eId="section-49-2"><num>(2)</num><content><p>Omit <ref eId="c00624" href="https://www.legislation.gov.uk/ukpga/2008/25/section/97">section 97</ref> (unregistered independent educational institutions: inspection).</p></content></subsection><subsection eId="section-49-3"><num>(3)</num><content><p><mod>After <ref eId="c00625" href="https://www.legislation.gov.uk/ukpga/2008/25/section/127">section 127</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><hcontainer name="crossheading" ukl:Name="Pblock"><heading>Powers of entry and investigation etc</heading><section eId="d25e114"><num>127A</num><heading>Reasonable cause required to exercise powers</heading><subsection eId="d25e118"><num>(1)</num><intro><p>The Chief Inspector may exercise the powers of entry and investigation conferred by <span><ref href="#d25e223">sections 127B</ref> to <ref href="#d25e616">127D</ref>
</span> if the Chief Inspector has reasonable cause to believe—</p></intro><level class="para1"><num>(a)</num><content><p>that a relevant offence is being or has been committed on the premises to be entered, or</p></content></level><level class="para1"><num>(b)</num><content><p>that evidence of the commission of a relevant offence may be found on or accessed from the premises to be entered.</p></content></level></subsection><subsection><num>(2)</num><intro><p>In this section and <span><ref href="#d25e223">sections 127B</ref> to <ref href="#d25e616">127D</ref>
</span> “<term refersTo="#term-relevant-offence">relevant offence</term>” means an offence under—</p></intro><level class="para1"><num>(a)</num><content><p>section 96 (conducting an unregistered independent educational institution),</p></content></level><level class="para1"><num>(b)</num><content><p>section 118 (failure to comply with relevant restriction imposed by Secretary of State),</p></content></level><level class="para1"><num>(c)</num><content><p><ref href="#">section 118C</ref> (providing education at institution when registration is suspended),</p></content></level><level class="para1"><num>(d)</num><content><p><ref href="#">section 118F</ref> (providing boarding accommodation in breach of stop boarding requirement),</p></content></level><level class="para1"><num>(e)</num><content><p>section 121 (failure to comply with relevant restriction imposed by justice of the peace),</p></content></level><level class="para1"><num>(f)</num><content><p>section 127 (failure to comply with relevant restriction imposed by Tribunal),</p></content></level><level class="para1"><num>(g)</num><content><p><ref href="#d25e991">section 127F</ref> (obstruction of or failure to comply with investigation), or</p></content></level><level class="para1"><num>(h)</num><content><p><ref href="#">paragraph 4</ref> of <ref href="#">Schedule A1</ref> (breach of prevention order imposed following section 96 offence).</p></content></level></subsection></section><section eId="d25e223"><num>127B</num><heading>Entry without warrant and powers of investigation</heading><subsection><num>(1)</num><content><p>The Chief Inspector may, without a warrant, enter any premises (see also <ref href="#d25e360">section 127C</ref> for entry to premises under warrant).</p></content></subsection><subsection><num>(2)</num><content><p>The power of entry must be exercised at a reasonable hour.</p></content></subsection><subsection><num>(3)</num><intro><p>Before entering any premises under this section, the Chief Inspector must—</p></intro><level class="para1"><num>(a)</num><content><p>produce evidence of their identity, and</p></content></level><level class="para1"><num>(b)</num><content><p>outline the purpose for which the power is exercised,</p></content></level><wrapUp><p>if asked to do so by a person on the premises.</p></wrapUp></subsection><subsection eId="d25e262"><num>(4)</num><intro><p>On entering any premises under this section, the Chief Inspector may—</p></intro><level class="para1"><num>(a)</num><content><p>inspect the premises;</p></content></level><level class="para1"><num>(b)</num><content><p>inspect and take copies of any document found on the premises;</p></content></level><level class="para1"><num>(c)</num><content><p>inspect any equipment found on the premises;</p></content></level><level class="para1"><num>(d)</num><content><p>take measurements of the premises or anything found on the premises;</p></content></level><level class="para1"><num>(e)</num><content><p>take photographs and make audio and video recordings on the premises.</p></content></level></subsection><subsection eId="d25e298"><num>(5)</num><content><p>When entering premises under this section, the Chief Inspector may be accompanied by any person and bring anything to facilitate the exercise of a power conferred by <ref href="#d25e262">subsection (4)</ref>.</p></content></subsection><subsection><num>(6)</num><intro><p>A person who accompanies the Chief Inspector under <ref href="#d25e298">subsection (5)</ref> may only do something intended to facilitate the exercise of a power conferred by <ref href="#d25e262">subsection (4)</ref> while—</p></intro><level class="para1"><num>(a)</num><content><p>in the company of the Chief Inspector, and</p></content></level><level class="para1"><num>(b)</num><content><p>under the Chief Inspector’s supervision.</p></content></level></subsection><subsection><num>(7)</num><content><p>In this section and <ref href="#d25e616">section 127D</ref> “<term refersTo="#term-document">document</term>” means anything in which information of any description is recorded.</p></content></subsection><subsection><num>(8)</num><content><p>This section does not confer power to inspect or take copies of anything of a kind specified in <ref eId="c00626" href="https://www.legislation.gov.uk/ukpga/1984/60/section/9">section 9</ref><ref eId="c00627" href="https://www.legislation.gov.uk/ukpga/1984/60/section/9">(2)</ref> of the <ref eId="c00628" href="https://www.legislation.gov.uk/ukpga/1984/60/contents">Police and Criminal Evidence Act 1984</ref> (legally privileged material etc).</p></content></subsection></section><section eId="d25e360"><num>127C</num><heading>Entry under warrant</heading><subsection><num>(1)</num><content><p>The Chief Inspector may enter premises if authorised by a warrant under this section to do so.</p></content></subsection><subsection><num>(2)</num><intro><p>A justice of the peace may issue a warrant under this section only if satisfied, on an application by the Chief Inspector, that the requirement in <ref href="#d25e114">section 127A</ref><ref href="#d25e118">(1)</ref> (reasonable cause for belief) is met, and that—</p></intro><level class="para1"><num>(a)</num><content><p>entry to the premises under <ref href="#d25e223">section 127B</ref> has been refused or is likely to be refused unless a warrant is produced,</p></content></level><level class="para1"><num>(b)</num><content><p>it is not practicable to communicate with any person entitled to grant entry,</p></content></level><level class="para1"><num>(c)</num><content><p>entering or attempting to enter the premises without a warrant may frustrate or seriously prejudice the purpose of entering, or</p></content></level><level class="para1"><num>(d)</num><content><p>to investigate a relevant offence effectively, the powers of investigation conferred by <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref> should be available to the Chief Inspector (in addition to those conferred by <ref href="#d25e223">section 127B</ref>).</p></content></level></subsection><subsection><num>(3)</num><intro><p>A warrant under this section may authorise the Chief Inspector to enter—</p></intro><level class="para1"><num>(a)</num><content><p>one or more premises specified in the application, or</p></content></level><level class="para1"><num>(b)</num><content><p>any premises occupied or controlled by a person specified in the application (an “all premises warrant”).</p></content></level></subsection><subsection><num>(4)</num><intro><p>If the application is for an all premises warrant, the justice of the peace must also be satisfied—</p></intro><level class="para1"><num>(a)</num><content><p>that there are reasonable grounds for believing that it is necessary to enter premises occupied or controlled by the person which are not specified in the application to investigate a relevant offence effectively, and</p></content></level><level class="para1"><num>(b)</num><content><p>that it is not reasonably practicable to specify in the application all the premises which the person occupies or controls and may need to be entered to investigate the offence effectively.</p></content></level></subsection><subsection><num>(5)</num><content><p>A warrant under this section authorises entry on one occasion only unless it specifies that it authorises multiple entries.</p></content></subsection><subsection><num>(6)</num><content><p>If the warrant authorises multiple entries, it must also specify whether the number of entries authorised is unlimited or limited to a specified maximum.</p></content></subsection><subsection eId="d25e464"><num>(7)</num><intro><p>A warrant under this section—</p></intro><level class="para1"><num>(a)</num><content><p>authorises the Chief Inspector to exercise the powers of investigation conferred by <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref><ref href="#d25e634">(a)</ref>, and</p></content></level><level class="para1"><num>(b)</num><content><p>may authorise the Chief Inspector to exercise the powers of investigation conferred by <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref><ref href="#d25e645">(b)</ref> to <ref href="#d25e718">(k)</ref> or particular powers.</p></content></level></subsection><subsection><num>(8)</num><content><p>The power of entry must be exercised at a reasonable hour unless the Chief Inspector considers that the purpose of entry and investigation may be frustrated by entry at a reasonable hour.</p></content></subsection><subsection><num>(9)</num><intro><p>Before entering premises under a warrant, the Chief Inspector must—</p></intro><level class="para1"><num>(a)</num><content><p>produce evidence of their identity, and</p></content></level><level class="para1"><num>(b)</num><content><p>outline the purpose for which the power is exercised,</p></content></level><wrapUp><p>if asked to do so by a person on the premises.</p></wrapUp></subsection><subsection><num>(10)</num><intro><p>On entering premises under a warrant, the Chief Inspector must—</p></intro><level class="para1"><num>(a)</num><content><p>provide a copy of the warrant to the occupier or to any other person appearing to be in charge of the premises, or</p></content></level><level class="para1"><num>(b)</num><content><p>if neither the occupier nor any such person is present, leave a copy of the warrant in a prominent place on the premises.</p></content></level></subsection><subsection eId="d25e543"><num>(11)</num><content><p>When entering premises under a warrant, the Chief Inspector may be accompanied by any person and bring anything to facilitate the exercise of a power conferred by <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref>.</p></content></subsection><subsection><num>(12)</num><intro><p>A person who accompanies the Chief Inspector under <ref href="#d25e543">subsection (11)</ref> may only do something intended to facilitate the exercise of a power conferred by <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref> while—</p></intro><level class="para1"><num>(a)</num><content><p>in the company of the Chief Inspector, and</p></content></level><level class="para1"><num>(b)</num><content><p>under the Chief Inspector’s supervision.</p></content></level></subsection><subsection><num>(13)</num><intro><p>The following provisions of the <ref eId="c00629" href="https://www.legislation.gov.uk/ukpga/1984/60/contents">Police and Criminal Evidence Act 1984</ref> apply to a warrant under this section as though references there to a constable were to the Chief Inspector—</p></intro><level class="para1"><num>(a)</num><content><p>subsections (2) to (8) of section 15 (search warrants: safeguards);</p></content></level><level class="para1"><num>(b)</num><content><p><ref eId="c00630" href="https://www.legislation.gov.uk/ukpga/1984/60/section/16">subsections (3)</ref>, <ref eId="c00631" href="https://www.legislation.gov.uk/ukpga/1984/60/section/16">(9)</ref>, and <ref eId="c00632" href="https://www.legislation.gov.uk/ukpga/1984/60/section/16/subsection/10">(10) to (12)</ref> of <ref eId="c00633" href="https://www.legislation.gov.uk/ukpga/1984/60/section/16">section 16</ref> (execution of warrants).</p></content></level></subsection></section><section eId="d25e616"><num>127D</num><heading>Powers of investigation following entry under warrant</heading><subsection eId="d25e620"><num>(1)</num><intro><p>On entering any premises under a warrant issued under <ref href="#d25e360">section 127C</ref> (and subject to any limitation imposed under <ref href="#d25e360">section 127C</ref><ref href="#d25e464">(7)</ref>) the Chief Inspector may—</p></intro><level class="para1" eId="d25e634"><num>(a)</num><content><p>do anything that may be done under <ref href="#d25e223">section 127B</ref><ref href="#d25e262">(4)</ref> (following an entry without warrant);</p></content></level><level class="para1" eId="d25e645"><num>(b)</num><content><p>search the premises;</p></content></level><level class="para1"><num>(c)</num><content><p>inspect any information capable of being viewed using equipment or a device on the premises;</p></content></level><level class="para1" eId="d25e657"><num>(d)</num><content><p>require any person on the premises to produce any document in the person’s possession or control;</p></content></level><level class="para1" eId="d25e663"><num>(e)</num><content><p>take copies of any document produced in response to a requirement under <ref href="#d25e657">paragraph (d)</ref>;</p></content></level><level class="para1" eId="d25e672"><num>(f)</num><content><p>require any person on the premises to produce any information which is stored in electronic form and is accessible from the premises in a form in which it can be taken away and in which it is visible and legible (or from which it can readily be produced in a visible and legible form);</p></content></level><level class="para1" eId="d25e678"><num>(g)</num><content><p>operate any equipment found on the premises for the purposes of producing such information in such a form;</p></content></level><level class="para1" eId="d25e684"><num>(h)</num><content><p>take copies of anything produced under <ref href="#d25e672">paragraph (f)</ref> or <ref href="#d25e678">(g)</ref>;</p></content></level><level class="para1" eId="d25e696"><num>(i)</num><content><p>seize any document or equipment found on the premises, or anything produced in response to a requirement under <ref href="#d25e657">paragraph (d)</ref> or <ref href="#d25e672">(f)</ref> or produced under <ref href="#d25e678">paragraph (g)</ref>;</p></content></level><level class="para1" eId="d25e711"><num>(j)</num><content><p>interview any person aged 18 or over on the premises where there is reasonable cause to believe that the person can provide information relating to a relevant offence, and require the person to provide any such information;</p></content></level><level class="para1" eId="d25e718"><num>(k)</num><content><p>require any person on the premises to provide the Chief Inspector with whatever facilities and assistance within the person’s control are necessary to enable the Chief Inspector to exercise the powers conferred by this section.</p></content></level></subsection><subsection><num>(2)</num><content><p>The Chief Inspector may only exercise a power conferred by <ref href="#d25e620">subsection (1)</ref><ref href="#d25e645">(b)</ref> to <ref href="#d25e718">(k)</ref> for the purpose for which the warrant under <ref href="#d25e360">section 127C</ref> was issued.</p></content></subsection><subsection eId="d25e741"><num>(3)</num><content><p>Anything seized under <ref href="#d25e620">subsection (1)</ref><ref href="#d25e663">(e)</ref>, <ref href="#d25e684">(h)</ref> or <ref href="#d25e696">(i)</ref> may be retained for so long as is necessary in all the circumstances.</p></content></subsection><subsection eId="d25e758"><num>(4)</num><intro><p>Where the Chief Inspector exercises the power conferred by <ref href="#d25e620">subsection (1)</ref><ref href="#d25e711">(j)</ref> to interview a person—</p></intro><level class="para1"><num>(a)</num><content><p>they may be interviewed either alone or in the presence of one or more other persons;</p></content></level><level class="para1" eId="d25e775"><num>(b)</num><content><p>no answer which the person gives during the interview is admissible in evidence against the person, or the person’s spouse or civil partner, in any criminal proceedings.</p></content></level></subsection><subsection eId="d25e781"><num>(5)</num><intro><p><ref href="#d25e758">Subsection (4)</ref><ref href="#d25e775">(b)</ref> does not apply in relation to proceedings for—</p></intro><level class="para1"><num>(a)</num><content><p>an offence under <ref href="#d25e991">section 127F</ref><ref href="#d25e1036">(4)</ref> (refusal to be interviewed or provide information during an interview),</p></content></level><level class="para1"><num>(b)</num><content><p>an offence under <a href="https://www.legislation.gov.uk/ukpga/Geo5/1-2/6/section/5">section 5</a> of the <a href="https://www.legislation.gov.uk/ukpga/Geo5/1-2/6/contents">Perjury Act 1911</a>, or</p></content></level><level class="para1" eId="d25e814"><num>(c)</num><content><p>another offence where, in giving evidence, the person makes a statement inconsistent with an answer given by them during the interview.</p></content></level></subsection><subsection><num>(6)</num><content><p>An answer may not be used against a person by virtue of <ref href="#d25e781">subsection (5)</ref><ref href="#d25e814">(c)</ref> unless evidence relating to it is adduced, or a question relating to it is asked, by or on behalf of the person in the proceedings.</p></content></subsection><subsection eId="d25e831"><num>(7)</num><intro><p>This section does not confer power to inspect, seize or take copies of anything of a kind specified in <ref eId="c00634" href="https://www.legislation.gov.uk/ukpga/1984/60/section/9">section 9</ref><ref eId="c00635" href="https://www.legislation.gov.uk/ukpga/1984/60/section/9">(2)</ref> of the <ref eId="c00636" href="https://www.legislation.gov.uk/ukpga/1984/60/contents">Police and Criminal Evidence Act 1984</ref> (legally privileged material etc), other than such of the following as is relevant to the investigation of a relevant offence—</p></intro><level class="para1"><num>(a)</num><content><p>material that is excluded material within the meaning of <ref eId="c00637" href="https://www.legislation.gov.uk/ukpga/1984/60/section/14">section 14</ref><ref eId="c00642" href="https://www.legislation.gov.uk/ukpga/1984/60/section/14">(2)</ref> of <ref eId="c00643" href="https://www.legislation.gov.uk/ukpga/1984/60/contents">that Act</ref>.</p></content></level></subsection></section><section><num>127E</num><heading>Power of constable to assist</heading><subsection><num>(1)</num><intro><p>The Chief Inspector may apply to a justice of the peace for a warrant authorising a constable to assist the Chief Inspector, using reasonable force if necessary, to—</p></intro><level class="para1"><num>(a)</num><content><p>enter premises mentioned in subsection <ref href="#d25e912">(2)</ref> under a warrant issued under <ref href="#d25e360">section 127C</ref>, or</p></content></level><level class="para1"><num>(b)</num><content><p>exercise a power conferred by <ref href="#d25e616">section 127D</ref> on premises mentioned in subsection <ref href="#d25e912">(2)</ref>.</p></content></level></subsection><subsection eId="d25e912"><num>(2)</num><intro><p>The premises are—</p></intro><level class="para1"><num>(a)</num><content><p>one or more premises specified in the application, or</p></content></level><level class="para1"><num>(b)</num><content><p>any premises occupied or controlled by a person specified in the application.</p></content></level></subsection><subsection><num>(3)</num><intro><p>The justice may issue a warrant only if satisfied that the requirement in <ref href="#d25e114">section 127A</ref><ref href="#d25e118">(1)</ref> (reasonable cause for belief) is met, and that—</p></intro><level class="para1"><num>(a)</num><content><p>the Chief Inspector has attempted to exercise a power conferred by <ref href="#d25e360">section 127C</ref> or <ref href="#d25e616">127D</ref> but has been prevented from doing so,</p></content></level><level class="para1"><num>(b)</num><content><p>the Chief Inspector reasonably expects to be prevented from exercising any such power if an attempt to do so is made, or</p></content></level><level class="para1"><num>(c)</num><content><p>the purpose of exercising any such power may be frustrated unless the Chief Inspector, on arriving at the premises, can exercise the power immediately.</p></content></level></subsection><subsection eId="d25e965"><num>(4)</num><content><p>A warrant under this section must be issued to and executed by a constable.</p></content></subsection><subsection><num>(5)</num><content><p><ref eId="c00644" href="https://www.legislation.gov.uk/ukpga/1984/60/section/15">Section 15</ref> of the <ref eId="c00645" href="https://www.legislation.gov.uk/ukpga/1984/60/contents">Police and Criminal Evidence Act 1984</ref> (search warrants: safeguards) applies in relation to a warrant under this section as though references in subsections <ref href="#d25e912">(2)</ref> and <ref href="#d25e965">(4)</ref> to a constable were to the Chief Inspector.</p></content></subsection></section><section eId="d25e991"><num>127F</num><heading>Offences: obstruction etc</heading><subsection><num>(1)</num><content><p>A person commits an offence if they intentionally obstruct another person in the exercise of any power conferred by section <ref href="#d25e223">127B</ref>, <ref href="#d25e360">127C</ref> or <ref href="#d25e616">127D</ref>.</p></content></subsection><subsection eId="d25e1010"><num>(2)</num><content><p>A person commits an offence if they intentionally fail to produce any document required under <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref><ref href="#d25e657">(d)</ref>.</p></content></subsection><subsection eId="d25e1023"><num>(3)</num><content><p>A person commits an offence if they intentionally fail to produce any information required under <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref><ref href="#d25e672">(f)</ref> in the form required under that paragraph.</p></content></subsection><subsection eId="d25e1036"><num>(4)</num><intro><p>A person commits an offence if they—</p></intro><level class="para1" eId="d25e1042"><num>(a)</num><content><p>refuse to be interviewed under <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref><ref href="#d25e711">(j)</ref>, or</p></content></level><level class="para1" eId="d25e1055"><num>(b)</num><content><p>intentionally fail to provide any information required during the course of an interview under that paragraph.</p></content></level></subsection><subsection eId="d25e1061"><num>(5)</num><content><p>A person commits an offence if they intentionally fail to comply with a requirement reasonably imposed under <ref href="#d25e616">section 127D</ref><ref href="#d25e620">(1)</ref><ref href="#d25e718">(k)</ref> (power to require assistance).</p></content></subsection><subsection eId="d25e1074"><num>(6)</num><intro><p>In proceedings for an offence under any of subsections <ref href="#d25e1010">(2)</ref> to <ref href="#d25e1061">(5)</ref>, it is a defence to show that the person had a reasonable excuse—</p></intro><level class="para1"><num>(a)</num><content><p>in the case of an offence under <ref href="#d25e1010">subsection (2)</ref>, for failing to produce the document;</p></content></level><level class="para1"><num>(b)</num><content><p>in the case of an offence under <ref href="#d25e1023">subsection (3)</ref>, for failing to produce the information in the form required;</p></content></level><level class="para1"><num>(c)</num><content><p>in the case of an offence under <ref href="#d25e1036">subsection (4)</ref><ref href="#d25e1042">(a)</ref>, for refusing to be interviewed;</p></content></level><level class="para1"><num>(d)</num><content><p>in the case of an offence under <ref href="#d25e1036">subsection (4)</ref><ref href="#d25e1055">(b)</ref>, for failing to provide the information;</p></content></level><level class="para1"><num>(e)</num><content><p>in the case of an offence under <ref href="#d25e1061">subsection (5)</ref>, for failing to comply with the requirement.</p></content></level></subsection><subsection><num>(7)</num><intro><p>A person is taken to have shown a fact mentioned in <ref href="#d25e1074">subsection (6)</ref> if—</p></intro><level class="para1"><num>(a)</num><content><p>sufficient evidence is adduced to raise an issue with respect to it, and</p></content></level><level class="para1"><num>(b)</num><content><p>the contrary is not proved beyond reasonable doubt.</p></content></level></subsection><subsection><num>(8)</num><content><p>A person who commits an offence
