<Title>Independent educational institutions in England</Title>

<Pnumber>92</Pnumber>
<P1para>

<Pnumber>1</Pnumber>
<P2para>
<Text>The following are independent educational institutions for the purposes of this Chapter—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>independent schools in England;</Text>
</P3para>
</P3>
<P3 id="p09728">
<Pnumber>b</Pnumber>
<P3para>
<Text>institutions in England, other than independent schools and excepted institutions, that provide full-time education for—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>at least five children of compulsory school age, or</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>at least one child of compulsory school age who is looked after by a local authority or has special educational needs.</Text>
</P4para>
</P4>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>2</Pnumber>
<P2para>
<Text>The following subsections apply for the purposes of <InternalLink Ref="p09721">subsection (1)</InternalLink><InternalLink Ref="p09728">(b)</InternalLink> (and see section 138(1A) for provision about the meaning of an institution providing education).</Text>
</P2para>
</P2>
<P2 id="p09748">
<Pnumber>3</Pnumber>
<P2para>
<Text>Regulations may—</Text>
<P3 id="p09751">
<Pnumber>a</Pnumber>
<P3para>
<Text>specify that an amount of time is or is not to be treated as “full-time” by reference to a number of hours in, or a proportion of, a week or other period, or in any other way;</Text>
</P3para>
</P3>
<P3 id="p09755">
<Pnumber>b</Pnumber>
<P3para>
<Text>provide that time spent on a specified activity or on an activity of a specified description is or is not to be treated as time during which education is being provided;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>amend <InternalLink Ref="p09770">subsection (4)</InternalLink> so as to add, remove or amend factors;</Text>
</P3para>
</P3>
<P3>
<Pnumber>d</Pnumber>
<P3para>
<Text>amend this section so as to add, remove or amend provision about the interpretation of the factors in <InternalLink Ref="p09770">subsection (4)</InternalLink>.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2 id="p09770">
<Pnumber>4</Pnumber>
<P2para>
<Text>If, or to the extent that, the question of whether an institution provides full-time education for a child is not determined by regulations under <InternalLink Ref="p09748">subsection (3)</InternalLink><InternalLink Ref="p09751">(a)</InternalLink> or <InternalLink Ref="p09755">(b)</InternalLink>, the factors relevant to determining that question include—</Text>
<P3>
<Pnumber>a</Pnumber>
<P3para>
<Text>the number of hours per week that—</Text>
<P4>
<Pnumber>i</Pnumber>
<P4para>
<Text>education is provided to children by the institution;</Text>
</P4para>
</P4>
<P4>
<Pnumber>ii</Pnumber>
<P4para>
<Text>activities incidental to that education (such as breaks and independent study time) are provided;</Text>
</P4para>
</P4>
</P3para>
</P3>
<P3>
<Pnumber>b</Pnumber>
<P3para>
<Text>the number of weeks in an academic year that education is provided;</Text>
</P3para>
</P3>
<P3>
<Pnumber>c</Pnumber>
<P3para>
<Text>the time of day that education is provided.</Text>
</P3para>
</P3>
</P2para>
</P2>
<P2>
<Pnumber>5</Pnumber>
<P2para>
<Text>An academic year means a period of 12 months ending with 31 August.</Text>
</P2para>
</P2>
<P2>
<Pnumber>6</Pnumber>
<P2para>
<Text>A child has special educational needs if an EHC plan or an individual development plan is maintained for the child (see <Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/section/579" id="c00499" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="section-579">section 579</Citation><Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/section/579" id="c00500" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="section-579">(1)</Citation> of the <Citation URI="https://www.legislation.gov.uk/ukpga/1996/56/contents" id="c00501" Class="UnitedKingdomPublicGeneralAct" Year="1996" Number="56" SectionRef="contents">Education Act 1996</Citation> for the meaning of “EHC plan” and “individual development plan”).</Text>

<Text>A reference to a child who is looked after by a local authority is to be read—</Text>
