<Text>Where an appeal is brought under section 125(1)(a) against a decision under section 99(2) (standards not likely to be met on registration), the Secretary of State may direct the Chief Inspector to—</Text>

<Text>inspect the institution which is the subject of the appeal, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>make a report to the Secretary of State on the extent to which any relevant standard is likely to be met in relation to the institution once it becomes a registered independent educational institution.</Text>

<Pnumber>1</Pnumber>

<Text>The Secretary of State may suspend the registration of an independent educational institution if—</Text>
<P3 id="p10071">
<Pnumber>a</Pnumber>
<P3para>
<Text>the Secretary of State is satisfied that one or more of the independent educational institution standards are not being met in relation to the institution, and</Text>
</P3para>
</P3>
<P3 id="p10075">
<Pnumber>b</Pnumber>
<P3para>
<Text>the Secretary of State has reasonable cause to believe that, as a result, one or more students at the institution will or may be exposed to the risk of harm.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>In determining the matters in subsection <InternalLink Ref="p10068">(1)</InternalLink><InternalLink Ref="p10071">(a)</InternalLink> and <InternalLink Ref="p10075">(b)</InternalLink>, the Secretary of State must (in particular) take account of any information provided by the Chief Inspector or an independent inspectorate that is relevant.</Text>
</P2para>
</P2>
<P2 id="p10088">
<Pnumber>3</Pnumber>
<P2para>
<Text>Before suspending the registration of an institution, the Secretary of State must give the proprietor of the institution a warning notice—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>stating that the Secretary of State is proposing to suspend the registration of the institution and explaining the effect of a suspension,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>specifying the dates on which the Secretary of State proposes to start and end the suspension,</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>identifying the standard or standards that are not being met, which the Secretary of State believes will or may result in one or more students being exposed to the risk of harm,</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>setting out the grounds for that belief, and</Text>
</P3para>
</P3>
<P3>
<Pnumber>e</Pnumber>
<P3para>
<Text>specifying the period during which the proprietor may make representations about the proposed suspension (the “specified period”).</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>4</Pnumber>
<P2para>
<Text>The Secretary of State must have regard to any representations made by the proprietor during the specified period in deciding whether to suspend the institution’s registration.</Text>
</P2para>
</P2>

<Pnumber>5</Pnumber>
<P2para>
<Text>Where the Secretary of State decides not to suspend the institution’s registration, the Secretary of State must give the proprietor of the institution a notice informing the proprietor of the decision.</Text>

<Pnumber>6</Pnumber>
<P2para>
<Text>Where the Secretary of State decides to suspend the institution’s registration, the Secretary of State must give the proprietor of the institution a notice informing the proprietor of the decision and—</Text>

<Text>specifying the date on which the suspension starts,</Text>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>specifying the date on which the suspension ends, which must be no more than 12 weeks after the suspension starts, and</Text>

<Text>explaining the right of appeal conferred by section 125.</Text>

<Text>Subsections <InternalLink Ref="p10088">(3)</InternalLink> to <InternalLink Ref="p10120">(6)</InternalLink> do not apply where the Secretary of State considers that, in order to protect one or more students at the institution from the risk of harm, it is necessary to suspend an institution’s registration without first seeking representations.</Text>

<Pnumber>8</Pnumber>
<P2para>
<Text>In such a case, the Secretary of State must, as soon as reasonably practicable after deciding to suspend the institution’s registration, give the proprietor a notice—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>stating that the Secretary of State has decided to suspend the registration of the institution and explaining the effect of a suspension,</Text>

</P3>
<P3>
<Pnumber>b</Pnumber>

<Text>The suspension of an institution’s registration does not affect the continuation of the registration (but see <InternalLink Ref="p10314">section 118C</InternalLink>: offence of providing education at an institution when its registration is suspended).</Text>

<Pnumber>10</Pnumber>
<P2para>
<Text>Where an institution’s registration is suspended, the Secretary of State must include an indication to that effect on the register for the period of the suspension.</Text>

<Title>Period of suspension</Title>

<Text>A suspension under <InternalLink Ref="p10066">section 118A</InternalLink>—</Text>

<Text>takes effect on the date specified in the notice of suspension under <InternalLink Ref="p10066">section 118A</InternalLink><InternalLink Ref="p10120">(6)</InternalLink> or <InternalLink Ref="p10142">(8)</InternalLink>, and</Text>

<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>ends on the date specified in that notice, subject to subsections <InternalLink Ref="p10209">(2)</InternalLink> to <InternalLink Ref="p10220">(4)</InternalLink>.</Text>

<Text>The Secretary of State must lift a suspension of an institution’s registration if the condition mentioned in <InternalLink Ref="p10066">section 118A</InternalLink><InternalLink Ref="p10068">(1)</InternalLink><InternalLink Ref="p10075">(b)</InternalLink> is no longer met.</Text>

<P2para>
<Text>The Secretary of State may lift a suspension of an institution’s registration if the Secretary of State considers it appropriate to do so.</Text>
</P2para>
</P2>

<Pnumber>4</Pnumber>
<P2para>
<Text>The Secretary of State may extend a suspension of an institution’s registration for a period of not more than 12 weeks if the conditions mentioned in paragraphs <InternalLink Ref="p10071">(a)</InternalLink> and <InternalLink Ref="p10075">(b)</InternalLink> of <InternalLink Ref="p10066">section 118A</InternalLink><InternalLink Ref="p10068">(1)</InternalLink> are still met.</Text>

<Text>Before extending a suspension of an institution’s registration, the Secretary of State must give the proprietor of the institution a warning notice—</Text>

<Text>In such a case, the Secretary of State must, as soon as reasonably practicable after deciding to extend the suspension, give the proprietor a notice—</Text>

<Title>Offence of conducting institution when its registration is suspended</Title>

<Text>The proprietor of an independent educational institution that provides education or supervised activity to one or more students while its registration is suspended is guilty of an offence.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>It is a defence for a person charged with an offence under <InternalLink Ref="p10316">subsection (1)</InternalLink> to prove that—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>they and the head teacher of the institution (if a different person) did not know and could not reasonably have been expected to know of the existence of the notice given under <InternalLink Ref="p10066">section 118A</InternalLink> or <InternalLink Ref="p10189">118B</InternalLink> that caused the suspension to have effect at the time of the alleged offence, or</Text>

<Pnumber>b</Pnumber>

<Text>the conduct prohibited by <InternalLink Ref="p10316">subsection (1)</InternalLink> ceased as soon as reasonably practicable after that notice was given.</Text>

<Text>A person guilty of an offence under <InternalLink Ref="p10316">subsection (1)</InternalLink> is liable on summary conviction to imprisonment for a term not exceeding the maximum term for summary offences or to a fine (or to both).</Text>

<Title>Suspension of registration: requirement to stop providing boarding accommodation</Title>

<Text>Where the Secretary of State suspends the registration of a boarding institution, the Secretary of State may impose on the proprietor of the institution a requirement to stop providing boarding accommodation to its students (a “stop boarding requirement”).</Text>

<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>A stop boarding requirement may relate to all boarders at the institution or boarders of a particular description.</Text>
</P2para>
</P2>
<P2>
<Pnumber>3</Pnumber>
<P2para>
<Text>Before imposing a stop boarding requirement on the proprietor of a boarding institution, the Secretary of State must give the proprietor notice in accordance with—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>subsections <InternalLink Ref="p10394">(4)</InternalLink> and <InternalLink Ref="p10452">(8)</InternalLink>,</Text>

</P3>

<Text>Where the Secretary of State decides not to impose a stop boarding requirement on the proprietor of the institution—</Text>

<Text>in a case where the Secretary of State also decides not to suspend the institution’s registration, the Secretary of State must give the proprietor a notice of the decision not to impose a stop boarding requirement at the same time as the Secretary of State gives the notice under <InternalLink Ref="p10066">section 118A</InternalLink><InternalLink Ref="p10116">(5)</InternalLink>;</Text>

<Title>Offence of providing boarding accommodation in breach of stop boarding requirement</Title>
<P1 id="p10763">
<Pnumber>118F</Pnumber>
<P1para>

<Pnumber>1</Pnumber>
<P2para>
<Text>The proprietor of a boarding institution that provides boarding accommodation to a student in breach of a stop boarding requirement is guilty of an offence.</Text>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>It is a defence for a person charged with an offence under <InternalLink Ref="p10765">subsection (1)</InternalLink> to prove that—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>they and the head teacher of the institution (if a different person) did not know and could not reasonably have been expected to know of the existence of the notice given under <InternalLink Ref="p10066">section 118A</InternalLink> or <InternalLink Ref="p10189">118B</InternalLink> that caused the stop boarding requirement to have effect at the time of the alleged offence, or</Text>

</P3>

<Pnumber>b</Pnumber>
<P3para>
<Text>the conduct prohibited by <InternalLink Ref="p10765">subsection (1)</InternalLink> ceased as soon as reasonably practicable after that notice was given.</Text>

<Pnumber>3</Pnumber>
<P2para>
<Text>A person guilty of an offence under <InternalLink Ref="p10765">subsection (1)</InternalLink> is liable on summary conviction to imprisonment for a term not exceeding the maximum term for summary offences or to a fine (or to both).</Text>
</P2para>

<Pnumber>4</Pnumber>
<P2para>
<Text>“<Term>The maximum term for summary offences</Term>” means—</Text>

<Pnumber>a</Pnumber>
<P3para>
<Text>if the offence is committed before the time when <Citation URI="https://www.legislation.gov.uk/ukpga/2003/44/section/281" id="c00542" Class="UnitedKingdomPublicGeneralAct" Year="2003" Number="44" SectionRef="section-281">section 281</Citation><Citation URI="https://www.legislation.gov.uk/ukpga/2003/44/section/281" id="c00543" Class="UnitedKingdomPublicGeneralAct" Year="2003" Number="44" SectionRef="section-281">(5)</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/2003/44/contents" id="c00544" Class="UnitedKingdomPublicGeneralAct" Year="2003" Number="44" SectionRef="contents">Criminal Justice Act 2003</Citation> (alteration of penalties for certain summary offences: England and Wales) comes into force, six months;</Text>

<Text>if the offence is committed after that time, 51 weeks.</Text>

<Text>If boarding accommodation is provided under an arrangement between a boarding institution and another person, it is irrelevant for the purposes of this section when that arrangement was made.</Text>

<Text>The Tribunal may determine that question for the purposes of the application or appeal, including by finding that a relevant person is, was or would be a fit and proper person to be involved in the running of an independent educational institution even if the Secretary of State is not of that opinion.</Text>
