<Title>Making a prevention order</Title>

<Text>Where a person (the “defendant”) is convicted of an offence under section 96 (conducting an unregistered independent educational institution), the prosecution may apply for a prevention order before the defendant is sentenced for the offence.</Text>
</P2para>

<Pnumber>2</Pnumber>
<P2para>
<Text>On an application under <InternalLink Ref="p11031">sub-paragraph (1)</InternalLink>, the court may make a prevention order if it thinks it is appropriate to do so for the purpose of protecting children from the risk of harm (within the meaning of <Citation URI="https://www.legislation.gov.uk/ukpga/1989/41/section/31" id="c00558" Class="UnitedKingdomPublicGeneralAct" Year="1989" Number="41" SectionRef="section-31">section 31</Citation><Citation URI="https://www.legislation.gov.uk/ukpga/1989/41/section/31" id="c00559" Class="UnitedKingdomPublicGeneralAct" Year="1989" Number="41" SectionRef="section-31">(9)</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1989/41/contents" id="c00560" Class="UnitedKingdomPublicGeneralAct" Year="1989" Number="41" SectionRef="contents">Children Act 1989</Citation>) arising from the defendant—</Text>

<Text>conducting an unregistered independent educational institution, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>otherwise providing children with education, childcare, instruction or supervision.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>A prevention order is an order which, for the purpose mentioned in <InternalLink Ref="p11035">sub-paragraph (2)</InternalLink>—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>requires the defendant to do anything specified in the order, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>prohibits the defendant from doing anything specified in the order.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>4</Pnumber>
<P2para>
<Text>The court may make a prevention order in respect of the defendant only if it is made in addition to—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>a sentence imposed in respect of the offence under section 96, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>an order discharging the offender conditionally.</Text>

<Text>If, following an application by the prosecution for a prevention order, the court decides not to make such an order, it must state in open court its reasons for that decision.</Text>

<Title>Duration of prevention order</Title>
<P1>

<Text>A prevention order takes effect on the day on which it is made.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>A prevention order must specify the period for which it has effect, which must be a fixed period of at least six months and not more than three years.</Text>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>Where a court makes a prevention order in respect of a defendant who is already subject to such an order, the earlier order ceases to have effect.</Text>
</P2para>
</P2>

<Title>Application for variation or discharge of prevention order</Title>
<P1>
<Pnumber>3</Pnumber>
<P1para>

<Pnumber>1</Pnumber>
<P2para>
<Text>The defendant may apply to the appropriate court for an order varying or discharging a prevention order.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>On an application under this paragraph, the court may by order vary or discharge the prevention order.</Text>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>A defendant may not make an application under this paragraph—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>before the end of the period of three months beginning with the day on which the prevention order was made, or</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>before the end of the period of three months beginning with the day on which any previous application under this paragraph was refused.</Text>
</P3para>
</P3>

</P2>

<Text>“<Term>The appropriate court</Term>” means—</Text>
<P3>
<Pnumber>a</Pnumber>

<Text>in any case, the court that made the order, or</Text>

<Text>in a case where the defendant is an individual, a magistrates’ court for the area in which the defendant lives.</Text>

<Title>Offence of breaching prevention order</Title>

<Text>A person who breaches a prevention order is guilty of an offence.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>A person guilty of an offence under this paragraph is liable on summary conviction to imprisonment for a term not exceeding the maximum term for summary offences or to a fine (or to both).</Text>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>“<Term>The maximum term for summary offences</Term>” means—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>if the offence is committed before the time when <Citation URI="https://www.legislation.gov.uk/ukpga/2003/44/section/281" id="c00561" Class="UnitedKingdomPublicGeneralAct" Year="2003" Number="44" SectionRef="section-281">section 281</Citation><Citation URI="https://www.legislation.gov.uk/ukpga/2003/44/section/281" id="c00562" Class="UnitedKingdomPublicGeneralAct" Year="2003" Number="44" SectionRef="section-281">(5)</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/2003/44/contents" id="c00563" Class="UnitedKingdomPublicGeneralAct" Year="2003" Number="44" SectionRef="contents">Criminal Justice Act 2003</Citation> (alteration of penalties for certain summary offences: England and Wales) comes into force, six months;</Text>

<Text>if the offence is committed after that time, 51 weeks.</Text>
