient for giving effect to the purpose of the scheme, and, without prejudice to the generality of the foregoing words, may make provision—</Text><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/7/1/a" id="section-7-1-b"><Pnumber>b</Pnumber><P3para><Text>for empowering the Minister or the Board of Trade, as the case may be, to make regulations for giving effect to the purposes of the scheme.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/7/2" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/7/2" id="section-7-2"><Pnumber>2</Pnumber><P2para><Text>A scheme may provide that it shall come into operation, or shall be deemed to have come into operation, on such date as may be specified therein, whether before or after the commencement of this Act.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/7/3" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/7/3" id="section-7-3"><Pnumber>3</Pnumber><P2para><Text>A scheme may be amended or revoked by a subsequent scheme or by an order made by the Minister or the Board of Trade, as the case may be.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/7/4" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/7/4" id="section-7-4"><Pnumber>4</Pnumber><P2para><Text>A scheme and any regulations made thereunder, and any order made under this Act, shall, for the purpose of section three of the <CommentaryRef Ref="c590529"/>Rules Publication Act, 1893 (which relates to the printing of statutory rules), be deemed to be statutory rules within the meaning of that Act.</Text></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/83/section/7/5" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/83/section/7/5" id="section-7-5"><Pnumber>5</Pnumber><P2para><Text>A scheme applying the provisions of a Naval War Pensions Order to mariners or other persons in the cases mentioned in this Act may apply the Order having regard to the differences in the conditions of service of mariners and other persons and of officers and men of His Majesty’s naval forces respectively or to other circumstances;
