2008</ref> (unregistered independent educational institutions: offence), after subsection (4) insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" court to make a prevention order where a person is convicted of an offence under this section.</p></content></subsection></quotedStructure></mod></p></content></subsection><subsection 96</p></authorialNote></num><heading>Unregistered independent educational institutions: prevention orders</heading><hcontainer name="crossheading" class="schGroup7"><heading>Making a prevention order</heading><paragraph class="schProv1"><num>1</num><subparagraph eId="d25e130"><num>(1)</num><content><p>Where a person (the “defendant”) is convicted of an offence under section 96 (conducting an unregistered independent educational institution), the prosecution may apply for a prevention order before the defendant is sentenced for the offence.</p></content></subparagraph><subparagraph eId="d25e136"><num>(2)</num><intro><p>On an application under <ref href="#d25e130">sub-paragraph (1)</ref>, the court may make a prevention order if it thinks it is appropriate to do so for the purpose of protecting children from the risk of harm (within the meaning of <ref eId="c00558" href="https://www.legislation.gov.uk/ukpga/1989/41/section/31">section 31</ref><ref eId="c00559" href="https://www.legislation.gov.uk/ukpga/1989/41/section/31">(9)</ref> of the <ref eId="c00560" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref>) arising from the defendant—</p></intro><level class="para1"><num>(a)</num><content><p>conducting an unregistered independent educational institution, or</p></content></level><level class="para1"><num>(b)</num><content><p>otherwise providing children with education, childcare, instruction or supervision.</p></content></level></subparagraph><subparagraph><num>(3)</num><intro><p>A prevention order is an order which, for the purpose mentioned in <ref href="#d25e136">sub-paragraph (2)</ref>—</p></intro><level class="para1"><num>(a)</num><content><p>requires the defendant to do anything specified in the order, or</p></content></level><level class="para1"><num>(b)</num><content><p>prohibits the defendant from doing anything specified in the order.</p></content></level></subparagraph><subparagraph><num>(4)</num><intro><p>The court may make a prevention order in respect of the defendant only if it is made in addition to—</p></intro><level class="para1"><num>(a)</num><content><p>a sentence imposed in respect of the offence under section 96, or</p></content></level><level class="para1"><num>(b)</num><content><p>an order discharging the offender conditionally.</p></content></level></subparagraph><subparagraph><num>(5)</num><content><p>If, following an application by the prosecution for a prevention order, the court decides not to make such an order, it must state in open court its reasons for that decision.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Duration of prevention order</heading><paragraph class="schProv1"><num>2</num><subparagraph><num>(1)</num><content><p>A prevention order takes effect on the day on which it is made.</p></content></subparagraph><subparagraph><num>(2)</num><content><p>A prevention order must specify the period for which it has effect, which must be a fixed period of at least six months and not more than three years.</p></content></subparagraph><subparagraph><num>(3)</num><content><p>Where a court makes a prevention order in respect of a defendant who is already subject to such an order, the earlier order ceases to have effect.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Application for variation or discharge of prevention order</heading><paragraph class="schProv1"><num>3</num><subparagraph><num>(1)</num><content><p>The defendant may apply to the appropriate court for an order varying or discharging a prevention order.</p></content></subparagraph><subparagraph><num>(2)</num><content><p>On an application under this paragraph, the court may by order vary or discharge the prevention order.</p></content></subparagraph><subparagraph><num>(3)</num><intro><p>A defendant may not make an application under this paragraph—</p></intro><level class="para1"><num>(a)</num><content><p>before the end of the period of three months beginning with the day on which the prevention order was made, or</p></content></level><level class="para1"><num>(b)</num><content><p>before the end of the period of three months beginning with the day on which any previous application under this paragraph was refused.</p></content></level></subparagraph><subparagraph><num>(4)</num><intro><p>“<term refersTo="#term-the-appropriate-court">The appropriate court</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>in any case, the court that made the order, or</p></content></level><level class="para1"><num>(b)</num><content><p>in a case where the defendant is an individual, a magistrates’ court for the area in which the defendant lives.</p></content></level></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Offence of breaching prevention order</heading><paragraph eId="d25e296" class="schProv1"><num>4</num><subparagraph><num>(1)</num><content><p>A person who breaches a prevention order is guilty of an offence.</p></content></subparagraph><subparagraph><num>(2)</num><content><p>A person guilty of an offence under this paragraph is liable on summary conviction to imprisonment for a term not exceeding the maximum term for summary offences or to a fine (or to both).</p></content></subparagraph><subparagraph><num>(3)</num><intro><p>“<term refersTo="#term-the-maximum-term-for-summary-offences">The maximum term for summary offences</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>if the offence is committed before the time when <ref eId="c00561" href="https://www.legislation.gov.uk/ukpga/2003/44/section/281">section 281</ref><ref eId="c00562" href="https://www.legislation.gov.uk/ukpga/2003/44/section/281">(5)</ref> of the <ref eId="c00563" href="https://www.legislation.gov.uk/ukpga/2003/44/contents">Criminal Justice Act 2003</ref> (alteration of penalties for certain summary offences: England and Wales) comes into force, six months;</p></content></level><level class="para1"><num>(b)</num><content><p>if the offence is committed after that time, 51 weeks.</p></content></level></subparagraph><subparagraph><num>(4)</num><content><p>Where a person is convicted of an offence under this paragraph, it is not open to the court by or before which the person is convicted to make, in respect of the offence, an order for conditional discharge.</p></content></subparagraph></paragraph></hcontainer><hcontainer name="crossheading" class="schGroup7"><heading>Transitional provision</heading><paragraph class="schProv1"><num>5</num><content><p>This Schedule does not apply in relation to a conviction before the coming into force of this Schedule of an offence under section 96.</p></content></paragraph></hcontainer></hcontainer></quotedStructure></mod></p></content></subsection><subsection
