proprietors</heading><subsection eId="section-57-1"><num>(1)</num><content><p>The <ref eId="c00743" href="https://www.legislation.gov.uk/ukpga/2006/40/contents">Education and Inspections Act 2006</ref> is amended in accordance with subsections <ref href="#section-57-2">(2)</ref> and <ref href="#section-57-3">(3)</ref>.</p></content></subsection><subsection eId="section-57-2"><num>(2)</num><content><p><mod>In <ref eId="c00744" href="https://www.legislation.gov.uk/ukpga/2006/40/part/8">Part 8</ref> (inspections), after <ref eId="c00745" href="https://www.legislation.gov.uk/ukpga/2006/40/part/8/chapter/2">Chapter 2</ref>, insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><chapter><num>Chapter 2A</num><heading>Inspection of Academy proprietors</heading><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Inspection</heading><section eId="d25e114"><num>122A</num><heading>Duty to inspect Academy proprietors at specified intervals</heading><subsection eId="d25e118"><num>(1)</num><intro><p>The Chief Inspector must—</p></intro><level class="para1"><num>(a)</num><content><p>conduct inspections of every Academy proprietor at such intervals as may be specified in regulations made by the Secretary of State, and</p></content></level><level class="para1" eId="d25e130"><num>(b)</num><content><p>prepare a written report on completion of each inspection.</p></content></level></subsection><subsection eId="d25e136"><num>(2)</num><content><p>The Secretary of State may by regulations provide that subsection <ref href="#d25e118">(1)</ref> does not apply in relation to specified categories of Academy proprietor in specified circumstances.</p></content></subsection><subsection eId="d25e145"><num>(3)</num><content><p>An Academy proprietor in relation to which subsection <ref href="#d25e118">(1)</ref> does not apply by virtue of regulations under subsection <ref href="#d25e136">(2)</ref> is an “exempt proprietor”.</p></content></subsection><subsection eId="d25e157"><num>(4)</num><intro><p>When conducting an inspection under this section, the Chief Inspector must have regard to any views about the matters listed in section <ref href="#d25e224">122B</ref><ref href="#d25e237">(2)</ref> which are expressed to the Chief Inspector by—</p></intro><level class="para1"><num>(a)</num><content><p>such persons as may be specified in regulations made by the Secretary of State;</p></content></level><level class="para1"><num>(b)</num><content><p>such other persons as the Chief Inspector considers appropriate.</p></content></level></subsection><subsection><num>(5)</num><content><p>Subsection <ref href="#d25e118">(1)</ref> has effect subject to subsection <ref href="#d25e573">122E</ref>.</p></content></subsection><subsection><num>(6)</num><intro><p>An inspection which is required under this section must not extend to—</p></intro><level class="para1"><num>(a)</num><content><p>denominational education provided at an Academy which has been designated as having a religious character, or which is to be treated as having been so designated by virtue of <ref eId="c00746" href="https://www.legislation.gov.uk/ukpga/2010/32/section/6">section 6</ref><ref eId="c00747" href="https://www.legislation.gov.uk/ukpga/2010/32/section/6">(8)</ref> of the <ref eId="c00748" href="https://www.legislation.gov.uk/ukpga/2010/32/contents">Academies Act 2010</ref>, or</p></content></level><level class="para1"><num>(b)</num><content><p>the content of collective worship at such an Academy.</p></content></level></subsection></section><section eId="d25e224"><num>122B</num><heading>Report of section <ref href="#d25e114">122A</ref> inspection</heading><subsection><num>(1)</num><content><p>It is the general duty of the Chief Inspector, when conducting an inspection under section <ref href="#d25e114">122A</ref>, to report on the quality and effectiveness of the Academy proprietor’s leadership, management and governance in connection with its role as an Academy proprietor.</p></content></subsection><subsection eId="d25e237"><num>(2)</num><intro><p>The Chief Inspector’s report must (in particular) cover—</p></intro><level class="para1"><num>(a)</num><content><p>the quality and effectiveness of any activities undertaken by the Academy proprietor to secure the provision of a quality education to registered pupils and students of its Academies;</p></content></level><level class="para1"><num>(b)</num><content><p>the quality and effectiveness of the Academy proprietor’s governance and executive leadership;</p></content></level><level class="para1"><num>(c)</num><content><p>the quality and effectiveness of any activities undertaken by the Academy proprietor to promote the wellbeing of children and young persons;</p></content></level><level class="para1"><num>(d)</num><content><p>the quality and effectiveness of any activities undertaken by the Academy proprietor to secure improvements in its Academies;</p></content></level><level class="para1"><num>(e)</num><content><p>the quality and effectiveness of the Academy proprietor’s management of its resources;</p></content></level><level class="para1"><num>(f)</num><content><p>such other matters as may be specified in regulations made by the Secretary of State.</p></content></level></subsection><subsection eId="d25e279"><num>(3)</num><intro><p>The Chief Inspector must send a copy of a report under section <ref href="#d25e114">122A</ref><ref href="#d25e118">(1)</ref><ref href="#d25e130">(b)</ref> to—</p></intro><level class="para1"><num>(a)</num><content><p>the Academy proprietor, and</p></content></level><level class="para1"><num>(b)</num><content><p>the Secretary of State.</p></content></level></subsection><subsection><num>(4)</num><intro><p>The Academy proprietor must—</p></intro><level class="para1"><num>(a)</num><content><p>make a copy of any report sent to it under subsection <ref href="#d25e279">(3)</ref> available for inspection by members of the public,</p></content></level><level class="para1"><num>(b)</num><content><p>provide a copy of the report, free of charge, upon request, and</p></content></level><level class="para1"><num>(c)</num><content><p>take such steps as are reasonably practicable to secure that every registered parent of a pupil at an Academy school or alternative provision Academy of which the Academy proprietor is the proprietor receives a copy of the report within five working days following receipt of the report by the Academy proprietor.</p></content></level></subsection><subsection><num>(5)</num><content><p>The Chief Inspector may send a copy of the report to such other persons as the Chief Inspector considers appropriate.</p></content></subsection><subsection eId="d25e337"><num>(6)</num><content><p>The Chief Inspector may arrange for the report to be published in such manner as the Chief Inspector considers appropriate.</p></content></subsection><subsection><num>(7)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-child">child</term>” means a person aged under 18, and references to “children” are to be read accordingly;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-wellbeing">wellbeing</term>”, in relation to a child or young person, means their wellbeing so far as relating to the matters mentioned in <ref eId="c00749" href="https://www.legislation.gov.uk/ukpga/2004/31/section/10">section 10</ref><ref eId="c00750" href="https://www.legislation.gov.uk/ukpga/2004/31/section/10">(2)</ref> of the <ref eId="c00751" href="https://www.legislation.gov.uk/ukpga/2004/31/contents">Children Act 2004</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-working-day">working day</term>” means a day other than a Saturday, a Sunday, Christmas Day, Good Friday or a bank holiday under the <ref eId="c00752" href="https://www.legislation.gov.uk/ukpga/1971/80/contents">Banking and Financial Dealings Act 1971</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-young-person">young person</term>” means any of the persons mentioned in <ref eId="c00753" href="https://www.legislation.gov.uk/ukpga/2004/31/section/10">section 10</ref><ref eId="c00754" href="https://www.legislation.gov.uk/ukpga/2004/31/section/10">(9)</ref> of the <ref eId="c00755" href="https://www.legislation.gov.uk/ukpga/2004/31/contents">Children Act 2004</ref>.</p></content></hcontainer></subsection></section><section eId="d25e400"><num>122C</num><heading>Other inspections</heading><subsection eId="d25e404"><num>(1)</num><content><p>The Chief Inspector must inspect and report on any Academy proprietor, or category of Academy proprietor, in connection with its role as an Academy proprietor, if requested to do so by the Secretary of State.</p></content></subsection><subsection eId="d25e410"><num>(2)</num><content><p>The Chief Inspector may inspect and report on any Academy proprietor, in connection with its role as an Academy proprietor, in circumstances where there is no requirement to do so under any other provision of this Chapter.</p></content></subsection><subsection><num>(3)</num><content><p>If the Chief Inspector carries out an inspection under subsection <ref href="#d25e410">(2)</ref> in response to a request from the Academy proprietor, the Chief Inspector may charge the Academy proprietor for the cost of the inspection.</p></content></subsection><subsection><num>(4)</num><intro><p>An inspection which is conducted under this section must not extend to—</p></intro><level class="para1"><num>(a)</num><content><p>denominational education provided at an Academy which has been designated as having a religious character, or which is to be treated as having been so designated by virtue of <ref eId="c00756" href="https://www.legislation.gov.uk/ukpga/2010/32/section/6">section 6</ref><ref eId="c00757" href="https://www.legislation.gov.uk/ukpga/2010/32/section/6">(8)</ref> of the <ref eId="c00758" href="https://www.legislation.gov.uk/ukpga/2010/32/contents">Academies Act 2010</ref>, or</p></content></level><level class="para1"><num>(b)</num><content><p>the content of collective worship at such an Academy.</p></content></level></subsection><subsection><num>(5)</num><content><p>The Chief Inspector may arrange for a report under this section to be published in such manner as the Chief Inspector considers appropriate.</p></content></subsection></section><section><num>122D</num><heading>Duty to notify certain persons of inspection</heading><subsection><num>(1)</num><intro><p>Before conducting an inspection under section <ref href="#d25e114">122A</ref> the Chief Inspector must notify—</p></intro><level class="para1"><num>(a)</num><content><p>the Academy proprietor, and</p></content></level><level class="para1"><num>(b)</num><content><p>any relevant religious body.</p></content></level></subsection><subsection eId="d25e485"><num>(2)</num><intro><p>If the Academy proprietor is notified by the Chief Inspector that the Chief Inspector is proposing to inspect the Academy proprietor under section <ref href="#d25e114">122A</ref>, the Academy proprietor must take such steps as are reasonably practicable to notify the following persons of the time when the inspection is to take place—</p></intro><level class="para1" eId="d25e494"><num>(a)</num><content><p>the registered parents of registered pupils at any Academy school or alternative provision Academy of which the Academy proprietor is the proprietor;</p></content></level><level class="para1"><num>(b)</num><content><p>the members of the Academy proprietor (if any).</p></content></level></subsection><subsection eId="d25e506"><num>(3)</num><intro><p>If the Academy proprietor is notified by the Chief Inspector that the Chief Inspector is electing to treat, or is required by the Secretary of State to treat, an inspection under section <ref href="#d25e400">122C</ref> as if it were an inspection under section <ref href="#d25e114">122A</ref> as a result of the exercise of a power under section <ref href="#d25e573">122E</ref>, the Academy proprietor must take such steps as are reasonably practicable to notify the following persons that the inspection is being so treated, and of the time when the inspection is to take place—</p></intro><level class="para1" eId="d25e521"><num>(a)</num><content><p>the registered parents of registered pupils at any Academy school or alternative provision Academy of which the Academy proprietor is the proprietor;</p></content></level><level class="para1"><num>(b)</num><content><p>the members of the Academy proprietor (if any);</p></content></level><level class="para1"><num>(c)</num><content><p>any relevant religious body.</p></content></level></subsection><subsection><num>(4)</num><intro><p>Any notification given under subsection <ref href="#d25e485">(2)</ref><ref href="#d25e494">(a)</ref> or <ref href="#d25e506">(3)</ref><ref href="#d25e521">(a)</ref> must include a statement, in a form approved by the Chief Inspector, inviting the registered parents of registered pupils to inform the Chief Inspector of their views on matters relating to—</p></intro><level class="para1"><num>(a)</num><content><p>the Academy at which their child is a registered pupil;</p></content></level><level class="para1"><num>(b)</num><content><p>the Academy proprietor.</p></content></level></subsection></section><section eId="d25e573"><num>122E</num><heading>Power or duty to treat other inspection as section <ref href="#d25e114">122A</ref> inspection</heading><subsection><num>(1)</num><content><p>The Chief Inspector may elect for an inspection under section <ref href="#d25e400">122C</ref> of an Academy proprietor to which section <ref href="#d25e114">122A</ref> applies to be treated as if it were an inspection under section <ref href="#d25e114">122A</ref> for the purposes of section <ref href="#d25e114">122A</ref><ref href="#d25e118">(1)</ref>, section <ref href="#d25e224">122B</ref><ref href="#d25e279">(3)</ref> to <ref href="#d25e337">(6)</ref> and section <ref href="#d25e941">122H</ref>.</p></content></subsection><subsection><num>(2)</num><content><p>In the case of an inspection of an exempt proprietor under section <ref href="#d25e400">122C</ref>, the Chief Inspector may elect to treat the inspection as if it were an inspection under section <ref href="#d25e114">122A</ref> for the purposes of section <ref href="#d25e114">122A</ref><ref href="#d25e157">(4)</ref> and sections <ref href="#d25e224">122B</ref> and <ref href="#d25e941">122H</ref>.</p></content></subsection><subsection><num>(3)</num><content><p>The Secretary of State may require the Chief Inspector to treat an inspection under section <ref href="#d25e400">122C</ref><ref href="#d25e404">(1)</ref> of an Academy proprietor to which section <ref href="#d25e114">122A</ref> applies as if it were an inspection under section <ref href="#d25e114">122A</ref> for the purposes of section <ref href="#d25e114">122A</ref><ref href="#d25e118">(1)</ref> and <ref href="#d25e157">(4)</ref> and sections <ref href="#d25e224">122B</ref> and <ref href="#d25e941">122H</ref>.</p></content></subsection><subsection><num>(4)</num><content><p>In the case of an inspection of an exempt proprietor under section <ref href="#d25e400">122C</ref><ref href="#d25e404">(1)</ref>, the Secretary of State may require the Chief Inspector to treat the inspection as if it were an inspection under section <ref href="#d25e114">122A</ref> for the purposes of section <ref href="#d25e114">122A</ref><ref href="#d25e157">(4)</ref> and sections <ref href="#d25e224">122B</ref> and <ref href="#d25e941">122H</ref>.</p></content></subsection><subsection><num>(5)</num><content><p>In this section, “<term refersTo="#term-exempt-proprietor">exempt proprietor</term>” has the meaning given by section <ref href="#d25e114">122A</ref><ref href="#d25e145">(3)</ref>.</p></content></subsection></section><section><num>122F</num><heading>Framework for inspections under this Chapter</heading><subsection eId="d25e711"><num>(1)</num><intro><p>The Chief Inspector must devise—</p></intro><level class="para1" eId="d25e717"><num>(a)</num><content><p>a common set of principles applicable to all inspections conducted under this Chapter, or</p></content></level><level class="para1" eId="d25e723"><num>(b)</num><content><p>two or more common sets of principles each of which is applicable to a particular description of such inspections.</p></content></level></subsection><subsection><num>(2)</num><content><p>A set of principles devised under subsection <ref refersTo="#term-framework">framework</term>”.</p></content></subsection><subsection><num>(3)</num><content><p>If the Chief Inspector devises two or more frameworks under subsection <ref href="#d25e711">(1)</ref><ref href="#d25e723">(b)</ref>, the Chief Inspector must ensure that, taken together, they cover all inspections conducted under this Chapter.</p></content></subsection><subsection><num>(4)</num><content><p>A framework must cover such matters as may be specified in regulations made by the Secretary of State.</p></content></subsection><subsection><num>(5)</num><content><p>The Chief Inspector must publish a framework in such manner as the Chief Inspector considers appropriate.</p></content></subsection><subsection><num>(6)</num><content><p>The Chief Inspector may at any time revise a framework.</p></content></subsection><subsection><num>(7)</num><content><p>The Chief Inspector must publish a revised framework in such manner as the Chief Inspector considers appropriate.</p></content></subsection><subsection><num>(8)</num><content><p>In devising or revising a framework, the Chief Inspector must have regard to guidance given from time to time by the Secretary of State.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Powers of entry etc.</heading><section><num>122G</num><heading>Powers of entry etc. for purposes of inspection</heading><subsection><num>(1)</num><content><p>This section applies to an inspection conducted by the Chief Inspector under this Chapter.</p></content></subsection><subsection><num>(2)</num><intro><p>The Chief Inspector may, at any reasonable time, enter—</p></intro><level class="para1"><num>(a)</num><content><p>any premises of the Academy proprietor;</p></content></level><level class="para1" eId="d25e815"><num>(b)</num><content><p>the premises of any Academy of which the Academy proprietor is the proprietor;</p></content></level><level class="para1"><num>(c)</num><content><p>any other premises on which, by virtue of arrangements made by the Academy proprietor, any pupils or students who are registered at an Academy within paragraph <ref href="#d25e815">(b)</ref> are receiving part of their education from any person (“<term refersTo="#term-the-provider">the provider</term>”);</p></content></level><level class="para1"><num>(d)</num><content><p>any premises of the provider used in connection with the provision by the provider of that education.</p></content></level></subsection><subsection eId="d25e839"><num>(3)</num><intro><p>The Chief Inspector may, at any reasonable time, inspect, take copies of, or take away such of the following as the Chief Inspector considers relevant to the discharge of the Chief Inspector’s functions under this Chapter—</p></intro><level class="para1"><num>(a)</num><content><p>any documents or records kept by the Academy proprietor;</p></content></level><level class="para1"><num>(b)</num><content><p>any documents or records kept by an Academy of which the Academy proprietor is the proprietor;</p></content></level><level class="para1"><num>(c)</num><content><p>any documents or records kept by the provider relating to the provision of education by virtue of arrangements made by the Academy proprietor.</p></content></level></subsection><subsection><num>(4)</num><intro><p>The power in subsection <ref href="#d25e839">(3)</ref> includes—</p></intro><level class="para1"><num>(a)</num><content><p>power to require any person holding or accountable for any such documents or records to produce them, and</p></content></level><level class="para1"><num>(b)</num><content><p>in relation to any such documents or records kept by means of a computer, power to require them to be produced in a form in which they are legible and can be taken away.</p></content></level></subsection><subsection><num>(5)</num><intro><p>In connection with inspecting any such documents or records the Chief Inspector—</p></intro><level class="para1"><num>(a)</num><content><p>may obtain access to, and inspect and check the operation of, any computer and associated apparatus or material which the Chief Inspector considers is or has been in use in connection with the documents or records, and</p></content></level><level class="para1"><num>(b)</num><content><p>may require a person within subsection <ref href="#d25e905">(6)</ref> to afford the Chief Inspector such reasonable assistance as the Chief Inspector requires for that purpose.</p></content></level></subsection><subsection eId="d25e905"><num>(6)</num><intro><p>A person is within this subsection if that person is—</p></intro><level class="para1"><num>(a)</num><content><p>the person by whom or on whose behalf the computer is or has been used, or</p></content></level><level class="para1"><num>(b)</num><content><p>a person having charge of, or otherwise concerned with the operation of, the computer, apparatus or material.</p></content></level></subsection><subsection><num>(7)</num><content><p>A person is guilty of an offence if that person intentionally obstructs the Chief Inspector in the exercise of any function conferred by this Chapter.</p></content></subsection><subsection><num>(8)</num><content><p>A person who commits an offence under this section is liable on summary conviction to a fine not exceeding level 4 on the standard scale.</p></content></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Academy proprietors not performing to acceptable standard</heading><section eId="d25e941"><num>122H</num><heading>Academy proprietors not performing to acceptable standard</heading><subsection eId="d25e945"><num>(1)</num><intro><p>Subsections <ref href="#d25e972">(2)</ref> to <ref href="#d25e1032">(4)</ref> apply if, on completion of an inspection under section <ref href="#d25e114">122A</ref>, the Chief Inspector is of the opinion that—</p></intro><level class="para1" eId="d25e960"><num>(a)</num><content><p>the persons responsible for leading, managing and governing the Academy proprietor are failing to lead, manage or govern the Academy proprietor to an acceptable standard, or</p></content></level><level class="para1" eId="d25e966"><num>(b)</num><content><p>the Academy proprietor is failing to lead, manage or govern an Academy of which it is the proprietor to an acceptable standard.</p></content></level></subsection><subsection eId="d25e972"><num>(2)</num><intro><p>The Chief Inspector must—</p></intro><level class="para1"><num>(a)</num><content><p>send a draft of the report of the inspection to the Academy proprietor, and</p></content></level><level class="para1"><num>(b)</num><content><p>consider any comments on the draft that are made by the Academy proprietor within such period as may be specified in regulations made by the Secretary of State.</p></content></level></subsection><subsection eId="d25e990"><num>(3)</num><intro><p>Where, after complying with subsection <ref href="#d25e972">(2)</ref>, the Chief Inspector is of the opinion that the case falls within paragraph <ref href="#d25e960">(a)</ref> or <ref href="#d25e966">(b)</ref> of subsection <ref href="#d25e945">(1)</ref>, the Chief Inspector must—</p></intro><level class="para1" eId="d25e1008"><num>(a)</num><intro><p>without delay, notify the following persons in writing of that opinion—</p></intro><level class="para2"><num>(i)</num><content><p>the Secretary of State, and</p></content></level><level class="para2"><num>(ii)</num><content><p>the Academy proprietor, and</p></content></level></level><level class="para1"><num>(b)</num><content><p>state that opinion in the report of the inspection.</p></content></level></subsection><subsection eId="d25e1032"><num>(4)</num><intro><p>A notification made under subsection <ref href="#d25e990">(3)</ref><ref href="#d25e1008">(a)</ref> must also record—</p></intro><level class="para1"><num>(a)</num><content><p>in a case within subsection <ref href="#d25e945">(1)</ref><ref href="#d25e960">(a)</ref>, whether the Chief Inspector is of the opinion that the persons responsible for leading, managing and governing the Academy proprietor are demonstrating the capacity to secure the necessary improvement in the Academy proprietor;</p></content></level><level class="para1"><num>(b)</num><content><p>in a case within subsection <ref href="#d25e945">(1)</ref><ref href="#d25e966">(b)</ref>, whether the Chief Inspector is of the opinion that the Academy proprietor is demonstrating the capacity to secure the necessary improvement in the Academy.</p></content></level></subsection></section></hcontainer><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Supplementary</heading><section><num>122I</num><heading>Regulations under Chapter 2A</heading><intro><p>Regulations under this Chapter may—</p></intro><level class="para1"><num>(a)</num><content><p>make different provision for different purposes;</p></content></level><level class="para1"><num>(b)</num><content><p>make consequential provision.</p></content></level></section><section><num>122J</num><heading>Interpretation of Chapter 2A</heading><subsection eId="d25e1096"><num>(1)</num><intro><p>In this Chapter—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-academy">Academy</term>” means an educational institution to which Academy arrangements relate;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-academy-arrangements">Academy arrangements</term>” has the meaning given by <ref eId="c00759" href="https://www.legislation.gov.uk/ukpga/2010/32/section/1">section 1</ref> of the <ref eId="c00760" href="https://www.legislation.gov.uk/ukpga/2010/32/contents">Academies Act 2010</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-academy-proprietor">Academy proprietor</term>” is a person who, in pursuance of Academy arrangements, is the proprietor of an Academy;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-academy-school">Academy school</term>” has the meaning given by <ref eId="c00761" href="https://www.legislation.gov.uk/ukpga/2010/32/section/1A">section 1A</ref> of the <ref eId="c00762" href="https://www.legislation.gov.uk/ukpga/2010/32/contents">Academies Act 2010</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-alternative-provision-academy">alternative provision Academy</term>” has the meaning given by <ref eId="c00763" href="https://www.legislation.gov.uk/ukpga/2010/32/section/1C">section 1C</ref> of <ref eId="c00764" href="https://www.legislation.gov.uk/ukpga/2010/32/contents">that Act</ref>;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-denominational-education">denominational education</term>”, in relation to an Academy, means religious education which—</p></intro><level class="para1"><num>(a)</num><content><p>is provided in accordance with—</p><blockList class="ordered roman parens" ukl:Name="OrderedList" ukl:Type="roman" ukl:Decoration="parens"><item><num>(i)</num><p>any provisions of the trust deed affecting the Academy which relate to the teaching and learning of religious education, or</p></item><item><num>(ii)</num><p>the tenets of the religion or religious denomination in relation to which the Academy is designated, and</p></item></blockList></content></level><level class="para1"><num>(b)</num><content><p>is not required by Academy arrangements to be given in accordance with the requirements for agreed syllabuses in <ref eId="c00765" href="https://www.legislation.gov.uk/ukpga/1996/56/section/375">section 375</ref><ref eId="c00766" href="https://www.legislation.gov.uk/ukpga/1996/56/section/375">(3)</ref> of the <ref eId="c00767" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">Education Act 1996</ref>;</p></content></level></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-parent">parent</term>” has the meaning given by <ref eId="c00768" href="https://www.legislation.gov.uk/ukpga/1996/56/section/576">section 576</ref> of <ref eId="c00769" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">that Act</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-registered">registered</term>”, in relation to the parents of pupils at an Academy school or alternative provision Academy, means shown in the register kept under <ref eId="c00770" href="https://www.legislation.gov.uk/ukpga/1996/56/section/434">section 434</ref> of <ref eId="c00771" href="https://www.legislation.gov.uk/ukpga/1996/56/contents">that Act</ref>;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-registered-pupil">registered pupil</term>”, in relation to an Academy school or alternative provision Academy, means a person registered as a pupil in that register;</p></content></hcontainer><hcontainer name="definition"><intro><p>“<term refersTo="#term-relevant-religious-body">relevant religious body</term>”, in relation to an Academy, means—</p></intro><level class="para1"><num>(a)</num><content><p>in the case of a Church of England Academy or a Roman Catholic Church Academy, the appropriate diocesan authority, and</p></content></level><level class="para1"><num>(b)</num><content><p>in any other case, such body or person as is specified in the Academy arrangements relating to the Academy as representing the religion or religious denomination in relation to which the Academy is designated,</p></content></level><wrapUp><p>and in the case of an Academy designated in relation to more than one religion or religious denomination, references to “the relevant religious body” are to be read as references to all of the relevant religious bodies applicable to the Academy;</p></wrapUp></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-trust-deed">trust deed</term>”, in relation to an Academy, includes any instrument (other than the articles or memorandum of association) regulating the constitution of the Academy proprietor or the maintenance, management or conduct of the Academy.</p></content></hcontainer></subsection><subsection><num>(2)</num><intro><p>In subsection <ref href="#d25e1096">(1)</ref>—</p></intro><level class="para1"><num>(a)</num><content><p>“<term refersTo="#term-church-of-england-academy">Church of England Academy</term>” means an Academy in the Province of Canterbury or York in relation to which the religion or religious denomination specified in the order designating the Academy as having a religious character is “Church of England” and “<term refersTo="#term-appropriate-diocesan-authority">appropriate diocesan authority</term>”, in relation to such an Academy, means the Diocesan Board of Education for the diocese of the Church of England in which the school is situated, and</p></content></level><level class="para1"><num>(b)</num><content><p>“<term refersTo="#term-roman-catholic-church-academy">Roman Catholic Church Academy</term>” means an Academy in relation to which the religion or religious denomination specified in the order designating the Academy as having a religious character is “Roman Catholic” and “<term refersTo="#term-appropriate-diocesan-authority">appropriate diocesan authority</term>”, in relation to such an Academy, means the bishop of the Roman Catholic diocese in which the Academy is situated.</p></content></level></subsection><subsection><num>(3)</num><intro><p>For the purposes of this Chapter, an Academy has been “designated as having a religious character” if it has been so designated by an order under—</p></intro><level class="para1"><num>(a)</num><content><p><ref eId="c00772" href="https://www.legislation.gov.uk/ukpga/1998/31/section/69">section 69</ref><ref eId="c00773" href="https://www.legislation.gov.uk/ukpga/1998/31/section/69">(3)</ref> of the <ref eId="c00774" href="https://www.legislation.gov.uk/ukpga/1998/31/contents">School Standards and Framework Act 1998</ref> by virtue of <ref eId="c00775" href="https://www.legislation.gov.uk/ukpga/1998/31/section/124B">section 124B</ref><ref eId="c00776" href="https://www.legislation.gov.uk/ukpga/1998/31/section/124B">(2)</ref> of <ref eId="c00777" href="https://www.legislation.gov.uk/ukpga/1998/31/contents">that Act</ref>, or</p></content></level><level class="para1"><num>(b)</num><content><p><ref eId="c00778" href="https://www.legislation.gov.uk/ukpga/2010/32/section/8A">section 8A</ref><ref eId="c00779" href="https://www.legislation.gov.uk/ukpga/2010/32/section/8A">(1)</ref> of the <ref eId="c00780" href="https://www.legislation.gov.uk/ukpga/2010/32/contents">Academies Act 2010</ref> (16 to 19 academies having religious character),</p></content></level><wrapUp><p>and references to the order designating the Academy as having a religious character should be read accordingly.</p></wrapUp></subsection></section></hcontainer></chapter></quotedStructure></mod></p></content></subsection><subsection eId="section-57-3"><num>(3)</num><content><p><mod>In <ref eId="d25e1390"><num>(1)</num><intro><p>An Academy agreement must include provision allowing the Secretary of State to terminate the agreement if the Chief Inspector has given notice under <ref eId="c00786" href="https://www.legislation.gov.uk/ukpga/2006/40/section/122H">section </ref><ref href="#d25e941">122H</ref>(3)(a) of the <ref eId="c00787" href="https://www.legislation.gov.uk/ukpga/2006/40/contents">Education and Inspections Act 2006</ref> that—</p></intro><level class="para1"><num>(a)</num><content><p>the persons responsible for leading, managing and governing the Academy proprietor are failing to lead, manage or govern the Academy proprietor to an acceptable standard, or</p></content></level><level class="para1"><num>(b)</num><content><p>the Academy proprietor is failing to lead, manage or govern an Academy of which it is the proprietor to an acceptable standard.</p></content></level></subsection><subsection><num>(2)</num><content><p>The Academy agreement must require the Secretary of State, before terminating the agreement on one of those grounds, to give the proprietor a termination warning notice.</p></content></subsection><subsection eId="d25e1422"><num>(3)</num><intro><p>A termination warning notice is a notice—</p></intro><level class="para1"><num>(a)</num><content><p>requesting that the Academy proprietor respond to the Secretary of State by making representations, or</p></content></level><level class="para1" eId="d25e1434"><num>(b)</num><intro><p>requiring the Academy proprietor—</p></intro><level class="para2"><num>(i)</num><content><p>to take specified action by a specified date, and</p></content></level><level class="para2"><num>(ii)</num><content><p>to respond to the Secretary of State by making representations, or by agreeing to take that action, by a specified date.</p></content></level></level></subsection><subsection><num>(4)</num><content><p>The Academy agreement must provide that, where a termination warning notice under subsection <ref href="#d25e1422">(3)</ref><ref href="#d25e1434">(b)</ref> is given to the Academy proprietor on one of the grounds specified in subsection <ref href="#d25e1390">(1)</ref>, the power to terminate the agreement is available only if the proprietor has failed to comply with the termination warning notice (whether by failing to take specified action, or to respond, on time).</p></content></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-57-6"><num>(6)</num><content><p><mod>For <ref eId="c00788" href="https://www.legislation.gov.uk/ukpga/2010/32/section/2C">section 2C</ref> (new academy agreements) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" Wellbeing and Schools Act 2026 comes fully into force may include further provision about—</p></intro><level class="para1"><num>(a)</num><content><p>the procedure for terminating the agreement in accordance with the provision required by section 2A, <ref href="#d25e1386">2AA</ref> or 2B;</p></content></level><level class="para1"><num>(b)</num><content><p>the consequences of terminating the agreement in accordance with that provision.</p></content></level></subsection><subsection><num>(3)</num><content><p>Section <ref href="#d25e1556">2D</ref> makes provision about agreements entered into before those dates.</p></content></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-57-7"><num>(7)</num><content><p><mod>For <ref eId="c00789" href="https://www.legislation.gov.uk/ukpga/2010/32/section/2D">section 2D</ref> (old academy agreements) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" agreement does not apply to the new termination powers.</p></content></subsection><subsection><num>(4)</num><content><p>A provision of a pre-section <ref href="#d25e1386">2AA</ref> agreement that relates to the procedure for terminating the agreement does not apply to the section <ref href="#d25e1386">2AA</ref> termination powers.</p></content></subsection><subsection><num>(5)</num><intro><p>Subsections <ref href="#d25e1641">(6)</ref> and <ref href="#d25e1665">(7)</ref> apply where an old Academy agreement or a pre-section <ref href="#d25e1386">2AA</ref> Academy agreement—</p></intro><level class="para1"><num>(a)</num><content><p>contains provision about the consequences of terminating the agreement (“relevant provision”), and</p></content></level><level class="para1"><num>(b)</num><intro><p>the relevant provision is expressed in a way that—</p></intro><level class="para2"><num>(i)</num><content><p>in the case of an old Academy agreement, is capable of covering termination in accordance with the new termination powers;</p></content></level><level class="para2"><num>(ii)</num><content><p>in the case of a pre-section <ref href="#d25e1386">2AA</ref> agreement, is capable of covering termination in accordance with the section <ref href="#d25e1386">2AA</ref> termination powers.</p></content></level></level></subsection><subsection eId="d25e1641"><num>(6)</num><intro><p>The relevant provision applies to termination in accordance with—</p></intro><level class="para1"><num>(a)</num><content><p>in the case of an old Academy agreement, the new termination powers;</p></content></level><level class="para1"><num>(b)</num><content><p>in the case of a pre-section <ref href="#d25e1386">2AA</ref> agreement, the section <ref href="#d25e1386">2AA</ref> termination powers.</p></content></level></subsection><subsection eId="d25e1665"><num>(7)</num><intro><p>If the relevant provision sets out different consequences depending on whether the agreement is terminated on the ground that the proprietor has breached the Agreement or on other grounds—</p></intro><level class="para1"><num>(a)</num><content><p>in the case of an old Academy agreement, termination in accordance with the new termination powers is to be treated as termination on the grounds of breach by the proprietor, and</p></content></level><level class="para1"><num>(b)</num><content><p>in the case of a pre-section <ref href="#d25e1386">2AA</ref> agreement, termination in accordance with the section <ref href="#d25e1386">2AA</ref> termination powers is to be treated as termination on the grounds of breach by the proprietor.</p></content></level></subsection><subsection><num>(8)</num><intro><p>In this section—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-new-termination-powers">new termination powers</term>”, in relation to an Academy agreement, means the powers to terminate in accordance with the provision required by sections 2A, <ref href="#d25e1386">2AA</ref> and 2B;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-old-academy-agreement">old Academy agreement</term>” means an Academy agreement made before 18 April 2016;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-pre-section-2aa-agreement">pre-section 2AA agreement</term>” means an Academy agreement made on or after the 18 April 2016, but before the day on which section <ref href="#section-57">57</ref> of the Children’s Wellbeing and Schools Act 2026 comes fully into force;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-section-2aa-termination-powers">section 2AA termination powers</term>” in relation to an Academy agreement, means the powers to terminate in accordance with the provision required by section <ref
