<Text>a company registered under the <Citation URI="https://www.legislation.gov.uk/ukpga/2006/46/contents" id="c00678" Class="UnitedKingdomPublicGeneralAct" Year="2006" Number="46" SectionRef="contents">Companies Act 2006</Citation> which has its registered office for the purposes of <Citation URI="https://www.legislation.gov.uk/ukpga/2006/46/contents" id="c00679" Class="UnitedKingdomPublicGeneralAct" Year="2006" Number="46" SectionRef="contents">that Act</Citation> in England, or</Text>

<Pnumber>b</Pnumber>

<Text>The second condition is that it provides education to at least one student who lives in England and who—</Text>

<P3para>
<Text>is over compulsory school age but is under the age of 19, or</Text>

<Text>is aged 19 or over and has an EHC plan that specifies that the student should be in full-time education.</Text>

<Text>The third condition is that at least one of the students mentioned in subsection <InternalLink Ref="p12775">(3)</InternalLink> receives all or the majority of their education from the institution.</Text>

<Text>The fourth condition is that it is set up to deliver all or the majority of the education that it provides online.</Text>

<Text>The Secretary of State may by regulations amend this section so as to add a new condition or remove or change a condition for the time being specified.</Text>
