admission: additional triggers</heading><subsection eId="section-63-1"><num>(1)</num><content><p><ref eId="c00827" href="https://www.legislation.gov.uk/ukpga/1998/31/section/96">Section 96</ref> of the <ref eId="c00828" href="https://www.legislation.gov.uk/ukpga/1998/31/contents">School Standards and Framework Act 1998</ref> (general power of local authority to direct admission of individual pupil) is amended as follows.</p></content></subsection><subsection eId="section-63-2"><num>(2)</num><content><p><mod>After <ref eId="c00829" href="https://www.legislation.gov.uk/ukpga/1998/31/section/96">subsection (1)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(1A)</num><content><p>The local authority may also give such a direction (in the case of any child in their area) in circumstances specified in the code for school admissions.</p></content></subsection><subsection><num>(1B)</num><intro><p>For that purpose the code may only specify circumstances in which—</p></intro><level class="para1"><num>(a)</num><content><p>a relevant procedure has been invoked, or</p></content></level><level class="para1"><num>(b)</num><content><p>the child who is to be the subject of the direction is a previously-looked-after child.</p></content></level></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-63-3"><num>(3)</num><content><p><mod>In <ref eId="c00830" href="https://www.legislation.gov.uk/ukpga/1998/31/section/96">subsection (7)</ref>, after “section” insert <quotedText startQuote="“">—</quotedText><quotedStructure endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="default"><hcontainer name="definition"><intro><p>“<term refersTo="#term-previously-looked-after-child">previously-looked-after child</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>a child who was looked after by a local authority in England or Wales but ceased to be so looked after as a result of—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>a child arrangements order, within the meaning given by <ref eId="c00831" href="https://www.legislation.gov.uk/ukpga/1989/41/section/8">section 8</ref><ref eId="c00832" href="https://www.legislation.gov.uk/ukpga/1989/41/section/8">(1)</ref> of the <ref eId="c00833" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref>, which includes arrangements relating to with whom the child is to live, or when the child is to live with any person,</p></item><item><num>(ii)</num><p>a special guardianship order, within the meaning given by <ref eId="c00834" href="https://www.legislation.gov.uk/ukpga/1989/41/section/14A">section 14A</ref> of the <ref eId="c00835" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref>, or</p></item><item><num>(iii)</num><p>an adoption order, within the meaning given by <ref eId="c00836" href="https://www.legislation.gov.uk/ukpga/1976/36/section/72">section 72</ref><ref eId="c00837" href="https://www.legislation.gov.uk/ukpga/1976/36/section/72">(1)</ref> of the <ref eId="c00838" href="https://www.legislation.gov.uk/ukpga/1976/36/contents">Adoption Act 1976</ref> or <ref eId="c00839" href="https://www.legislation.gov.uk/ukpga/2002/38/section/46">section 46</ref><ref eId="c00840" href="https://www.legislation.gov.uk/ukpga/2002/38/section/46">(1)</ref> of the <ref eId="c00841" href="https://www.legislation.gov.uk/ukpga/2002/38/contents">Adoption and Children Act 2002</ref>, or</p></item></blockList></content></level><level class="para1"><num>(b)</num><content><p>a child who appears to the local authority—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>to have been in state care in a place outside England and Wales because the child would not otherwise have been cared for adequately, and</p></item><item><num>(ii)</num><p>to have ceased to be in that state care as a result of being adopted;</p></item></blockList></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-relevant-procedure">relevant procedure</term>” means a procedure established under the code for school admissions for the purpose of securing admission to school for children who have failed to secure, or are considered at particular risk of not securing, admission
