any person contravenes any of the provisions of the foregoing subsection, he shall be liable on summary conviction, in the case of a first conviction, to a fine not exceeding <Addition any proceedings for a contravention of subsection (1) of this section, it shall be a defence for the person charged to prove—</Text><P3 CommentaryRef="c589735">persons lawfully conducting a retail pharmacy business in accordance with section 69 of the </Addition><CommentaryRef Ref="c589736"/><Addition ChangeId="d30p161" CommentaryRef="c589735">Medicines Act 1968</Addition>;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/13/section/4/4/a/vi" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/13/section/4/4/a/vi" id="section-4-4-a-vi"><Pnumber>vi</Pnumber><P4para><Text>persons undergoing training with a view to becoming registered medical practitioners, registered nurses or registered pharmacists;</Text></P4para></P4><P4 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/13/section/4/4/a/vii" technical character intended for circulation mainly amongst persons of the classes mentioned in the last preceding paragraph or one of some of those classes; or</Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/13/section/4/4/c" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/13/section/4/4/c" id="section-4-4-c"><Pnumber>c</Pnumber><P3para><Text>that the said advertisement was published in such circumstances that he did not know and had no reason to believe that he was taking part in the publication thereof.</Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/13/section/4/5" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/13/section/4/5" id="section-4-5"><Pnumber>5</Pnumber><P2para><Text>Nothing in this section shall apply in respect of any advertisement published by a local authority or by the governing body of a voluntary hospital or by any person acting with the sanction of the Minister.</Text></P2para></P2><P2 ChangeId="key-70988d70dc09c47057ede3c005deaaba-2" CommentaryRef="key-70988d70dc09c47057ede3c005deaaba">the Common Council of the City of London; or</Substitution></Text></P3para></P3><P3 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/13/section/4/7/e" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/13/section/4/7/e" id="section-4-7-e"><Pnumber><Substitution ChangeId="key-70988d70dc09c47057ede3c005deaaba-2" CommentaryRef="key-70988d70dc09c47057ede3c005deaaba">e</Substitution></Pnumber><P3para><Text><Substitution ChangeId="key-70988d70dc09c47057ede3c005deaaba-2" CommentaryRef="key-70988d70dc09c47057ede3c005deaaba">a county council or county borough council in Wales.</Substitution></Text></P3para></P3></P2para></P2><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/13/section/4/8" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/13/section/4/8" id="section-4-8"><Pnumber>8</Pnumber><P2para><Text>In this section the expression “<Term id="term-advertisement">advertisement</Term>” includes any notice, circular, label, wrapper or other document, and any announcement made orally or by any means of producing or transmitting sounds.</Text></P2para></P2></P1para></P1></P1group><P1group><Title> Interpretation.</Title><P1 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/13/section/5" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/13/section/5" id="section-5"><Pnumber>5</Pnumber><P1para><P2 DocumentURI="http://www.legislation.gov.uk/ukpga/Geo6/2-3/13/section/5/1" IdURI="http://www.legislation.gov.uk/id/ukpga/Geo6/2-3/13/section/5/1" id="section-5-1"><Pnumber>1</Pnumber><P2para><Text>In this Act the following expressions have the meanings hereby respectively assigned to them, that is to say:—</Text><UnorderedList Decoration="none" Class="Definition"><ListItem><Para><Text>“<Term id="term-hospital">Hospital</Term>” includes a clinic, dispensary or other institution for the reception of the sick whether as in-patients or as out-patients;</Text></Para></ListItem><ListItem><Para><Text>“<Term id="term-the-minister">The Minister</Term>” means the Minister
