<Text>The Chief Inspector may exercise the powers of entry and investigation conferred by <Span><InternalLink Ref="p11830">sections 127B</InternalLink> to <InternalLink Ref="p12072">127D</InternalLink>
</Span> if the Chief Inspector has reasonable cause to believe—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>that a relevant offence is being or has been committed on the premises to be entered, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>that evidence of the commission of a relevant offence may be found on or accessed from the premises to be entered.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>In this section and <Span><InternalLink Ref="p11830">sections 127B</InternalLink> to <InternalLink Ref="p12072">127D</InternalLink>
</Span> “<Term>relevant offence</Term>” means an offence under—</Text>

<Text>section 96 (conducting an unregistered independent educational institution),</Text>

<Text>section 118 (failure to comply with relevant restriction imposed by Secretary of State),</Text>

<Text><InternalLink Ref="p10314">section 118C</InternalLink> (providing education at institution when registration is suspended),</Text>

<Text><InternalLink Ref="p10763">section 118F</InternalLink> (providing boarding accommodation in breach of stop boarding requirement),</Text>

<Text>section 121 (failure to comply with relevant restriction imposed by justice of the peace),</Text>

<Title>Entry without warrant and powers of investigation</Title>
<P1 id="p11830">
<Pnumber>127B</Pnumber>
<P1para>
<P2>
<Pnumber>1</Pnumber>
<P2para>
<Text>The Chief Inspector may, without a warrant, enter any premises (see also <InternalLink Ref="p11912">section 127C</InternalLink> for entry to premises under warrant).</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>The power of entry must be exercised at a reasonable hour.</Text>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>Before entering any premises under this section, the Chief Inspector must—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>produce evidence of their identity, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>outline the purpose for which the power is exercised,</Text>
</P3para>
</P3>
<Text>if asked to do so by a person on the premises.</Text>
</P2para>
</P2>

<Pnumber>4</Pnumber>
<P2para>
<Text>On entering any premises under this section, the Chief Inspector may—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>inspect the premises;</Text>
</P3para>

<Pnumber>b</Pnumber>
<P3para>
<Text>inspect and take copies of any document found on the premises;</Text>
</P3para>

<Text>inspect any equipment found on the premises;</Text>

<Pnumber>d</Pnumber>
<P3para>
<Text>take measurements of the premises or anything found on the premises;</Text>

<Text>take photographs and make audio and video recordings on the premises.</Text>

<Text>When entering premises under this section, the Chief Inspector may be accompanied by any person and bring anything to facilitate the exercise of a power conferred by <InternalLink Ref="p11855">subsection (4)</InternalLink>.</Text>

<Pnumber>6</Pnumber>
<P2para>
<Text>A person who accompanies the Chief Inspector under <InternalLink Ref="p11879">subsection (5)</InternalLink> may only do something intended to facilitate the exercise of a power conferred by <InternalLink Ref="p11855">subsection (4)</InternalLink> while—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>in the company of the Chief Inspector, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>

<Text>under the Chief Inspector’s supervision.</Text>

<Pnumber>7</Pnumber>
<P2para>
<Text>In this section and <InternalLink Ref="p12072">section 127D</InternalLink> “<Term>document</Term>” means anything in which information of any description is recorded.</Text>

<Pnumber>8</Pnumber>
<P2para>
<Text>This section does not confer power to inspect or take copies of anything of a kind specified in <Citation URI="https://www.legislation.gov.uk/ukpga/1984/60/section/9" id="c00626" Class="UnitedKingdomPublicGeneralAct" Year="1984" Number="60" SectionRef="section-9">section 9</Citation><Citation URI="https://www.legislation.gov.uk/ukpga/1984/60/section/9" id="c00627" Class="UnitedKingdomPublicGeneralAct" Year="1984" Number="60" SectionRef="section-9">(2)</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1984/60/contents" id="c00628" Class="UnitedKingdomPublicGeneralAct" Year="1984" Number="60" SectionRef="contents">Police and Criminal Evidence Act 1984</Citation> (legally privileged material etc).</Text>

<Title>Entry under warrant</Title>
<P1 id="p11912">
<Pnumber>127C</Pnumber>
<P1para>
<P2>
<Pnumber>1</Pnumber>
<P2para>
<Text>The Chief Inspector may enter premises if authorised by a warrant under this section to do so.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>A justice of the peace may issue a warrant under this section only if satisfied, on an application by the Chief Inspector, that the requirement in <InternalLink Ref="p11768">section 127A</InternalLink><InternalLink Ref="p11770">(1)</InternalLink> (reasonable cause for belief) is met, and that—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>entry to the premises under <InternalLink Ref="p11830">section 127B</InternalLink> has been refused or is likely to be refused unless a warrant is produced,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>it is not practicable to communicate with any person entitled to grant entry,</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>entering or attempting to enter the premises without a warrant may frustrate or seriously prejudice the purpose of entering, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>to investigate a relevant offence effectively, the powers of investigation conferred by <InternalLink Ref="p12072">section 127D</InternalLink><InternalLink Ref="p12074">(1)</InternalLink> should be available to the Chief Inspector (in addition to those conferred by <InternalLink Ref="p11830">section 127B</InternalLink>).</Text>

</P3>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>A warrant under this section may authorise the Chief Inspector to enter—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>one or more premises specified in the application, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>any premises occupied or controlled by a person specified in the application (an “all premises warrant”).</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>4</Pnumber>
<P2para>
<Text>If the application is for an all premises warrant, the justice of the peace must also be satisfied—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>that there are reasonable grounds for believing that it is necessary to enter premises occupied or controlled by the person which are not specified in the application to investigate a relevant offence effectively, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>that it is not reasonably practicable to specify in the application all the premises which the person occupies or controls and may need to be entered to investigate the offence effectively.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>5</Pnumber>
<P2para>
<Text>A warrant under this section authorises entry on one occasion only unless it specifies that it authorises multiple entries.</Text>
</P2para>
</P2>
<P2>
<Pnumber>6</Pnumber>
<P2para>
<Text>If the warrant authorises multiple entries, it must also specify whether the number of entries authorised is unlimited or limited to a specified maximum.</Text>
</P2para>
</P2>
<P2 id="p11978">
<Pnumber>7</Pnumber>
<P2para>
<Text>A warrant under this section—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>authorises the Chief Inspector to exercise the powers of investigation conferred by <InternalLink Ref="p12072">section 127D</InternalLink><InternalLink Ref="p12074">(1)</InternalLink><InternalLink Ref="p12081">(a)</InternalLink>, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>may authorise the Chief Inspector to exercise the powers of investigation conferred by <InternalLink Ref="p12072">section 127D</InternalLink><InternalLink Ref="p12074">(1)</InternalLink><InternalLink Ref="p12088">(b)</InternalLink> to <InternalLink Ref="p12130">(k)</InternalLink> or particular powers.</Text>

<Pnumber>8</Pnumber>
<P2para>
<Text>The power of entry must be exercised at a reasonable hour unless the Chief Inspector considers that the purpose of entry and investigation may be frustrated by entry at a reasonable hour.</Text>
</P2para>
</P2>
<P2>
<Pnumber>9</Pnumber>
<P2para>
<Text>Before entering premises under a warrant, the Chief Inspector must—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>produce evidence of their identity, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>outline the purpose for which the power is exercised,</Text>
</P3para>
</P3>
<Text>if asked to do so by a person on the premises.</Text>

<Text>On entering premises under a warrant, the Chief Inspector must—</Text>

<Text>provide a copy of the warrant to the occupier or to any other person appearing to be in charge of the premises, or</Text>

<Pnumber>b</Pnumber>

<Text>if neither the occupier nor any such person is present, leave a copy of the warrant in a prominent place on the premises.</Text>

<Text>When entering premises under a warrant, the Chief Inspector may be accompanied by any person and bring anything to facilitate the exercise of a power conferred by <InternalLink Ref="p12072">section 127D</InternalLink><InternalLink Ref="p12074">(1)</InternalLink>.</Text>

<Text>The following provisions of the <Citation URI="https://www.legislation.gov.uk/ukpga/1984/60/contents" id="c00629" Class="UnitedKingdomPublicGeneralAct" Year="1984" Number="60" SectionRef="contents">Police and Criminal Evidence Act 1984</Citation> apply to a warrant under this section as though references there to a constable were to the Chief Inspector—</Text>

<Text>subsections (2) to (8) of section 15 (search warrants: safeguards);</Text>

<Pnumber>b</Pnumber>

<Title>Powers of investigation following entry under warrant</Title>

<Text>On entering any premises under a warrant issued under <InternalLink Ref="p11912">section 127C</InternalLink> (and subject to any limitation imposed under <InternalLink Ref="p11912">section 127C</InternalLink><InternalLink Ref="p11978">(7)</InternalLink>) the Chief Inspector may—</Text>

<Text>interview any person aged 18 or over on the premises where there is reasonable cause to believe that the person can provide information relating to a relevant offence, and require the person to provide any such information;</Text>

<Text>require any person on the premises to provide the Chief Inspector with whatever facilities and assistance within the person’s control are necessary to enable the Chief Inspector to exercise the powers conferred by this section.</Text>

<Text>The Chief Inspector may only exercise a power conferred by <InternalLink Ref="p12074">subsection (1)</InternalLink><InternalLink Ref="p12088">(b)</InternalLink> to <InternalLink Ref="p12130">(k)</InternalLink> for the purpose for which the warrant under <InternalLink Ref="p11912">section 127C</InternalLink> was issued.</Text>

<Text>Anything seized under <InternalLink Ref="p12074">subsection (1)</InternalLink><InternalLink Ref="p12100">(e)</InternalLink>, <InternalLink Ref="p12113">(h)</InternalLink> or <InternalLink Ref="p12119">(i)</InternalLink> may be retained for so long as is necessary in all the circumstances.</Text>

<Text>they may be interviewed either alone or in the presence of one or more other persons;</Text>

<Text>no answer which the person gives during the interview is admissible in evidence against the person, or the person’s spouse or civil partner, in any criminal proceedings.</Text>

<Text>The Chief Inspector may apply to a justice of the peace for a warrant authorising a constable to assist the Chief Inspector, using reasonable force if necessary, to—</Text>

<Text>enter premises mentioned in subsection <InternalLink Ref="p12244">(2)</InternalLink> under a warrant issued under <InternalLink Ref="p11912">section 127C</InternalLink>, or</Text>

<Text>any premises occupied or controlled by a person specified in the application.</Text>

<Text>The justice may issue a warrant only if satisfied that the requirement in <InternalLink Ref="p11768">section 127A</InternalLink><InternalLink Ref="p11770">(1)</InternalLink> (reasonable cause for belief) is met, and that—</Text>

<P3para>
<Text>the Chief Inspector has attempted to exercise a power conferred by <InternalLink Ref="p11912">section 127C</InternalLink> or <InternalLink Ref="p12072">127D</InternalLink> but has been prevented from doing so,</Text>

<Text>the Chief Inspector reasonably expects to be prevented from exercising any such power if an attempt to do so is made, or</Text>

<Text>the purpose of exercising any such power may be frustrated unless the Chief Inspector, on arriving at the premises, can exercise the power immediately.</Text>

<Text>A warrant under this section must be issued to and executed by a constable.</Text>

<Text>A person commits an offence if they intentionally fail to comply with a requirement reasonably imposed under <InternalLink Ref="p12072">section 127D</InternalLink><InternalLink Ref="p12074">(1)</InternalLink><InternalLink Ref="p12130">(k)</InternalLink> (power to require assistance).</Text>

<Text>In proceedings for an offence under any of subsections <InternalLink Ref="p12300">(2)</InternalLink> to <InternalLink Ref="p12332">(5)</InternalLink>, it is a defence to show that the person had a reasonable excuse—</Text>
