href="https://www.legislation.gov.uk/ukpga/2008/25/contents">Education and Skills Act 2008</ref> is amended as follows.</p></content></subsection><subsection eId="section-44-2"><num>(2)</num><intro><p>In <ref eId="c00531" href="https://www.legislation.gov.uk/ukpga/2008/25/section/94">section 94</ref> (independent educational institution standards)—</p></intro><level class="para1" eId="section-44-2-a"><num>(a)</num><content><p><mod>after <ref eId="c00532" href="https://www.legislation.gov.uk/ukpga/2008/25/section/94">subsection (1)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection eId="d25e110"><num>(1A)</num><intro><p>A standard within subsection (1)(d) in relation to a proprietor may be prescribed by reference—</p></intro><level class="para1" eId="d25e116"><num>(a)</num><intro><p>in the case of a proprietor which is a body of persons—</p></intro><level class="para2" eId="d25e122"><num>(i)</num><content><p>to whether persons having general control and management of, or legal responsibility and accountability for, the proprietor are, in the opinion of the Secretary of State, fit and proper persons to be involved in the running of an independent educational institution;</p></content></level><level class="para2"><num>(ii)</num><content><p>to whether the Secretary of State is notified before a new person becomes involved in the general control and management of, or assumes legal responsibility and accountability for, the proprietor;</p></content></level></level><level class="para1" eId="d25e134"><num>(b)</num><content><p>in the case of a proprietor which is an individual, to whether that individual is, in the opinion of the Secretary of State, a fit and proper person to be involved in the running of an independent educational institution.</p></content></level></subsection></quotedStructure><inline name="appendText">;</inline></mod></p></content></level><level class="para1" eId="section-44-2-b"><num>(b)</num><content><p><mod>after <ref eId="c00533" href="https://www.legislation.gov.uk/ukpga/2008/25/section/94">subsection (3)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(3A)</num><content><p>A standard may be prescribed by reference to whether or not the proprietor of an independent educational institution has regard to guidance issued, or a document published, by the Secretary of State from time to time.</p></content></subsection></quotedStructure></mod></p></content></level></subsection><subsection eId="section-44-3"><num>(3)</num><content><p><mod>After <ref eId="c00534" href="https://www.legislation.gov.uk/ukpga/2008/25/section/99">section 99</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>99A</num><heading>Inspections on appeal against decision not to register</heading><subsection><num>(1)</num><intro><p>Where an appeal is brought under section 125(1)(a) against a decision under section 99(2) (standards not likely to be met on registration), the Secretary of State may direct the Chief Inspector to—</p></intro><level class="para1"><num>(a)</num><content><p>inspect the institution which is the subject of the appeal, and</p></content></level><level class="para1"><num>(b)</num><content><p>make a report to the Secretary of State on the extent to which any relevant standard is likely to be met in relation to the institution once it becomes a registered independent educational institution.</p></content></level></subsection><subsection><num>(2)</num><intro><p>In this section “<term refersTo="#term-any-relevant-standard">any relevant standard</term>” means any independent educational institution standard that is—</p></intro><level class="para1"><num>(a)</num><content><p>specified in the direction by the Secretary of State for the purposes of the inspection, or</p></content></level><level class="para1"><num>(b)</num><content><p>considered to be relevant by the Chief Inspector in the circumstances of the case.</p></content></level></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-44-4"><num>(4)</num><content><p><mod>After <ref eId="c00535" href="https://www.legislation.gov.uk/ukpga/2008/25/section/118">section 118</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section eId="d25e227"><num>118A</num><heading>Suspension of registration</heading><subsection eId="d25e231"><num>(1)</num><intro><p>The Secretary of State may suspend the registration of an independent educational institution if—</p></intro><level class="para1" eId="d25e237"><num>(a)</num><content><p>the Secretary of State is satisfied that one or more of the independent educational institution standards are not being met in relation to the institution, and</p></content></level><level class="para1" eId="d25e243"><num>(b)</num><content><p>the Secretary of State has reasonable cause to believe that, as a result, one or more students at the institution will or may be exposed to the risk of harm.</p></content></level></subsection><subsection><num>(2)</num><content><p>In determining the matters in subsection <ref href="#d25e231">(1)</ref><ref href="#d25e237">(a)</ref> and <ref href="#d25e243">(b)</ref>, the Secretary of State must (in particular) take account of any information provided by the Chief Inspector or an independent inspectorate that is relevant.</p></content></subsection><subsection eId="d25e263"><num>(3)</num><intro><p>Before suspending the registration of an institution, the Secretary of State must give the proprietor of the institution a warning notice—</p></intro><level class="para1"><num>(a)</num><content><p>stating that the Secretary of State is proposing to suspend the registration of the institution and explaining the effect of a suspension,</p></content></level><level class="para1"><num>(b)</num><content><p>specifying the dates on which the Secretary of State proposes to start and end the suspension,</p></content></level><level class="para1"><num>(c)</num><content><p>identifying the standard or standards that are not being met, which the Secretary of State believes will or may result in one or more students being exposed to the risk of harm,</p></content></level><level class="para1"><num>(d)</num><content><p>setting out the grounds for that belief, and</p></content></level><level class="para1"><num>(e)</num><content><p>specifying the period during which the proprietor may make representations about the proposed suspension (the “specified period”).</p></content></level></subsection><subsection><num>(4)</num><content><p>The Secretary of State must have regard to any representations made by the proprietor during the specified period in deciding whether to suspend the institution’s registration.</p></content></subsection><subsection eId="d25e305"><num>(5)</num><content><p>Where the Secretary of State decides not to suspend the institution’s registration, the Secretary of State must give the proprietor of the institution a notice informing the proprietor of the decision.</p></content></subsection><subsection eId="d25e311"><num>(6)</num><intro><p>Where the Secretary of State decides to suspend the institution’s registration, the Secretary of State must give the proprietor of the institution a notice informing the proprietor of the decision and—</p></intro><level class="para1"><num>(a)</num><content><p>specifying the date on which the suspension starts,</p></content></level><level class="para1"><num>(b)</num><content><p>specifying the date on which the suspension ends, which must be no more than 12 weeks after the suspension starts, and</p></content></level><level class="para1"><num>(c)</num><content><p>explaining the right of appeal conferred by section 125.</p></content></level></subsection><subsection eId="d25e335"><num>(7)</num><content><p>Subsections <ref href="#d25e263">(3)</ref> to <ref href="#d25e311">(6)</ref> do not apply where the Secretary of State considers that, in order to protect one or more students at the institution from the risk of harm, it is necessary to suspend an institution’s registration without first seeking representations.</p></content></subsection><subsection eId="d25e347"><num>(8)</num><intro><p>In such a case, the Secretary of State must, as soon as reasonably practicable after deciding to suspend the institution’s registration, give the proprietor a notice—</p></intro><level class="para1" eId="d25e353"><num>(a)</num><content><p>stating that the Secretary of State has decided to suspend the registration of the institution and explaining the effect of a suspension,</p></content></level><level class="para1"><num>(b)</num><content><p>identifying the standard or standards that are not being met, which the Secretary of State believes will or may result in one or more students being exposed to the risk of harm,</p></content></level><level class="para1"><num>(c)</num><content><p>setting out the grounds for that belief,</p></content></level><level class="para1"><num>(d)</num><content><p>specifying the date on which the suspension starts,</p></content></level><level class="para1"><num>(e)</num><content><p>specifying the date on which the suspension ends, which must be no more than 12 weeks after the suspension starts, and</p></content></level><level class="para1"><num>(f)</num><content><p>explaining the right of appeal conferred by section 125.</p></content></level></subsection><subsection><num>(9)</num><content><p>The suspension of an institution’s registration does not affect the continuation of the registration (but see <ref href="#d25e645">section 118C</ref>: offence of providing education at an institution when its registration is suspended).</p></content></subsection><subsection><num>(10)</num><content><p>Where an institution’s registration is suspended, the Secretary of State must include an indication to that effect on the register for the period of the suspension.</p></content></subsection><subsection><num>(11)</num><content><p>For the purposes of this section and <ref href="#d25e427">section 118B</ref> “<term refersTo="#term-harm">harm</term>” has the meaning given by <ref eId="c00536" href="https://www.legislation.gov.uk/ukpga/1989/41/section/31">section 31</ref><ref eId="c00537" href="https://www.legislation.gov.uk/ukpga/1989/41/section/31">(9)</ref> of the <ref eId="c00538" href="https://www.legislation.gov.uk/ukpga/1989/41/contents">Children Act 1989</ref>.</p></content></subsection></section><section eId="d25e427"><num>118B</num><heading>Period of suspension</heading><subsection><num>(1)</num><intro><p>A suspension under <ref href="#d25e227">section 118A</ref>—</p></intro><level class="para1"><num>(a)</num><content><p>takes effect on the date specified in the notice of suspension under <ref href="#d25e227">section 118A</ref><ref href="#d25e311">(6)</ref> or <ref href="#d25e347">(8)</ref>, and</p></content></level><level class="para1"><num>(b)</num><content><p>ends on the date specified in that notice, subject to subsections <ref href="#d25e466">(2)</ref> to <ref href="#d25e485">(4)</ref>.</p></content></level></subsection><subsection eId="d25e466"><num>(2)</num><content><p>The Secretary of State must lift a suspension of an institution’s registration if the condition mentioned in <ref href="#d25e227">section 118A</ref><ref href="#d25e231">(1)</ref><ref href="#d25e243">(b)</ref> is no longer met.</p></content></subsection><subsection eId="d25e479"><num>(3)</num><content><p>The Secretary of State may lift a suspension of an institution’s registration if the Secretary of State considers it appropriate to do so.</p></content></subsection><subsection eId="d25e485"><num>(4)</num><content><p>The Secretary of State may extend a suspension of an institution’s registration for a period of not more than 12 weeks if the conditions mentioned in paragraphs <ref href="#d25e237">(a)</ref> and <ref href="#d25e243">(b)</ref> of <ref href="#d25e227">section 118A</ref><ref href="#d25e231">(1)</ref> are still met.</p></content></subsection><subsection eId="d25e502"><num>(5)</num><intro><p>Before extending a suspension of an institution’s registration, the Secretary of State must give the proprietor of the institution a warning notice—</p></intro><level class="para1"><num>(a)</num><content><p>stating that the Secretary of State is proposing to extend the suspension,</p></content></level><level class="para1"><num>(b)</num><content><p>specifying the date on which the Secretary of State proposes to end the extension,</p></content></level><level class="para1"><num>(c)</num><content><p>identifying the standard or standards that are not being met, which the Secretary of State believes will or may result in one or more students being exposed to the risk of harm (which need not be the same standards mentioned in the notice for the previous period of suspension),</p></content></level><level class="para1"><num>(d)</num><content><p>setting out the grounds for that belief (which need not be the same grounds mentioned in the notice for the previous period of suspension), and</p></content></level><level class="para1"><num>(e)</num><content><p>specifying the period during which the proprietor may make representations about the proposed extension (the “specified period”).</p></content></level></subsection><subsection><num>(6)</num><content><p>The Secretary of State must have regard to any representations made by the proprietor during the specified period in deciding whether to extend the suspension.</p></content></subsection><subsection eId="d25e544"><num>(7)</num><content><p>Where the Secretary of State decides not to extend the suspension, the Secretary of State must give the proprietor of the institution a notice informing the proprietor of the decision.</p></content></subsection><subsection eId="d25e550"><num>(8)</num><intro><p>Where the Secretary of State decides to extend the suspension, the Secretary of State must give the proprietor a notice informing the proprietor of the decision and—</p></intro><level class="para1"><num>(a)</num><content><p>specifying the date on which the extension ends, and</p></content></level><level class="para1"><num>(b)</num><content><p>explaining the right of appeal conferred by section 125.</p></content></level></subsection><subsection eId="d25e568"><num>(9)</num><content><p>Subsections <ref href="#d25e305">(5)</ref> to <ref href="#d25e347">(8)</ref> do not apply where the Secretary of State considers that, in order to protect one or more students at the institution from the risk of harm, it is necessary to extend the suspension of an institution’s registration without first seeking representations.</p></content></subsection><subsection eId="d25e580"><num>(10)</num><intro><p>In such a case, the Secretary of State must, as soon as reasonably practicable after deciding to extend the suspension, give the proprietor a notice—</p></intro><level class="para1"><num>(a)</num><content><p>stating that the Secretary of State has decided to extend the suspension,</p></content></level><level class="para1"><num>(b)</num><content><p>identifying the standard or standards that are not being met, which the Secretary of State believes will or may result in one or more students being exposed to the risk of harm (which need not be the same standards mentioned in the notice for the previous period of suspension),</p></content></level><level class="para1"><num>(c)</num><content><p>setting out the grounds for that belief (which need not be the same grounds mentioned in the notice for the previous period of suspension),</p></content></level><level class="para1" eId="d25e604"><num>(d)</num><content><p>specifying the date on which the extension ends, which must be no more than 12 weeks after the extension starts, and</p></content></level><level class="para1"><num>(e)</num><content><p>explaining the right of appeal conferred by section 125.</p></content></level></subsection><subsection><num>(11)</num><content><p>Where the Secretary of State extends the suspension of an institution’s registration, the suspension lasts until the date specified in the notice under <ref href="#d25e347">subsection (8)</ref><ref href="#d25e353">(a)</ref> or <ref href="#d25e580">(10)</ref><ref href="#d25e604">(d)</ref>, unless it is lifted under <ref href="#d25e466">subsection (2)</ref> or <ref href="#d25e479">(3)</ref> or extended again under <ref href="#d25e485">subsection (4)</ref>.</p></content></subsection></section><section eId="d25e645"><num>118C</num><heading>Offence of conducting institution when its registration is suspended</heading><subsection eId="d25e649"><num>(1)</num><content><p>The proprietor of an independent educational institution that provides education or supervised activity to one or more students while its registration is suspended is guilty of an offence.</p></content></subsection><subsection><num>(2)</num><intro><p>It is a defence for a person charged with an offence under <ref href="#d25e649">subsection (1)</ref> to prove that—</p></intro><level class="para1"><num>(a)</num><content><p>they and the head teacher of the institution (if a different person) did not know and could not reasonably have been expected to know of the existence of the notice given under <ref href="#d25e227">section 118A</ref> or <ref href="#d25e427">118B</ref> that caused the suspension to have effect at the time of the alleged offence, or</p></content></level><level class="para1"><num>(b)</num><content><p>the conduct prohibited by <ref href="#d25e649">subsection (1)</ref> ceased as soon as reasonably practicable after that notice was given.</p></content></level></subsection><subsection><num>(3)</num><content><p>A person guilty of an offence under <ref href="#d25e649">subsection (1)</ref> is liable on summary conviction to imprisonment for a term not exceeding the maximum term for summary offences or to a fine (or to both).</p></content></subsection><subsection><num>(4)</num><intro><p>“<term refersTo="#term-the-maximum-term-for-summary-offences">The maximum term for summary offences</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>if the offence is committed before the time when <ref eId="c00539" href="https://www.legislation.gov.uk/ukpga/2003/44/section/281">section 281</ref><ref eId="c00540" href="https://www.legislation.gov.uk/ukpga/2003/44/section/281">(5)</ref> of the <ref eId="c00541" href="https://www.legislation.gov.uk/ukpga/2003/44/contents">Criminal Justice Act 2003</ref> (alteration of penalties for certain summary offences: England and Wales) comes into force, six months;</p></content></level><level class="para1"><num>(b)</num><content><p>if the offence is committed after that time, 51 weeks.</p></content></level></subsection><subsection><num>(5)</num><content><p>In <ref href="#d25e649">subsection (1)</ref>, the reference to providing education or supervised activity does not include providing boarding accommodation or activities necessary to ensure the welfare of boarders (see <ref href="#d25e738">section 118D</ref> for provision about stopping boarding).</p></content></subsection></section><section eId="d25e738"><num>118D</num><heading>Suspension of registration: requirement to stop providing boarding accommodation</heading><subsection eId="d25e742"><num>(1)</num><content><p>Where the Secretary of State suspends the registration of a boarding institution, the Secretary of State may impose on the proprietor of the institution a requirement to stop providing boarding accommodation to its students (a “stop boarding requirement”).</p></content></subsection><subsection><num>(2)</num><content><p>A stop boarding requirement may relate to all boarders at the institution or boarders of a particular description.</p></content></subsection><subsection><num>(3)</num><intro><p>Before imposing a stop boarding requirement on the proprietor of a boarding institution, the Secretary of State must give the proprietor notice in accordance with—</p></intro><level class="para1"><num>(a)</num><content><p>subsections <ref href="#d25e789">(4)</ref> and <ref href="#d25e887">(8)</ref>,</p></content></level><level class="para1"><num>(b)</num><content><p><ref href="#d25e922">subsection (9)</ref>, or</p></content></level><level class="para1"><num>(c)</num><content><p>in the case of a new stop boarding requirement imposed under <ref href="#d25e1014">section 118E</ref>, that section.</p></content></level></subsection><subsection eId="d25e789"><num>(4)</num><intro><p>Where the Secretary of State gives a warning notice under <ref href="#d25e227">section 118A</ref><ref href="#d25e263">(3)</ref> (notice of proposed suspension of registration) to the proprietor of a boarding institution, the notice must also—</p></intro><level class="para1"><num>(a)</num><content><p>state whether the Secretary of State is proposing to impose a stop boarding requirement, and</p></content></level><level class="para1"><num>(b)</num><intro><p>if the Secretary of State is proposing to do so—</p></intro><level class="para2"><num>(i)</num><content><p>explain the effect of a stop boarding requirement,</p></content></level><level class="para2"><num>(ii)</num><content><p>specify whether the proposed requirement would relate to all boarders at the institution or, if not, the description of boarders to whom it would relate,</p></content></level><level class="para2"><num>(iii)</num><content><p>specify the dates on which the Secretary of State proposes to start and end the requirement, and</p></content></level><level class="para2"><num>(iv)</num><content><p>explain that the proprietor may make representations about the proposed requirement during the period specified in the notice for representations about the proposed suspension (the “specified period”).</p></content></level></level></subsection><subsection><num>(5)</num><content><p>The Secretary of State must have regard to any representations made by the proprietor during the specified period in deciding whether to impose a stop boarding requirement.</p></content></subsection><subsection><num>(6)</num><content><p>Subsections <ref href="#d25e859">(7)</ref> and <ref href="#d25e887">(8)</ref> apply where the Secretary of State has given the proprietor of a boarding institution a warning notice under <ref href="#d25e227">section 118A</ref><ref href="#d25e263">(3)</ref> which states that the Secretary of State is proposing to impose a stop boarding requirement.</p></content></subsection><subsection eId="d25e859"><num>(7)</num><intro><p>Where the Secretary of State decides not to impose a stop boarding requirement on the proprietor of the institution—</p></intro><level class="para1"><num>(a)</num><content><p>in a case where the Secretary of State also decides not to suspend the institution’s registration, the Secretary of State must give the proprietor a notice of the decision not to impose a stop boarding requirement at the same time as the Secretary of State gives the notice under <ref href="#d25e227">section 118A</ref><ref href="#d25e305">(5)</ref>;</p></content></level><level class="para1"><num>(b)</num><content><p>in a case where the Secretary of State decides to suspend the institution’s registration, the notice under <ref href="#d25e227">section 118A</ref><ref href="#d25e311">(6)</ref> (notice of decision to suspend registration following warning notice) must state that the Secretary of State has decided not to impose a stop boarding requirement.</p></content></level></subsection><subsection eId="d25e887"><num>(8)</num><intro><p>Where the Secretary of State decides to impose a stop boarding requirement on the proprietor of the institution, the notice under <ref href="#d25e227">section 118A</ref><ref href="#d25e311">(6)</ref> (notice of decision to suspend registration following warning notice) given to the proprietor must also inform the proprietor of that decision and—</p></intro><level class="para1"><num>(a)</num><content><p>specify whether the requirement relates to all boarders at the institution or, if not, the description of boarders to whom it relates,</p></content></level><level class="para1"><num>(b)</num><content><p>specify the date on which the requirement starts, which may be on the same date as the suspension starts or on a later date,</p></content></level><level class="para1"><num>(c)</num><content><p>specify the date on which the requirement ends, which may be on the same date as the suspension ends or on an earlier date, and</p></content></level><level class="para1"><num>(d)</num><content><p>explain the right of appeal conferred by section 125.</p></content></level></subsection><subsection eId="d25e922"><num>(9)</num><intro><p>Where the Secretary of State decides to impose a stop boarding requirement on the proprietor of a boarding institution in a case where the Secretary of State has not given the proprietor a warning notice under <ref href="#d25e227">section 118A</ref><ref href="#d25e263">(3)</ref> (see <ref href="#d25e227">section 118A</ref><ref href="#d25e335">(7)</ref>), the notice under <ref href="#d25e227">section 118A</ref><ref href="#d25e347">(8)</ref> (notice of decision to suspend registration in urgent cases) given to the proprietor must also—</p></intro><level class="para1"><num>(a)</num><content><p>state that the Secretary of State has decided to impose a stop boarding requirement and explain the effect of a stop boarding requirement,</p></content></level><level class="para1"><num>(b)</num><content><p>specify whether the requirement relates to all boarders at the institution or, if not, the description of boarders to whom it relates,</p></content></level><level class="para1"><num>(c)</num><content><p>specify the date on which the requirement starts, which may be on the same date as the suspension starts or on a later date,</p></content></level><level class="para1"><num>(d)</num><content><p>specify the date on which the requirement ends, which may be on the same date as the suspension ends or on an earlier date, and</p></content></level><level class="para1"><num>(e)</num><content><p>explain the right of appeal conferred by section 125.</p></content></level></subsection><subsection><num>(10)</num><content><p>Where a stop boarding requirement is imposed in relation to a boarding institution, the Secretary of State must include an indication to that effect on the register for the period of the requirement.</p></content></subsection><subsection><num>(11)</num><intro><p>In this section and sections <ref href="#d25e1014">118E</ref> and <ref href="#d25e1428">118F</ref>—</p></intro><hcontainer name="definition"><content><p>“<term refersTo="#term-boarding-institution">boarding institution</term>” means an independent educational institution that provides boarding accommodation for some or all of its students;</p></content></hcontainer><hcontainer name="definition"><content><p>“<term refersTo="#term-stop-boarding-requirement">stop boarding requirement</term>” has the meaning given in <ref href="#d25e742">subsection (1)</ref>;</p></content></hcontainer><wrapUp><p>and references to an institution providing boarding accommodation to students include an institution arranging for boarding accommodation to be provided to its students by another person.</p></wrapUp></subsection></section><section eId="d25e1014"><num>118E</num><heading>Period of stop boarding requirement</heading><subsection><num>(1)</num><intro><p>A stop boarding requirement—</p></intro><level class="para1"><num>(a)</num><intro><p>takes effect—</p></intro><level class="para2"><num>(i)</num><content><p>on the date specified in the notice of suspension under <ref href="#d25e227">section 118A</ref><ref href="#d25e311">(6)</ref> or <ref href="#d25e347">(8)</ref> (see <ref href="#d25e738">section 118D</ref><ref href="#d25e887">(8)</ref> and <ref href="#d25e922">(9)</ref>), or</p></content></level><level class="para2"><num>(ii)</num><content><p>in the case of a new stop boarding requirement imposed under this section, on the date specified in the notice of extension under <ref href="#d25e427">section 118B</ref><ref href="#d25e550">(8)</ref> or <ref href="#d25e580">(10)</ref> (see subsections <ref href="#d25e1264">(10)</ref> and <ref href="#d25e1323">(11)</ref>), and</p></content></level></level><level class="para1"><num>(b)</num><content><p>ends on the date specified in that notice, subject to subsections <ref href="#d25e1084">(2)</ref> to <ref href="#d25e1104">(4)</ref>.</p></content></level></subsection><subsection eId="d25e1084"><num>(2)</num><content><p>A stop boarding requirement imposed on the proprietor of a boarding institution ends if the suspension of the institution’s registration is lifted (see <ref href="#d25e427">section 118B</ref><ref href="#d25e466">(2)</ref> and <ref href="#d25e479">(3)</ref>).</p></content></subsection><subsection eId="d25e1098"><num>(3)</num><content><p>The Secretary of State may end a stop boarding requirement early if the Secretary of State considers it appropriate to do so.</p></content></subsection><subsection eId="d25e1104"><num>(4)</num><intro><p>Where the Secretary of State extends the suspension of a boarding institution’s registration, the Secretary of State may—</p></intro><level class="para1" eId="d25e1110"><num>(a)</num><content><p>extend an existing stop boarding requirement, or</p></content></level><level class="para1" eId="d25e1116"><num>(b)</num><content><p>impose a new stop boarding requirement (either where no such requirement was imposed previously, or to replace a previous requirement with one with different terms).</p></content></level></subsection><subsection><num>(5)</num><intro><p>Before extending an existing stop boarding requirement or imposing a new one under this section, the Secretary of State must give the proprietor notice in accordance with—</p></intro><level class="para1"><num>(a)</num><content><p>subsections <ref href="#d25e1148">(6)</ref> and <ref href="#d25e1264">(10)</ref>, or</p></content></level><level class="para1"><num>(b)</num><content><p><ref href="#d25e1323">subsection (11)</ref>.</p></content></level></subsection><subsection eId="d25e1148"><num>(6)</num><intro><p>Where the Secretary of State gives a warning notice to the proprietor of a boarding institution under <ref href="#d25e427">section 118B</ref><ref href="#d25e502">(5)</ref> (notice of proposed extension of suspension), the notice must also—</p></intro><level class="para1"><num>(a)</num><content><p>state whether the Secretary of State is proposing to extend an existing stop boarding requirement or impose a new one,</p></content></level><level class="para1"><num>(b)</num><intro><p>if the Secretary of State is proposing to impose a new stop boarding requirement—</p></intro><level class="para2"><num>(i)</num><content><p>explain the effect of a stop boarding requirement,</p></content></level><level class="para2"><num>(ii)</num><content><p>specify whether the proposed requirement would relate to all boarders at the institution or, if not, the description of boarders to whom it would relate,</p></content></level><level class="para2"><num>(iii)</num><content><p>specify the dates on which the Secretary of State proposes to start and end the requirement, and</p></content></level><level class="para2"><num>(iv)</num><content><p>explain that the proprietor may make representations about the proposed requirement during the period specified in the notice for representations about the proposed extension of the institution’s suspension (the “specified period”);</p></content></level></level><level class="para1"><num>(c)</num><intro><p>if the Secretary of State is proposing to extend an existing stop boarding requirement—</p></intro><level class="para2"><num>(i)</num><content><p>specify the date on which the Secretary of State proposes to end the extension, and</p></content></level><level class="para2"><num>(ii)</num><content><p>explain that the proprietor may make representations about the proposed extension of the stop boarding requirement during the period specified in the notice for representations about the proposed extension of the institution’s suspension (the “specified period”).</p></content></level></level></subsection><subsection><num>(7)</num><content><p>The Secretary of State must have regard to any representations made by the proprietor during the specified period in deciding whether to extend an existing stop boarding requirement or impose a new one.</p></content></subsection><subsection><num>(8)</num><content><p>Subsections <ref href="#d25e1236">(9)</ref> and <ref href="#d25e1264">(10)</ref> apply where the Secretary of State has given the proprietor of a boarding institution a warning notice under <ref href="#d25e427">section 118B</ref><ref href="#d25e502">(5)</ref> (notice of proposed extension of suspension) which states that the Secretary of State is proposing to impose or extend a stop boarding requirement.</p></content></subsection><subsection eId="d25e1236"><num>(9)</num><intro><p>Where the Secretary of State decides not to impose or extend a stop boarding requirement on the proprietor of the institution—</p></intro><level class="para1"><num>(a)</num><content><p>in a case where the Secretary of State also decides not to extend the suspension of the institution’s registration, the Secretary of State must give the proprietor a notice of the decision not to impose a stop boarding requirement at the same time as the Secretary of State gives the notice under <ref href="#d25e427">section 118B</ref><ref href="#d25e544">(7)</ref>;</p></content></level><level class="para1"><num>(b)</num><content><p>in a case where the Secretary of State decides to extend the suspension of the institution’s registration, the notice under <ref href="#d25e427">section 118B</ref><ref href="#d25e550">(8)</ref> (notice of decision to extend suspension following warning notice) must state that the Secretary of State has decided not to impose or extend a stop boarding requirement.</p></content></level></subsection><subsection eId="d25e1264"><num>(10)</num><intro><p>Where the Secretary of State decides to impose or extend a stop boarding requirement on the proprietor of a boarding institution, the notice under <ref href="#d25e427">section 118B</ref><ref href="#d25e550">(8)</ref> (notice of decision to extend suspension following warning notice) given to the proprietor must also inform the proprietor of the decision and—</p></intro><level class="para1"><num>(a)</num><intro><p>in the case of a decision to impose a new stop boarding requirement—</p></intro><level class="para2"><num>(i)</num><content><p>specify whether the requirement relates to all boarders at the institution or, if not, the description of boarders to whom it relates,</p></content></level><level class="para2"><num>(ii)</num><content><p>specify the date on which the requirement starts,</p></content></level><level class="para2"><num>(iii)</num><content><p>specify the date on which the requirement ends, which may be on the date that the suspension ends or an earlier date, and</p></content></level><level class="para2"><num>(iv)</num><content><p>explain the right of appeal conferred by section 125;</p></content></level></level><level class="para1"><num>(b)</num><intro><p>in the case of a decision to extend a stop boarding requirement—</p></intro><level class="para2"><num>(i)</num><content><p>specify the date on which the extension ends, which may be on the date that the suspension ends or an earlier date, and</p></content></level><level class="para2"><num>(ii)</num><content><p>explain the right of appeal conferred by section 125.</p></content></level></level></subsection><subsection eId="d25e1323"><num>(11)</num><intro><p>Where the Secretary of State decides to impose or extend a stop boarding requirement on the proprietor of a boarding institution in a case where the Secretary of State has not given the proprietor a warning notice under <ref href="#d25e427">section 118B</ref><ref href="#d25e502">(5)</ref> (see <ref href="#d25e427">section 118B</ref><ref href="#d25e568">(9)</ref>), the notice under <ref href="#d25e427">section 118B</ref><ref href="#d25e580">(10)</ref> (notice of decision to extend suspension in urgent cases) given to the proprietor must also inform the proprietor of the decision and—</p></intro><level class="para1"><num>(a)</num><intro><p>in the case of a decision to impose a new stop boarding requirement—</p></intro><level class="para2"><num>(i)</num><content><p>explain the effect of a stop boarding requirement,</p></content></level><level class="para2"><num>(ii)</num><content><p>specify whether the requirement relates to all boarders at the institution or, if not, the description of boarders to whom it relates,</p></content></level><level class="para2"><num>(iii)</num><content><p>specify the date on which the requirement ends, which may be on the date that the suspension ends or an earlier date, and</p></content></level><level class="para2"><num>(iv)</num><content><p>explain the right of appeal conferred by section 125;</p></content></level></level><level class="para1"><num>(b)</num><intro><p>in the case of a decision to extend a stop boarding requirement—</p></intro><level class="para2"><num>(i)</num><content><p>specify the date on which the requirement ends, which may be on the date that the suspension ends or an earlier date, and</p></content></level><level class="para2"><num>(ii)</num><content><p>explain the right of appeal conferred by section 125.</p></content></level></level></subsection><subsection><num>(12)</num><content><p>Where the Secretary of State extends a stop boarding requirement under this section, the requirement lasts until the date specified in the notice under <ref href="#d25e427">section 118B</ref><ref href="#d25e550">(8)</ref> or <ref href="#d25e580">(10)</ref> (see subsections <ref href="#d25e1264">(10)</ref> and <ref href="#d25e1323">(11)</ref>), unless it ends earlier by virtue of <ref href="#d25e1084">subsection (2)</ref> or <ref href="#d25e1098">(3)</ref> or is extended again under <ref href="#d25e1104">subsection (4)</ref><ref href="#d25e1110">(a)</ref>.</p></content></subsection></section><section eId="d25e1428"><num>118F</num><heading>Offence of providing boarding accommodation in breach of stop boarding requirement</heading><subsection eId="d25e1432"><num>(1)</num><content><p>The proprietor of a boarding institution that provides boarding accommodation to a student in breach of a stop boarding requirement is guilty of an offence.</p></content></subsection><subsection><num>(2)</num><intro><p>It is a defence for a person charged with an offence under <ref href="#d25e1432">subsection (1)</ref> to prove that—</p></intro><level class="para1"><num>(a)</num><content><p>they and the head teacher of the institution (if a different person) did not know and could not reasonably have been expected to know of the existence of the notice given under <ref href="#d25e227">section 118A</ref> or <ref href="#d25e427">118B</ref> that caused the stop boarding requirement to have effect at the time of the alleged offence, or</p></content></level><level class="para1"><num>(b)</num><content><p>the conduct prohibited by <ref href="#d25e1432">subsection (1)</ref> ceased as soon as reasonably practicable after that notice was given.</p></content></level></subsection><subsection><num>(3)</num><content><p>A person guilty of an offence under <ref href="#d25e1432">subsection (1)</ref> is liable on summary conviction to imprisonment for a term not exceeding the maximum term for summary offences or to a fine (or to both).</p></content></subsection><subsection><num>(4)</num><intro><p>“<term refersTo="#term-the-maximum-term-for-summary-offences">The maximum term for summary offences</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>if the offence is committed before the time when <ref eId="c00542" href="https://www.legislation.gov.uk/ukpga/2003/44/section/281">section 281</ref><ref eId="c00543" href="https://www.legislation.gov.uk/ukpga/2003/44/section/281">(5)</ref> of the <ref eId="c00544" href="https://www.legislation.gov.uk/ukpga/2003/44/contents">Criminal Justice Act 2003</ref> (alteration of penalties for certain summary offences: England and Wales) comes into force, six months;</p></content></level><level class="para1"><num>(b)</num><content><p>if the offence is committed after that time, 51 weeks.</p></content></level></subsection><subsection><num>(5)</num><content><p>If boarding accommodation is provided under an arrangement between a boarding institution and another person, it is irrelevant for the purposes of this section when that arrangement was made.</p></content></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-44-5"><num>(5)</num><content><p><mod>In <ref eId="c00545" href="https://www.legislation.gov.uk/ukpga/2008/25/section/124">section 124</ref> (appeal by proprietor against decision of Secretary of State to deregister), after <ref eId="c00546" href="https://www.legislation.gov.uk/ukpga/2008/25/section/124">subsection (4)</ref> insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><subsection><num>(4A)</num><intro><p>Where the Tribunal is considering disposing under subsection (3)(b) or (c) of an appeal under subsection (1)(d), it must—</p></intro><level class="para1"><num>(a)</num><content><p>have due regard to the principle that the independent educational institution standards should be met, and to the likelihood that they will be met in relation to the institution which is the subject of the appeal, on an ongoing basis, and</p></content></level><level class="para1"><num>(b)</num><content><p>for that purpose, assume those standards will not be met in relation to the institution on an ongoing basis unless its proprietor adduces sufficient evidence in the course of the appeal to satisfy the Tribunal that they will insert—<quotedStructure startQuote="“" endQuote="”" uk:context="body" uk:docName="ukpga" ukl:TargetClass="primary" ukl:TargetSubClass="unknown" ukl:Context="main" ukl:Format="double"><section><num>126A</num><heading>Determination by Tribunal of whether persons are fit and proper</heading><subsection eId="d25e1752"><num>(1)</num><content><p>This section applies where the question of whether an institution meets, has met or is likely to meet an independent educational institution standard prescribed under section 94<ref href="#d25e110">(1A)</ref><ref href="#d25e116">(a)</ref><ref href="#d25e122">(i)</ref> or <ref href="#d25e134">(b)</ref> (fit and proper persons) is relevant to an application or appeal to the Tribunal under this Chapter.</p></content></subsection><subsection><num>(2)</num><content><p>The Tribunal may determine that question for the purposes of the application or appeal, including by finding that a relevant person is, was or would be a fit and proper person to be involved in the running of an independent educational institution even if the Secretary of State is not of that opinion.</p></content></subsection><subsection><num>(3)</num><intro><p>“<term refersTo="#term-relevant-person">Relevant person</term>” means—</p></intro><level class="para1"><num>(a)</num><content><p>where the proprietor or proposed proprietor of the institution mentioned in <ref href="#d25e1752">subsection (1)</ref> is a body of persons, a person having, or proposed to have, general control and management of, or legal responsibility and accountability for, the proprietor or proposed proprietor;</p></content></level><level class="para1"><num>(b)</num><content><p>where the proprietor or proposed proprietor of the institution mentioned in <ref href="#d25e1752">subsection (1)</ref> is an individual, the individual.</p></content></level></subsection></section></quotedStructure></mod></p></content></subsection><subsection eId="section-44-8"><num>(8)</num><content><p>The amendment made by <ref href="#section-44-5">subsection (5)</ref> does not apply in relation to a decision taken by the Secretary of State under <ref eId="c00550" href="https://www.legislation.gov.uk/ukpga/2008/25/section/116">section 116</ref><ref eId="c00551" href="https://www.legislation.gov.uk/ukpga/2008/25/section/116">(1)</ref><ref eId="c00552" href="https://www.legislation.gov.uk/ukpga/2008/25/section/116">(b)</ref> of the <ref eId="c00553" href="https://www.legislation.gov.uk/ukpga/2008/25/contents">Education and Skills Act 2008</ref> before the coming into force of <ref href="#section-44-5">subsection (5)</ref>.</p></content></subsection></section></hcontainer></part></body></act></akomaNtoso>
