eId="section-46-2"><num>(2)</num><intro><p>In <ref eId="c00568" href="https://www.legislation.gov.uk/ukpga/2008/25/section/98">section 98</ref> (applications for registration)—</p></intro><level class="para1" eId="section-46-2-a"><num>(a)</num><intro><p>in <ref eId="c00569" href="https://www.legislation.gov.uk/ukpga/2008/25/section/98">subsection (3)</ref>—</p></intro><level class="para2" eId="section-46-2-a-i"><num>(i)</num><content><p><mod>in <ref eId="c00570" href="https://www.legislation.gov.uk/ukpga/2008/25/section/98">paragraph (e)</ref>, after “students” insert <quotedText>“, the purposes of subsection (3)<ref href="#d25e129">(ea)</ref>—</p></intro><level class="para1"><num>(a)</num><intro><p>“<term refersTo="#term-building">building</term>” means any—</p></intro><level class="para2"><num>(i)</num><content><p>building,</p></content></level><level class="para2"><num>(ii)</num><content><p>part of a building,</p></content></level><level class="para2"><num>(iii)</num><content><p>permanent outdoor structure, or</p></content></level><level class="para2"><num>(iv)</num><content><p>part of a permanent outdoor structure,</p></content></level><wrapUp><p>which is wholly or mainly enclosed;</p></wrapUp></level><level class="para1"><num>(b)</num><intro><p>a building is made available “for student use” by an institution if students at the institution are routinely present in the building—</p></intro><level class="para2"><num>(i)</num><content><p>to be provided with meals or accommodation by the institution, or</p></content></level><level class="para2"><num>(ii)</num><content><p>to be provided with education by the institution and, while the education is being provided, the building is controlled by the institution.</p></content></level></level></subsection><subsection><num>(3B)</num><content><p>Regulations may make provision about what constitutes a type of special educational need for the purposes of subsection (3)(g) or section 101<ref href="#d25e267">(2)</ref><ref href="#d25e327">(i)</ref>.</p></content></subsection></quotedStructure></mod></p></content></level></subsection><subsection eId="section-46-3"><num>(3)</num><content><p><mod>In <ref eId="c00573" href="https://www.legislation.gov.uk/ukpga/2008/25/section/99">section 99</ref> (determination of applications for registration), after <ref eId="c00574" href="https://www.legislation.gov.uk/ukpga/2008/25/section/99">subsection (5)</ref> insert— <quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" (buildings used by students), subsection (5)(c) only requires the Secretary of State to include in the register the address of a building if it is different from the registered address of the institution.</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-46-4"><num>(4)</num><content><p>In the italic heading before <ref eId="c00575" href="https://www.legislation.gov.uk/ukpga/2008/25/section/101">section 101</ref> (material change), omit “to registered details”.</p></content></subsection><subsection eId="section-46-5"><num>(5)</num><content><p><mod>In <ref eId="c00576" href="https://www.legislation.gov.uk/ukpga/2008/25/section/101">section 101</ref> (definition of “material change”), for <ref eId="c00577" href="https://www.legislation.gov.uk/ukpga/2008/25/section/101">subsections (2)</ref> and <ref eId="c00578" href="https://www.legislation.gov.uk/ukpga/2008/25/section/101">(3)</ref> substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d25e267"><num>(2)</num><intro><p>“<term refersTo="#term-a-material-change">A material change</term>” means any of the following—</p></intro><level class="para1"><num>(a)</num><content><p>a change of proprietor;</p></content></level><level class="para1" eId="d25e282"><num>(b)</num><content><p>a change of registered address;</p></content></level><level class="para1"><num>(c)</num><content><p>a change to the age range of students;</p></content></level><level class="para1"><num>(d)</num><content><p>a change to the maximum number of students;</p></content></level><level class="para1"><num>(e)</num><content><p>a change to whether the institution is for male or female students or both;</p></content></level><level class="para1" eId="d25e306"><num>(f)</num><content><p>a change to whether the institution provides accommodation for students;</p></content></level><level class="para1" eId="d25e312"><num>(g)</num><content><p>a change of the buildings made available for student use by the institution (within the meaning given by section 98<ref href="#d25e147">(3A)</ref>);</p></content></level><level class="para1"><num>(h)</num><content><p>a change to whether the institution is a special institution;</p></content></level><level class="para1" eId="d25e327"><num>(i)</num><content><p>in the case of a special institution, a change to the type or types of special educational needs for which the institution is specially organised to make special educational provision.</p></content></level></subsection><subsection><num>(2A)</num><content><p>For the purposes of <ref href="#d25e267">subsection (2)</ref><ref href="#d25e306">(f)</ref> an institution providing accommodation includes providing it under arrangements with other persons (other than in connection with a residential trip away from the institution).</p></content></subsection><subsection eId="d25e344"><num>(2B)</num><intro><p>Subsection <ref href="#d25e267">(2)</ref><ref href="#d25e312">(g)</ref> does not include a change where—</p></intro><level class="para1"><num>(a)</num><content><p>the change is a building ceasing to be made available for student use,</p></content></level><level class="para1"><num>(b)</num><content><p>the change is an excluded building being made available for student use, or</p></content></level><level class="para1" eId="d25e367"><num>(c)</num><content><p>the change is reasonably expected by the proprietor to persist for a period of less than six months beginning with the day on which the change is made.</p></content></level></subsection><subsection><num>(2C)</num><intro><p>A building is an “excluded building” if—</p></intro><level class="para1"><num>(a)</num><content><p>it is at the registered address of an independent educational institution, or</p></content></level><level class="para1"><num>(b)</num><intro><p>it is at a further address included in the register—</p></intro><level class="para2"><num>(i)</num><content><p>in accordance with section 99(5)(c), or</p></content></level><level class="para2"><num>(ii)</num><content><p>following approval under this Chapter of a material change falling within <ref href="#d25e267">subsection (2)</ref><ref href="#d25e312">(g)</ref>.</p></content></level></level></subsection><subsection><num>(2D)</num><content><p>A change within <ref href="#d25e344">subsection (2B)</ref><ref href="#d25e367">(c)</ref> becomes a material change if, at the beginning of the first day after the end of the six month period mentioned in that provision, it persists.</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-46-6"><num>(6)</num><content><p><mod>In <ref eId="c00579" href="https://www.legislation.gov.uk/ukpga/2008/25/section/102">section 102</ref> (requirement to apply for approval for material change), after subsection (2) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(3)</num><intro><p>Regulations may specify—</p></intro><level class="para1"><num>(a)</num><content><p>the information that must be contained in an application for approval under this section, and</p></content></level><level class="para1"><num>(b)</num><content><p>the manner in which an application must be made.</p></content></level></subsection></quotedStructure></mod></p></content></subsection><subsection eId="section-46-7"><num>(7)</num><content><p><mod>For <ref eId="c00580" href="https://www.legislation.gov.uk/ukpga/2008/25/section/103">section 103</ref> (inspections) substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>103</num><heading>Inspections relating to applications for approval</heading><subsection><num>(1)</num><intro><p>Where an application for approval of a material change is made under section 102 or an appeal is brought under section 125(1)(b) against a decision not to approve a material change, the Secretary of State may direct the Chief Inspector to—</p></intro><level class="para1"><num>(a)</num><content><p>inspect the institution, and</p></content></level><level class="para1"><num>(b)</num><content><p>make a report to the Secretary of State on all or particular matters that the Secretary of State must consider in determining the application (see section 104<ref href="#d25e531">(1A)</ref> and <ref href="#d25e549">(1B)</ref>).</p></content></level></subsection><subsection><num>(2)</num><intro><p>Where such an application is made or such an appeal is brought, the Secretary of State may arrange for an independent inspectorate, which has been approved under section 106 in relation to the institution, to—</p></intro><level class="para1"><num>(a)</num><content><p>inspect the institution, and</p></content></level><level class="para1"><num>(b)</num><content><p>make a report to the Secretary of State on all or particular matters that the Secretary of State must consider in determining the application.</p></content></level></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-46-8"><num>(8)</num><intro><p>In <ref eId="c00581" href="https://www.legislation.gov.uk/ukpga/2008/25/section/104">section 104</ref> (determination of applications for approval)—</p></intro><level class="para1" eId="section-46-8-a"><num>(a)</num><content><p><mod>for <ref eId="c00582" href="https://www.legislation.gov.uk/ukpga/2008/25/section/104">subsection (1)</ref> substitute—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(1)</num><content><p>This section applies where the proprietor of a registered independent educational institution makes an application under section 102 for approval of a material change.</p></content></subsection><subsection eId="d25e531"><num>(1A)</num><intro><p>The Secretary of State must approve the change if—</p></intro><level class="para1"><num>(a)</num><content><p>the Secretary of State is satisfied that the independent educational institution standards are being met in relation to the institution at the time when the application is being decided, and</p></content></level><level class="para1"><num>(b)</num><content><p>the Secretary of State is satisfied that the standards are likely to continue to be met if the change is made.</p></content></level></subsection><subsection eId="d25e549"><num>(1B)</num><intro><p>If, at the time the Secretary of State decides the application, the Secretary of State is satisfied that the independent educational institution standards are not being met in relation to the institution, the Secretary of State—</p></intro><level class="para1"><num>(a)</num><content><p>must approve the change if satisfied that the standards are likely to be met immediately if the change is made;</p></content></level><level class="para1"><num>(b)</num><intro><p>may approve the change if satisfied—</p></intro><level class="para2"><num>(i)</num><content><p>that the standards are likely to be met within a reasonable time of the change being made, and</p></content></level><level class="para2"><num>(ii)</num><content><p>that, during the period before the standards are met, the change is likely to be beneficial to the education, welfare or safety of students who attend, or who might attend, the institution.</p></content></level></level></subsection></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="section-46-8-b"><num>(b)</num><intro><p>in <ref eId="c00583" href="https://www.legislation.gov.uk/ukpga/2008/25/section/104">subsection (2)</ref>—</p></intro><level class="para2" eId="section-46-8-b-i"><num>(i)</num><content><p><mod>in the words before <ref eId="c00584" href="https://www.legislation.gov.uk/ukpga/2008/25/section/104">paragraph (a)</ref>, for “subsection (1)” substitute <quotedText>“this section”</quotedText>;</mod></p></content></level><level class="para2" eId="section-46-8-b-ii"><num>(ii)</num><content><p><mod>in <ref eId="c00585" href="https://www.legislation.gov.uk/ukpga/2008/25/section/104">paragraph (a)</ref>, after “Chief Inspector” insert <quotedText>“or an independent
