1 to 4</ref> of the <ref eId="c00674" href="https://www.legislation.gov.uk/ukpga/2022/21/contents">Skills and Post-16 Education Act 2022</ref> (see section 4 of that Act);</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-special-post-16-institution">special post-16 institution</term>” has the same meaning as in <ref eId="c00675" href="https://www.legislation.gov.uk/ukpga/2014/6/part/3">Part 3</ref> of the <ref eId="c00676" href="https://www.legislation.gov.uk/ukpga/2014/6/contents">Children and Families Act 2014</ref> (see section 83 of that Act);</p></content></hcontainer></quotedStructure><inline name="appendText">.</inline></mod></p></content></level></subsection><subsection eId="section-52-3"><num>(3)</num><content><p><mod>After <ref eId="c00677" href="https://www.legislation.gov.uk/ukpga/2002/32/section/141A">section 141A</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e227"><num>141AA</num><heading>Meaning of “online education provider”</heading><subsection><num>(1)</num><content><p>An online education provider is an institution that meets the following conditions.</p></content></subsection><subsection><num>(2)</num><intro><p>The first condition is that it is—</p></intro><level class="para1"><num>(a)</num><content><p>a company registered under the <ref eId="c00678" href="https://www.legislation.gov.uk/ukpga/2006/46/contents">Companies Act 2006</ref> which has its registered office for the purposes of <ref eId="c00679" href="https://www.legislation.gov.uk/ukpga/2006/46/contents">that Act</ref> in England, or</p></content></level><level class="para1"><num>(b)</num><content><p>a charity registered in accordance with <ref eId="c00680" href="https://www.legislation.gov.uk/ukpga/2011/25/section/30">section 30</ref> of the <ref eId="c00681" href="https://www.legislation.gov.uk/ukpga/2011/25/contents">Charities Act 2011</ref> which has its address in England for the purposes of registration by the Charity Commission.</p></content></level></subsection><subsection eId="d25e267"><num>(3)</num><intro><p>The second condition is that it provides education to at least one student who lives in England and who—</p></intro><level class="para1"><num>(a)</num><content><p>is of compulsory school age,</p></content></level><level class="para1"><num>(b)</num><content><p>is over compulsory school age but is under the age of 19, or</p></content></level><level class="para1"><num>(c)</num><content><p>is aged 19 or over and has an EHC plan that specifies that the student should be in full-time education.</p></content></level></subsection><subsection><num>(4)</num><content><p>The third condition is that at least one of the students mentioned in subsection <ref href="#d25e267">(3)</ref> receives all or the majority of their education from the institution.</p></content></subsection><subsection><num>(5)</num><content><p>The fourth condition is that it is set up to deliver all or the majority of the education that it provides online.</p></content></subsection><subsection eId="d25e306"><num>(6)</num><content><p>The Secretary of State may by regulations amend this section so as to add a new condition or remove or change a condition for the time being specified.</p></content></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-52-4"><num>(4)</num><intro><p>In <ref eId="c00682" href="https://www.legislation.gov.uk/ukpga/2002/32/section/141B">section 141B</ref> (investigation of disciplinary cases by the Secretary of State)—</p></intro><level class="para1" eId="section-52-4-a"><num>(a)</num><intro><p>in <ref eId="c00683" href="https://www.legislation.gov.uk/ukpga/2002/32/section/141B">subsection (1)</ref>—</p></intro><level class="para2" eId="section-52-4-a-i"><num>(i)</num><content><p><mod>in the words before <ref eId="c00684" href="https://www.legislation.gov.uk/ukpga/2002/32/section/141B">paragraph (a)</ref>, for “an allegation is referred” substitute <quotedText>“it
