eId="section-70-1"><num>(1)</num><content><p>The <ref eId="c00891" href="https://www.legislation.gov.uk/ukpga/2023/50/contents">Online Safety Act 2023</ref> is amended as follows.</p></content></subsection><subsection eId="section-70-2"><num>(2)</num><content><p><mod>After <ref eId="c00892" href="https://www.legislation.gov.uk/ukpga/2023/50/section/214">section 214</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Power to require providers of internet services to prevent or restrict access by children to internet services</heading><section><num>214A</num><heading>Power to require providers of internet services to prevent or restrict access by children to internet services</heading><subsection eId="d25e101"><num>(1)</num><intro><p>The Secretary of State may, for the purpose of protecting relevant children from a risk of harm (including harm presented by content), make provision by regulations requiring providers of specified internet services—</p></intro><level class="para1" eId="d25e107"><num>(a)</num><content><p>to prevent access by relevant children to specified internet services which they provide, or to specified functionalities or other features of such services;</p></content></level><level class="para1" eId="d25e113"><num>(b)</num><content><p>to restrict access by relevant children to specified internet services which they provide, or to specified functionalities or other features of such services.</p></content></level></subsection><subsection><num>(2)</num><content><p>“<term refersTo="#term-relevant-child">Relevant child</term>” means a child who is of, or under, a specified age (and different ages may be specified for the purposes of paragraphs <ref href="#d25e107">(a)</ref> and <ref href="#d25e113">(b)</ref> of subsection <ref href="#d25e101">(1)</ref>).</p></content></subsection><subsection eId="d25e137"><num>(3)</num><intro><p>The provision that may be made by regulations under this section includes provision—</p></intro><level class="para1"><num>(a)</num><content><p>about the steps that must or may be taken by a provider for the purposes of complying with a requirement imposed by the regulations;</p></content></level><level class="para1"><num>(b)</num><content><p>about the monitoring of compliance with a requirement imposed by the regulations;</p></content></level><level class="para1" eId="d25e155"><num>(c)</num><content><p>about the enforcement of a requirement imposed by the regulations.</p></content></level></subsection><subsection><num>(4)</num><intro><p>The provision that may be made by virtue of subsection <ref href="#d25e101">(1)</ref><ref href="#d25e113">(b)</ref> includes, for example, provision requiring a provider of an internet service to—</p></intro><level class="para1"><num>(a)</num><content><p>limit the amount of time per day, or over the course of a specified period, for which relevant children may access the service or a specified functionality or other feature of the service;</p></content></level><level class="para1"><num>(b)</num><content><p>limit the times of day at which relevant children may access the service or a specified functionality or other feature of the service;</p></content></level><level class="para1"><num>(c)</num><intro><p>restrict access by relevant children to a service or to a functionality or other feature of a service by virtue of which—</p></intro><level class="para2"><num>(i)</num><content><p>a user of the service could receive unsolicited contact from a person who is not known to the user;</p></content></level><level class="para2"><num>(ii)</num><content><p>a user of the service could encounter live oral communications or live video generated directly on the service, or uploaded to or shared on the service, by a person who is not known to the user;</p></content></level><level class="para2"><num>(iii)</num><content><p>a person who is not known to a user of the service could encounter live oral communications or live video generated directly on the service, or uploaded to or shared on the service, by the user;</p></content></level><level class="para2"><num>(iv)</num><content><p>a person who is not known to a user of the service could identify the actual or approximate location of the user.</p></content></level></level></subsection><subsection><num>(5)</num><content><p>The provision that may be made by virtue of subsection <ref href="#d25e137">(3)</ref><ref href="#d25e155">(c)</ref> includes provision for a requirement to be an enforceable requirement for the purposes of Chapter 6 of Part 7.</p></content></subsection><subsection><num>(6)</num><intro><p>In making regulations under this section, the Secretary of State must have regard to—</p></intro><level class="para1"><num>(a)</num><content><p>the different ways in which an internet service of a particular kind is used, including functionalities or other features of the service that affect how much children use the service, and the impact of such use on the level of risk of harm that might be suffered by children, and</p></content></level><level class="para1"><num>(b)</num><content><p>the fact that children of different ages may be affected by an internet service, or a functionality or other feature of an internet service, in different ways.</p></content></level></subsection><subsection eId="d25e243"><num>(7)</num><intro><p>Regulations under this section may—</p></intro><level class="para1"><num>(a)</num><content><p>make provision applying any provision of this Act (with or without modifications);</p></content></level><level class="para1"><num>(b)</num><content><p>make provision for exceptions to requirements imposed by the regulations;</p></content></level><level class="para1"><num>(c)</num><content><p>make provision about the time by which, or period within which, a thing must be done;</p></content></level><level class="para1"><num>(d)</num><content><p>make provision by reference to standards, arrangements, specifications or technical requirements as published from time to time;</p></content></level><level class="para1"><num>(e)</num><content><p>confer functions on a person, including functions involving the exercise of a discretion, and make provision in connection with the procedure for exercising the functions;</p></content></level><level class="para1" eId="d25e279"><num>(f)</num><content><p>make consequential provision.</p></content></level></subsection><subsection><num>(8)</num><content><p>Regulations made by virtue of subsection <ref href="#d25e243">(7)</ref><ref href="#d25e279">(f)</ref> may amend or repeal primary legislation.</p></content></subsection><subsection><num>(9)</num><intro><p>The Secretary of State—</p></intro><level class="para1"><num>(a)</num><content><p>must exercise the power under subsection <ref href="#d25e101">(1)</ref> so as to make such provision as the Secretary of State considers appropriate following the conclusion of the consultation entitled “Growing up in the online world: a national consultation” launched on 2 March 2026 (command paper numbered CP 1528), and</p></content></level><level class="para1"><num>(b)</num><content><p>must, in exercising that power, have regard to the responses to the consultation.</p></content></level></subsection><subsection eId="d25e317"><num>(10)</num><intro><p>OFCOM must, so far as reasonably practicable—</p></intro><level class="para1"><num>(a)</num><content><p>carry out such research or provide such advice as the Secretary of State may request for the purposes of making regulations under this section, and</p></content></level><level class="para1"><num>(b)</num><content><p>do so by such time, or within such period, as the Secretary of State may specify in the request.</p></content></level></subsection><subsection><num>(11)</num><content><p>As soon as reasonably practicable after providing advice under subsection <ref href="#d25e317">(10)</ref>, OFCOM must publish the advice.</p></content></subsection><subsection><num>(12)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><intro><p>“<term refersTo="#term-primary-legislation">primary legislation</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>an Act of Parliament,</p></content></level><level class="para1"><num>(b)</num><content><p>an Act of the Scottish Parliament,</p></content></level><level class="para1"><num>(c)</num><content><p>an Act or Measure of Senedd Cymru, or</p></content></level><level class="para1"><num>(d)</num><content><p>Northern Ireland legislation;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-specified">specified</term>” means specified, or of a description specified, in regulations under this section.</p></content></hcontainer></subsection></section></hcontainer></quotedStructure></mod></p></content></subsection><subsection eId="section-70-3"><num>(3)</num><content><p><mod>In <ref eId="c00893" href="https://www.legislation.gov.uk/ukpga/2023/50/section/225">section 225</ref> (parliamentary procedure for regulations), in <ref eId="c00894" href="https://www.legislation.gov.uk/ukpga/2023/50/section/225">subsection (1)</ref>, after <ref eId="c00895" href="https://www.legislation.gov.uk/ukpga/2023/50/section/225">paragraph (e)</ref>
